RE: Annexation Impact Report for Nature's Park Annexation
Dear Commissioners;
In accordance with Section 31-12-108.5 C.R.S.,we respectfully submit this letter and the attached maps as the
annexation impact report for the Nature's Park Annexation into the Town of Milliken.
In compliance with the annexation act,this property will be urbanized in the near future. Western Equipment has
petitioned to annex this property so that all of their holdings in Section 35 and Section 2,Township 5 North, Range 67
West will be within one political entity(their parcel to the south is already within Milliken Town limits). They are
requesting that this property is initially zoned agricultural so that they can continue with the existing land use until
they have master planned all of their holdings. They anticipate that the ultimate land use will include a range of
residential densities and open space that incorporates the site's natural features and preserves wildlife travel
corridors. There is also an area near the historic Fairview School,along the Greeley Loveland Irrigation Canal that
they plan to include a small commercial pad. No preliminary or final plans for a subdivision of this property have
been submitted with the petition. Specific calculations as to the sizing of infrastructure to serve this project cannot be
generated until a preliminary plat is filed. Thus,the eventual infrastructure requirements for subdivision are unknown
at the time of annexation. The Town is providing you with its most current information on its planned extensions of
water,sewer,streets and other infrastructure for this property based on available information.
Project Location: This site is located east of Highway 257 and south of Weld County Road 52.
Legal Description:
The east'%of the northwest and the west% of the northeast quarter of Section 35,the south 30 feet of the east'/ of
the southwest and the west'/ of the southeast quarter of Section 26, Township 5 North, Range 67 West of the 6th
P.M., County of Weld,State of Colorado.
Said property contains 160.41 acres,more or less.
Following is a list of the items that the Town is required to address for the Commissioner's benefit.

1. A map or maps of the Town and adjacent territory showing:the present and proposed boundaries of the
Town in the vicinity of the proposed annexation;and the present streets, major trunk waterlines, sewer
interceptors and outfalls, other utility lines and ditches and the proposed extension of such streets and utility
lines in the vicinity of the proposed annexation.
Attached,please find a vicinity map that illustrates the current and proposed Town limits, present streets,
major trunk water lines,sewer interceptors and outfalls and ditches. In addition, please find excerpts from
Milliken's draft Master Water/Wastewater Plan and the Milliken Land Use Map. These maps provide
information about existing and proposed sewer and water lines and streets.
Sewer will be served to the site via a lift station proposed at the north end of Ethel Street near the
southeastern most corner of the Western Equipment property. Western will construct the sewer main from
WCR 52 to the lift station. Water service will be extended via a 12" main connecting to the existing main of
the west side of Highway 257. The water main will extend east and northerly across the property to reach
WCR 52 at a point east of the Greeley Loveland Irrigation Canal where it would eventually extend along the
road. That line will be oversized at 12"to serve as the WCR 52 main.
2. A copy of any draft or final pm-annexation agreement, if available.
The Town did not enter into a pre-annexation agreement.
3. A statement of the Town's plans for extending or providing for municipal services within the area to be
annexed.
This property is included in Milliken's master water and sewer plans and the Town and the entities below are
capable of providing services to this area.

* The property is currently within the Johnstown Fire Protection District. If this annexation is approved,the Western
Truck and Equipment will petition for inclusion into the Milliken Fire Protection District.
4. A statement of the Town's plans for the financing of municipal services within the area to be annexed.
The Petitioners are aware that Milliken has enacted fees and policies with the intention that growth should
pay its own way and that growth should improve the health,safety and welfare of its citizens. Examples of
Milliken's fees which are acceptable to the petitioners include fees for: raw water purchase,trails and open
space,public facilities infrastructure, streets, police infrastructure,capital investment,water meter purchase
and taps.
The Petitioners will design and install transportation infrastructure, utility infrastructure,and stormwater
improvements to serve the Property prior to the issuance of any building permits for all or any portion of the
property in accordance with Town standards. The Petitioners shall make such other improvements as
required by Town ordinances and resolutions,to guarantee construction of all required improvements, and,
if requested by Milliken,to dedicate to Milliken any or all other required improvements. The Petitioners are
required to dedicate free and clear of all liens and encumbrances of any kind, and at no charge to the Town,
all easements and rights-of-way for streets and other public ways and for other public purposes,within the
Property. The Petitioners will dedicate,with the subdivision of the Property and at no cost to the Town, all

required easements and right-of-way for installation and maintenance of infrastructure. The Petitioners will
enter into a subdivision improvements agreement pertaining to such improvements and other matters at
time of final plat.
5. A statement identifying all existing districts within the area to be annexed.
The area to be annexed is included within the following special districts:
Weld Library District
West Greeley Conservation District
Weld County School District Re-5J
Northern Colorado Water Conservancy District
Johnstown Fire Protection District
Aims Junior College
6. A statement of the effect of the annexation upon the school district governing the area to be annexed, as is
more fully set forth in Section 15-3(d)(7)of this chapter.
The annexation will not generate immediate impacts to the school district as the applicant is requesting
agricultural zoning at this time. However,the Town has an intergovernmental agreement with the school
district in place to ensure that the applicant pays for the impacts that it has on the school district. Weld
County School District Re-5J stated that this annexation is not in conflict with the Districts interests. If
developed,they request that cash-in-lieu of land dedication is paid to the District.
