RESOLUTION RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL ACTION AGAINST SHERRILYN AND ARLO BODA FOR VIOLATION OF THE WELD COUNTY CODE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Sherrilyn and Arlo Boda, VI #0600383, are allegedly in violation of the Weld County Code, and WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has not been corrected, and WHEREAS, on the 19th day of June, 2007, a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violation, and WHEREAS, Sherrilyn and Arlo Boda were not present or represented at said hearing, although all parties were notified of said hearing by Department of Planning Services staff, and WHEREAS,the Board of County Commissioners deems it advisable to refer said violation to the Weld County Attorney's Office for legal action, with an instruction for delay of action upon such referral until December 19, 2007, to allow adequate time for the property owners to complete the screening of the property from all adjacent properties and public rights-of-way, and until August 19, 2007, to submit a Building Permit application for the mobile home to bring the subject property into compliance and for an inspection of the property by the Department of Planning Services staff. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that VI #0600383 be, and hereby is, referred to the Weld County Attorney's Office for legal action against Sherrilyn and Arlo Boda to remedy the violation of the Weld County Code, and any other persons occupying the properties, any persons claiming an interest in the properties, and any persons acting in active concert with the identified parties, with an instruction for delay of action upon such referral until December 19, 2007, to allow adequate time for the property owners to completely screen the noncommercial junkyard from all adjacent properties and public rights-of-way, and until August 19, 2007, to submit a Building Permit for the mobile home to bring the subject property into compliance. 2007-1667 PL0824 (Y . We sent a letter to Little Thompson water regarding another water tap. We also spoke to the Dr. and requested a letter. Septic is okayed. As soon as they hear from the water company they will be able to submit a building permit for that mobile home. The oil company supposedly moved the 2007-1667 Vi_lation Summary Rep. .t oil and gas equipment so that the mobile home should not be an issue. They are still shooting for November 7th. She says that based upon a new map that the oil & gas company has provided them, everything will be at least 200' away. I told her that we will verify that through the building permit process. She said she'd stay in touch. 08/28/2006 Property Inspected Upon a visual inspection of the property, the following items were noted: 2 mobile homes (1 yellow-2001 & 1 old mobile home - blue/white/grey). Derelict vehicles & miscellaneous debris. No pictures were taken during this inspection. 09/05/2006 Property Inspected During an on-site inspection with Sheri &Arlo, the following items were noted: Colorado Oil and Gas Conservation Commission (COGCC). Zoning Permit for Medical Hardship and Building Permit need submitted within 60 days along with a letter addressing the remaining Noncommercial Junkyard and Commercial Vehicle issues. Left a copy of this inspection report on-site with Mr. & Mrs. Boda. No pictures were taken during this inspection. 08/30/2006 Property Inspected Fred San Martin (Building Inspector) Red tagged the Mobile Home & hot tub. He wrote the following on his correction notice: permit required for mobile home. Please contact our office regarding this within 5 days. 09/28/2006 Letter Received Received letter from Sheri Boda. 10/02/2006 Other Sent letter approving the proposed time line. 03/15/2007 Other Wendi Inloes sent letter requesting additional information in order to issue the building permit. She set a time limit and advised them that failure to do so would result in a Violation Hearing being scheduled for May 8th. 04/16/2007 Certified Mail Receipt Hand delivered the Certified letter to Sheri Boda during an office visit. 04/20/2007 Office Visit Sheri came into the office to discuss the oil &gas agreement and her violation. This violation was initiated due to the presence of a mobile home without any of the necessary Zoning or Building Permits in addition to other zoning violations. This violation has not yet been presented to the Board of County Commissioners through the Violation Hearing process. This application if approved, will partially correct the violation.
