HomeMy WebLinkAbout841023 RESOLUTION RE: APPROVAL OF RECORDED EXEMPTION NO. 683 - LLOYD AND JEAN BRANCH AND RANDY PREMER WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners, pursuant to its authority under Section 30-28-101 (10) (d) , CRS, as amended, did determine at a public meeting held in the Chambers of the Board, that a certain parcel of land, to be divided into two parcels, as shown on the plat known as Recorded Exemption No . 683 , does not come within the purview of the definition of the terms, "subdivision" and "subdivided land" , and WHEREAS, the request for Recorded Exemption No. 683 was sub- mitted by Lloyd and Jean Branch and Randy Premer for property beling located in part of the NE4 of Section 3 , Township 4 North, Range 64 West of the 6th P.M. , Weld County, Colorado, being more particularly described in the plat which shall be provided by the applicants and known as Exhibit "A" , said plat to be re- corded, and WHEREAS, this request is to divide the property into par- cels of 8 acres and 2 acres, more or less , to allow the appli- cants to legitimatize the illegal transfer of a parcel of ground sold subsequest to the adoption of the Weld County Subdivision Regulations and obtain a building right for the proposed eight acre parcel. NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado that the hereinabove de- scribed parcel of land be, and hereby is, exempt from the defi- nition of the terms, "subdivision" and "subdivided land" . BE IT FURTHER RESOLVED by the Board that this approval is conditional upon the applicants submitting a mylar plat to the Department of Planning Services to be recorded in the office of_ the Weld County Clerk and Recorder. The parcel of land on which this request is being made is described as Pt. NE11 of Section 3, T4N, R64W of the 6th P.M. , Weld County, Colorado. The property is located 2.5 miles south of Kersey on WCR 57. The property contains approximately 10.3± acres of Class Ile, IVe irrigated and IVe nonirrigated soils. The parcel of land under consideration is not the total contiguous land holdings of the applicant. The request is to divide the property into parcels of 8 acres and 2 acres, more or less. Mr. and Mrs. Branch and Mr. Premer would like to separate a parcel of ground transfered and sold in an illegal manner subsequent to the adoption of the Weld County Subdivision Regulations. The purpose of the exemption is to legitimize the illegal transfer and obtain a building right for the proposed eight acre parcel. Based upon the submitted information and policies of the County, the Department of Planning Services staff recommends the request be approved for the following reasons: 1. The request complies with Section 9-2C. of the Weld County Subdivision Regulations submission requirements; and 2. The request complies with Section 9-2E. of the Subdivision Regulations as follows: - The 10.31 acres, more or less, under consideration will allow uses that are consistent with the intent clause of the agricultural zone district. The uses will be compatible with the existing surrounding uses. - The proposal was reviewed by the city of Kersey and was found to comply with their long-range Comprehensive Plan. F^.1.423 Board of County Commissioners Page 2 - The proposal is in compliance with Section 1-3 of the Weld County Subdivision Regulations and the proposed land division complies with the Weld County Comprehensive Plan. Therefore, the proposed use is consistent with efficient and orderly development. - The proposal does not exist in an overlay district area. - The proposed lots meet minimum lot size requirements for land division. - Central Weld County Water District has indicated adequate water service is available for this proposal. - The proposed lots are not part of a recorded exemption within the last five (5) years. - The two lots proposed will have adequate access from WCR 57. The Department of Planning Services staff recommendation for approval is conditional upon the following: 1. The applicant shall submit a mylar plat to the Department of Planning Services to be recorded in the office of the Weld County Clerk and Recorder. The plat shall be drawn in accordance with the requirements of Section 9-2C. (4) of the Weld County Subdivision Regulations. The parcel owned by Randy Premer is known as "part of parcel G." The parcel owned by Lloyd and JeanniejBranch is known as "Parcel E, F and part of G. " After the Recorded Exemption regulations had been in effect, 2 acres of "parcel G" was divided and sold separately by the previous property owners, without going through the Recorded Exemption process , hence, an improper land split was created that we are now trying to correct. This proposal is consistent with the policies of the Weld County Comprehensive plan in that the uses and nature of thelland will not be changed by this process . The land now in question is zoned agriculture and shall remain with primary agriculture use, thus ensuring the proposal is consistent with the intent of the zone district in which the subject property is located. Uses that will be permitted are limited to those permitted by the County agriculture zoning ordinance which included crop, pasture, and limited animal husbandry. This is compatiable with existing surrounding land uses as these are presently engaged in the same uses. The uses permitted will be compatible with the future development of the surrounding area as permitted by the existing zone and with future development as projected by the comprehensive plan of the County. The property in question is not located within a 3 mile radius of any municipality. This proposal will not be inconsistant with efficient and orderly development as possible development will involve only one, one-family residence being added which will not increase the density of the sur- rounding area. Sewage disposal methods are septic systems in the area, which have been shown to be effective in the area. The Central Weld Water District does provide service to the area and will provide a tap for the parcel . The property under consideration is not located in a flood plain, geologic hazard, or Weld County Airport overlay district. This applica- tion complies with section fifty (50) , overlay district regulations as outlined in the Weld County Zoining Ordinance. At the time Branch 's bought their property they purchased two separate parcels, one being the parcel in question and the other being approx- imately 22 acres adjoining, which is a separate legal parcel . Upon purchase of this property, Branch 's obtained verbal confirmation from the Weld County Planning Department that they in fact had two separate 811023 Page 2 legal parcels with the right to build on the parcel "E, F and part of G. " They went ahead with their purchase on this information, and title insurance was granted, and taxes paid on it as a separate parcel . They have only discovered recently, when trying to sell the parcel , that while it is a separate legal parcel from their 22 acres , it is not legally separate from the adjoining property owned by Randy Premer, and the County will not allow them a building permit. When Randy Premer purchased his property, he obtained a new Federal Land Bank loan and title insurance which stated it was a legally divided parcel . The County has been taxing this parcel separately. It is as a cure for this problem that we now seek a Recorded Exemption for the two parcels.
