I am in receipt of your letter of October 1, 2007, a copy of which is enclosed herewith.
Please be advised, I am writing on behalf of the applicant, Roland Wagner, he does intend to
comply with all of the provisions required as conditions of approval for the above USR. Mr.
Wagner has advised me he has been in contact with the Planner in this matter and has completed,
to the best of his knowledge, all of the requirements. He has contacted the planner to come out
and view the property for an inspection,to ascertain compliance.

Re: Conditions of Approval: USR-1589
Dear Applicant:
On April 1,2007,your application for a use by special review was administratively approved by the Weld
County Board of County Commissioners with specific Conditions of Approval.
One of the required Conditions of Approval grants applicants sixty(60) days to submit a Mylar Plat. Should
you choose not to complete the use by special review process and provide the required Mylar Plat, the
Department of Planning Services will need to be notified in writing of your decision.
If you do not formally withdraw your application and/or are unable to meet the Conditions of Approval, your
case will be scheduled for a hearing before the Weld County Board of County Commissioners. Planning
Staff will be recommending denial or your request at this hearing. If your application is denied by the Board
of County Commissioners, the decision could affect future land development applications located on this
parcel.Withdrawing applications will not generally affect future applications.
Planning Services Staff is aware of the difficulty and associated delays in meeting the Conditions of
Approval normally associated with land use cases, and is willing to work with you in completing your
request. Please notify the Department of Planning Services, in writing,within 10 working days of your
decision. Planning Services Staff can be contacted at the above address or phone number.

The Weld County Department of Planning Services Staff has closed the zoning violation case on your property
as your Use by Special Review(USR-1589)permit was approved by the Board of County Commissioners on
April 11, 2007.
Please keep in mind that failure to complete USR-1589 and have the plat recorded or any future non-
compliance of USR-1589 would be processed as a Probable Case. Depending on the violations, Planning
could recommend that USR-1589 be revoked. Please continue to speak with Michelle Martin in order to
ensure that this permit is completed within a timely fashion.
