A regular meeting of the Weld County Utilities Coordinating Advisory Committee was held on Thursday,
April 12, 2007 at 10:00 a.m., in the Conference Room of the Weld County Planning Department at 918
10'"Street, Greeley, Colorado.
Members Present: Don Somer, Brian Varrella and Alan Overton.
Members Absent: Robert Fleck, Doug Melby, Lyle Sheeder, Jerry Adams, Don Magnuson and Al Trujillo.
Also Present: Hannah Hippely and Kris Ranslem, Department of Planning Services, Robert Parsons and
Jeff Couch.
Brian Varrella called the meeting to order at 10:25 a.m.
Don Somer moved to approve the minutes of the last regular meeting of March 6, 2007, seconded by Alan
Overton. Motion carried.
CASE NUMBER: MF-1025
PLANNER: Hannah Hippely
APPLICANT: Robert Parsons
LEGAL DESCRIPTION: Lot B of RE-3358; being Part of the NW4 of Section 10, T7N, R67W of
the 6'" P.M., Weld County Colorado.
REQUEST: Minor Subdivision Plat for 8 residential lots, Peace Haven Estates, with
Estate Zoning.
LOCATION: East of and adjacent to CR 19 and south of and adjacent to CR 84. For a
more precise location, see legal.
Hannah Hippely, Department of Planning Services, presented Case MF-1025. She stated that the
application is for an eight lot subdivision.
The site is located south of County Road 84 and east of and adjacent to County Road 19.
The proposed subdivision will be serviced by:
North Weld County Water District
Individual Septic Systems
Gas =Xcel Energy
Electric= Poudre Valley REA
Phone= Qwest
Sec. 24-7-60. Easement standards.
A. Easements shall follow rear and side lot lines whenever practical and shall have a minimum
total width of twenty (20)feet apportioned equally on abutting properties.
B. Where front line easements are required,a minimum of fifteen (15)feet shall be allocated as a
utility easement.
C. Easements shall be designed to provide efficient installation of utilities. Special guying
easements at corners may be required. Public utility installations shall be located to permit multiple
installations within the easements to avoid cross connections, minimize trenching and adequately
separate incompatible systems.
The Department of Planning Services is comfortable with the easements shown on the plat which are
in compliance with Section 24-7-60 of the Weld County Code.
Ms. Hippely brought up the question of a possibility that there will be a secondary access that runs
from CR 84 south to the 30'utility and drainage and emergency access easement shown that comes
off the cul-de-sac. It is her understanding that this easement is for the fire department and will be
temporary until such time that the shown easement connects to a cul-de-sac on the subdivision to the
east. Most likely that easement would be co-located with a 20' utility and drainage easement that is
shown on the plat.

Brian Varrella confirmed that is the one that comes off the southeast of the cul-de-sac. Ms. Hippely
replied that it is and therefore it would really just change the language on the 20' utility and drainage
easement that is shown on the eastern edge of the subdivision to utility, drainage and emergency
access easement.
Alan Overton asked if there are conditions upon that which need to be provided if the other access is
not available. Ms. Hippely stated that considering the subdivision to the east is not constructed
currently it will be included in the staffs conditions of approval that this be constructed and maintained
until such time that they can connect to the subdivision next door.
Alan Overton inquired about the electric transmission line easement that is shown on the plat that is
overlapping CR 84. He commented that you need to make sure that the 15' utility and drainage
easement that is within that is acceptable with the electric company.
Ms. Hippely replied that staff can include that in the conditions of approval and that it will be allowed in
that easement or move the 15' utility and drainage easement out of that.
Mr. Varrella asked if there was any public input.
Jeff Couch, Team Engineering, stated that he is the engineer for the project and the owner, Robert
Parsons is here as well. He summarized that this is a minor subdivision and there are no public open
spaces with it so they have provided the standard easements along both sides of the road right-of-way
and on the lot lines and on the property perimeter. He added that we need to change the utility
easement up along CR 84 on the south side and get it outside of the power line easement.
Alan Overton asked about the 150' no build setback from the eastern boundary. Robert Parsons
stated that they will vacate it. Mr. Parsons added that it was a condition upon the sale when they
purchased it and since his brother-in-law owns the one to the east they have mutually agreed to vacate
it. Alan Overton stated that it should be done before final plat. Brian Varrella added that it needs to be
done for the septic systems as well since they are shown in that setback.
Hannah Hippely clarified the changes which include removing the 15' easement, making the no build
setback and removing the septic envelopes and adding the emergency access language.
Alan Overton motioned to approve MF-1025 along with the changes stated, seconded by Don Somer.
Motion carried.
