HomeMy WebLinkAbout20071402.tiff RESOLUTION RE: ACCEPT DEED OF DEDICATION FOR EAST 24TH STREET AND CHERRY AVENUE AND AUTHORIZE CHAIR TO SIGN - DOUGLAS AND DOROTHY UYEMURA WHEREAS,the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS,the Board has been presented with a Deed of Dedication for East 24th Street and Cherry Avenue between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County,on behalf of the Department of Public Works,and Douglas and Dorothy Uyemura,2119 Cherry Avenue,Greeley,Colorado 80631,with terms and conditions being as stated in said Deed of Dedication, and WHEREAS,after review,the Board deems it advisable to accept said Deed of Dedication, a copy of which is attached hereto and incorporated herein by reference. NOW,THEREFORE,BE IT RESOLVED by the Board of County Commissioners of Weld County,Colorado,that the Deed of Dedication for East 24th Street and Cherry Avenue, between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County,on behalf of the Department of Public Works, and Douglas and Dorothy Uyemura, be,and hereby is, accepted. BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized to sign said Deed of Dedication. As part of the approval process, the City of Greeley is requiring JCM Development to realign the intersection of East 24th Street and Cherry Avenue. As part of that realignment, the adjacent property owners have agreed to dedicate an additional 15' of Right of Way for the road improvements. This additional Right of Way is located along the north side of East 24th Street and the West side of Cherry Avenue, which is in Weld County. Attached is a map showing this additional Right of Way. The safety of the intersection of East 24th Street and Cherry Avenue is being improved through this realignment. Weld County is being asked to pass a Resolution, at a Board of County Commissioners meeting, accepting this additional Right-of-Way, which is being offered at no cost or fee to the County. What options exist for the Board? (Include consequences,impacts, costs, etc. of options) The Board may accept or reject the additional Right of Way that is being offered for dedicated. Acceptance of this dedication will help to improve the safety of the intersection. Rejection may require JCM Development and the City of Greeley to seek other methods of improving this intersection. Recommendation to the Board: Public Works Department recommends that the Board accept this additional right of way.
