Said permits were applied for in April 2006, and were approved in June of 2006. At the time the applications were applied for and approved KMG did not believe the subject lands on which the wells were to be drilled were located within-an approved Weld County PUD. As it turns out, the wells will be drilled within the St. Vrain Lakes PUD, which was recorded on July 6, 2006. Only recently, has KMG learned that these wells were situated within a Weld County PUD and a Weld County USR would be required prior to drilling the subject wells. KMG has cleared the surface location and has scheduled these wells to be drilled the first and second week of February, 2007. Considering the above, and in light of the fact that Carma Bayshore, the surface owner, has no objections to,KMG drilling the subject wells at this time and at the platted locations, KMG is requesting approval from the Weld County Planning Department and the Weld County Building Department for an early release, and or waiver of any requisite building permits from the Weld County Building Department in order that KMG may proceed with the immediate drilling of the subject Rademacher wells outside of applying for the requisite USR and final resolution of the USR process. 2001 3154- Pi. 1815 Please know that KMG agrees to apply for, in a timely manner, and complete the USR process as required by the Weld County Planning Department, and to conduct its future operations in accordance with the final Development Standards per the USR Resolution to be crafted by the Weld County Board of Commissioners. If this meets with the Weld County Planning Departments approval, it is kindly requested that you forward this request for early release and or waiver for a building permit to the appropriate parties within your department and the building department. To assist you in this request I have enclosed a copy of the approval letter from Carma Bayshore, copy of the well survey plats and the approved permits from the Colorado Oil and Gas Conservation Commission.
