Based upon expected student generation rates from what appears to be the r possibility of nine new single-family units on approximately 81.25 acres, the new homes would generate approximately 9 new students to be accommodated within district. Bus transportation would likely be provided. It is understood that approval of the proposed new lot does not yet add residential units to enrollment potential. However, certain school issues should be considered at this important juncture, including school site planning, transportation access and facility capacity. The current facilities that would serve this lot are Twombly Elementary or Butler Elementary, Fort Lupton Middle School and Fort Lupton High School. Weld County School District RE-8 requests the cooperation and participation of the developer to provide cash in-lieu of land dedication fee, (currently $939 per new lot) , to address the need for future school sites. Further, the District requests that the County assist with monitoring residential growth working and consider facility capacity impacts upon the schools in determining whether a new project should be approved. We appreciate your cooperation and the opportunity to comment upon the issues of interest to both the County and the School District. We ask that the recorded exemption not be approved until the applicant demonstrates that the cash in-lieu of land dedication fee has been paid, or that arrangements have been made with the School District. Comments made during this stage of the review process may not be all-inclusive, as revised materials will have to be resubmitted and other concerns or issues may arise during further review Comments General Comments : A traffic study for the proposed subdivision was not required because access was from WCR 19 a paved roadway capable of handling the additional traffic. Thus,no offsite improvements were required. CR 19 is classified by the County as a collector road(Weld County Roadway Classification Plan,June 2002)adjacent to the proposed development requiring an 80-foot right-of-way. The applicant shall dedicate the existing right-of-way and the documents creating the right-of-way shall be noted on the final plat. le pavement design shall be amended to show 6"Minimum Class 5 Road Base to comply with County Standards. All typical road cross sections and notes regarding the roadway shall be revised to illustrate this change. Construction Plans: Stop signs and Street name signs shall be required at all intersections in accordance with the MUTCD standards and shown on the plans. The following seeding note shall be added to the grading and erosion control notes: Unlined drainage facilities and all areas disturbed during construction shall be actively revegetated. Seed mixes should be selected to match the conditions where they will be used. Recommended seed mixes may be obtained from the Weld County Public Works Pest and Weed Supervisor. Public Works requires 3 sets of final construction plans with original P. E. stamps, signatures and date. One check set of final construction plans may be submitted for review prior to supplying the 3 sets of signed plans. Drainage: A Drainage and Investigation and Erosion Control Report for Distant Thunder PUD dated April 2002,by Messner Engineering Inc. is in acceptance and was approved by the Board of County Commissioners on June 23, 2004. In the Sketch Plan review, the Department requested that primary and secondary septic envelopes be placed on the lots. The applicant placed them on the Change of Zone plat and they were approved by the Department. However, they were never recorded on the Change of Zone plat. The Department recommends that the septic envelopes with the Change of Zone plat submittal date of May 1, 2002 (including the 200 foot setback to the wetlands) be recorded on the Final Plat. 2. There are not Plat Notes on the Final Plat 3. There is no language for the preservation/protection of the second absorption field envelope in the development covenants. However, there is some similar language in the Design Guidelines (pg. 9), which will not be recorded as part of the covenants. The Department requests that any language placed in the covenants be the exact language as stated in the Change of Zone resolution. 4. Section 4.7 of the covenants includes language that appears to incorporate some measures of managed septic systems. However, the Department is concerned that this management of septic systems 'if fewer than all of the Lots contain septic systems' (as the Section quotes) should include all septic systems in the subdivision or none of the septic systems. 5. Covenant Sections 13.5.5 and 13.5.6 refer to parcels of the subdivision that are governed and have the right of withdrawal (respectively)from the requirements of the covenants. These Sections, as well as Section 13.8.1, also reference Exhibits A and D which were not included in the draft covenants. The City does not have an objection to the development itself but questions the PUD zoning requested by the applicant. Traditionally, PUD zoning should only be afforded to developments that propose a mix of uses and that are compatible with surrounding land uses. Planned Unit Developments should permit and encourage innovative design and high quality, master-planned urban developments on large parcels of land; to permit greater flexibility in the application of zoning and development standards and greater freedom in providing a mix of land uses in the development of a balanced community; to preserve critical environmental resources, provide above-average open space and recreational amenities, include exceptional design, and provide greater efficiency in the layout and provision of roads, utilities and other infrastructure; to provide flexibility in land planning and development, resulting in amenable relationships between buildings and ancillary uses, and permitting more intensive use of land where well related open space and recreational facilities are integrated into over-all design; to encourage unity and diversity in land development resulting in convenient and harmonious groupings of uses, structures and common facilities, varied type design and layout of housing and other buildings; and appropriate relationships of open spaces to intended uses and structures; to encourage unified and planned development of a site, with or without customary subdivision into single lots, and without specific application of the district regulations as provided for individual lots; to provide for and encourage the preservation and enhancement of desirable natural r- landscape and other features unique to a development site; to provide reasonable standards and criteria by which the specific proposals for a PUD can be evaluated; and finally to provide a procedure which can relate the design and layout of unified residential, commercial or industrial developments to the particular site and demand for such development in a manner consistent with the preservation of property values within established residential and agricultural areas. Although Weld County Code Section 23-2-650 does not address the above listed criteria for PUD zoning the City of Fort Lupton would like to encourage the County to address PUD zoning in future land use cases. This is especially important with future unincorporated developments within close proximity to municipalities and IGA areas. It appears that parcel 146910000012 is situated and surrounded by agricultural uses. Weld County Code Section 23-2-710(b)(3) states "...uses which would be permitted shall be compatible with the existing or future DEVELOPMENT of the surrounding area as permitted by the existing zoning, and with the future DEVELOPMENT as projected by Chapter 22 and any other applicable code provisions or ordinance in effect or MASTER PLANS of affected municipalities." It appears that Distant Thunder PUD is not compatible with the existing zoning of the surrounding area. Furthermore it appears that Distant Thunder PUD does not comply with Dacono's Comprehensive Land Use Plan revised January 2005. The application indicates in paragraph 6.3.8 that a signed agreement between the applicant and the City of Dacono dated March 15, 2004 addresses the concerns of Dacono and the proposed PUD. Weld County should encourage the applicant to revisit the agreement with Dacono to make sure that changes to Dacono's Master Plan have not been amended. In addition, Fort Lupton is currently in the process of updating its Comprehensive plans, which include a major update to the land use plan. Although Distant Thunder PUD is west of Weld County 21 and outside Fort Lupton's future planning and growth area it is within close proximity to Dacono's planning area. Weld County is aware that the City of Fort Lupton has a pending IGA with Dacono that addresses land uses and future planning. Some of the language that may be incorporated in the draft IGA with Dacono deals with land development in unincorporated Weld County and within IGA boundaries. Has the applicant contacted Dacono to see if Dacono prefers to annex this property? Again, thank you for allowing the City of Fort Lupton to comment on this proposal. It is noted however, that the commitment letter from Central Weld County Water District ("District"), dated June 19, 2001, states that the District requires that contracts be consummated within one (1) year from the date of the letter or the letter shall become null and void unless extended in writing by the District. No additional information was provided to show that a contract had been consummated or that the commitment letter had been extended. A Planned Unit Development(P.U.D.)Sketch Plan Application including a conceptual description of the proposed development,a Site Sketch Plan,prepared by Intermill Land Surveying and Engineering Geology Report, prepared by Church and Associates, May 30, 2001,were included in the referral. The site is located on 81.25 acres, the nine (9)proposed residential lots will occupy 33.66 acres and the remaining 47.59 acres will be designated as open space. The site geology consists of gently • sloping eolian sand, silt and clay which overlies the Cretaceous Laramie Formation. The Laramie Formation Is dominantly a daystone shale with interbedded sandstone and coal. The site Is located approximately one mile east of the Boulder—Weld Coal Field overlay district. The following conditions were observed in the referral and during the site visit 1) Soils. The sandy day soil was observed by Church and Associates to be slightly expansive in one of the samples taken at the site.The spoil piles at the test pit locations exhibited a"popcom"texture typical of expansive days. Soil and bedrock on the site, containing larger day fractions may be more expansive.Additional soil sampling and testing should be done for each individual foundation • and sewage system that will be constructed on the site. Swelling clay soil can cause structural damage over extended periods of time when structures are not engineered to a site's soil conditions. Perimeter drains are recommended for all structures founded in swelling soils and /or bedrock to deter water from "ponding" in the subsurface and causing saturation and subsequent expansion of the days. The slow percolation rate of the clay soil has a two-fold risk.One is associated with the installation of a sewage disposal system; the other is that of perched water tables.The slow percolation rates typical of day soils may decline with a swelling clay and further limit the performance of an ISDS. As indicated by Church and Associates, engineered sewage disposal systems should be anticipated for most or all of the lots,depending upon site specific percolation test results.Although no groundwater was encountered during the Church and Associates excavation of test pits, seasonal perched water tables may result from the presence of interbedded sands and days in the • Page 2 August 15,2001 subsurface. Groundwater levels on each lot should be measured and used to design the foundation systems which will be constructed on the site. Soil consisting of eolian sand and sift is highly erodible when stripped of vegetation. Sparse vegetation and bare soft was observed on the east side of the property during our visit.Adequate measures should be taken to minimize soil erosion during and after the grading and construction phases of the project.This may be achieved by establishing a permanent stand of native grasses • on the site.All areas disturbed by construction should be re-vegetated in a timely manner. 2) Drainage. During our site visit, a topographically low area was observed on Lot 3. This area supports grasses and cat-tails typically found In wetland environments.Although no standing water or marshy soil was observed at the time of our visit,seasonal fluctuations may occur.The building envelope for Lot 3 should be positioned well away from this area to avoid the risk of shallow flooding. In summary,the site's geologic condition should not preclude development of the proposed subdivision.
