Excepting and reserving unto Grantor all water rights, Including the rights associated
with the Wilson Sump, Permit No. O3195-F, Decree No. W-2654, Weld County,
Colorado.
Also excepting and reserving unto Grantor an easement for the Wilson Sump, for the
purposes of pumping, capturing, diverting and applying to beneficial use the waters
• of the Wilson Sump as recognized in Permit No. O13195-F and Decree No. W-2654,
Weld County, Colorado. The location and dimensions of the Wilson Sump are more
particularly set forth in Exhibit"A," attached hereto. Said easement shall include the
right to traverse Grantee's property to maintain, replace, and make use of the Sump
pumps or other diversions structures or works, as well as the right to maintain and
use Wilson Sump line no. 1 to carry Sump waters from the site of Wilson Sump to
Grantors property, Block 52, a Minor Resubdivision of the Amended Plat of the Town
of Barnesville, County of Weld, State of Colorado, according to the Map recorded
December 17, 1999 as Reception No. 2739264, located in the Northeast 1/4 of
Section 18, Township 6 North, Range 63 West of the 6th P.M, The path of Wilson
Sump line no. 1 is more particularly set forth in Exhibit "A" attached hereto. The
described easement shall for be for the benefit of Block 52 and shall be a burden on
the property transferred to grantor herein, shall be perpetual, and shall be binding
upon Grantor's grantees, heirs and assigns.
Also excepting and reserving the easement for the use of the Wilson Sump granted
to the Wilson Sump Water Users Association.
Grantee shall be entitled to 5 shares of the Wilson Sump Water Users Association,
as set forth more fully in the Articles and Bylaws of that Corporation.
TOGETHER with all and singular the hereditaments and appurtenances thereto
belonging, or in anywise appertaining, and the reversion and reversions, remainder
and remainders, rents, issues and profits thereof, and all the estate, right, title,
interest, claim and demand whatsoever of the grantor(s), either in law or equity, of,
in and to the above bargained premises, with the hereditaments and appurtenances.
