RESOLUTION
RE: APPROVE DECLARATION OF OIL AND GAS LEASE EXPIRATION
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Weld County executed and delivered that certain Oil and Gas Lease (the
"Lease"), dated August 25, 1975, recorded October 24, 1975, in Book 751 under Rec. No.
1673042, which Lease covered the following lands in Weld County, Colorado, to wit:
Township 8 North, Range 59 West, 6th P.M.
Section 4: Lot 4, SW1/4NW1/4
Section 5: Lot 1, SE1/4NE1/4, S1/2S1/2NW1/4
Section 8: S1/2
Township 8 North. Range 60 West, 6th P.M.
Section 8: NE1/4, E1/2NW1/4
Section 17: NE1/4
Township 5 North, Range 61 West, 6th P.M.
Section 4: Lot 3, SE1/4NW1/4, E1/2SW1/4, E1/2SW1/4

WHEREAS, according to the records of the Colorado Oil and Gas Conservation
Commission all wells drilled on lands covered by and under the terms of the Lease have been
plugged and abandoned, except for the James Davis #1 well in the SE1/4NE1/4 of Section 21,
Township 5 North, Range 61 West, of the 6th P.M., Weld County, Colorado, which has been shut
in and temporarily abandoned since at least 1999, and
WHEREAS, the Lease was for a term of five years from the date thereof and for so long
thereafter as oil or gas, or either of them, is produced from said land or from lands with which said
land is consolidated, or the premises are being developed or operated, and
WHEREAS,there is no producing well and there have been no operations or development
on said lands or lands consolidated therewith.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that as the owner of the minerals under the lands above described, it be, and
hereby is, declared that the Lease expired by its own terms and that the Lease has been null and
void as to all lands described therein since at least January 1, 2000.
The above and foregoing Resolution was, on motion duly made and seconded, adopted by
the following vote on the 3rd day of January, A.D., 2007.
