COMMERCIAL AND INDUSTRIAL PLANNED UNIT DEVELOPMENT BUSINESS
PARK
WHEREAS , the Board of County Commissioners of Weld County,
Colorado , pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, on the 28th day of December, 1983 , a public hearing
was held before the Board of County Commissioners of Weld County,
Colorado to consider the application of Agrigenetics Corp. , et al.
for a replat of Lots One through Four, Block Four, Sekich Com-
mercial and Industrial Planned Unit Development Business Park,
located in Part of the SWa, Section 23 , Township 3 North, Range
68 West of the 6th P.M. , Weld County, Colorado, and
WHEREAS , said Lots are located on the following real estate,

LOCATION: East of I-25 Frontage Road; adjacent to and north of Colorado State
Highway 66.
be recommended favorably to the Board of County Commissioners for the
following reasons:
1. The applicant has complied with application requirements listed in
Section 28.5.3 et seq. , of the Weld County Zoning Ordinance.
2. The request is in conformance with Sections 28.3.2. 1.1 through 28.3.2. 1.6
of the Weld County Zoning Ordinance as follows:
- The proposal is consistent with the Weld County Comprehensive Plan.
The subject replat area is part of the area approved for a
commercial and industrial P.U.D. plan by the Board of County
Commissioners on April 18, 1983. The proposed changes modify
platted side lot lines within the boundaries of the existing P.U.D.
District;
- The proposed replat of the P.U.D. Plan conforms to the P.U.D.
District. All uses as listed and approved by the Board of County
Commissioners in Case Number Z-386:83: 1 are uses by right and in
effect. There are no new uses proposed with case number S-227:83:8;
- The existing zoning in the surrounding area is Commercial (3) ,
Commercial (3) with unit development standards, Planned Unit
Development for industrial and commercial uses and agricultural .
The acreage within the zoned district areas allowing commercial and
industrial uses is largely undeveloped and remains in agricultural
production. The Weld County Future Land Use Map indicates the
surrounding area is intended for Agricultural uses;
A memorandum received from the Town of Mead on December 12, 1983
states no objection to this proposal;
The Utilities Coordinating Board recommended approval of the
easements intended to provide utility service to the P.U.D.
Subdivision in a meeting on December 15, 1983;
Therefore, the USES, BUILDINGS and STRUCTURES which would be
permitted shall be compatible with the existing or future
DEVELOPMENT of the surrounding area as permitted by the existing
zoning and with the future DEVELOPMENT as projected by the
COMPREHENSIVE PLAN or MASTER PLANS of affected municipalities;
- The USES, BUILDINGS and STRUCTURES will conform with the performance
standards outlined in Section 35.3 of the Weld County Zoning
Ordinance;
- The proposal is not located within any overlay districts.

Dear Rod,
Re : leplat 'A' , Sekich Business Park
The request for a replat of Sekich Business Park is made
for the following reasons ;
1) The original survey conducted by A. Royer
showed lot lines in locations that were
changed during the Platting process . The
prospective lot owners were unaware of the
changes . The survey monuments on the site
were not changed to reflect the lot line
adjustments , consequently , a misunderstanding
in regard to actual lot location occurred.
2) Because of the situation described above , fences
were built along the existing pinned lines . In one
case , the actual adjustment exceeded 30 feet.
Additionally, plans for building expansion had been
made that would make the proposed
building
envelope
encroachments into abutting property unacceptable.
3) All the affected property owners are willing to
have this area replatted.

We have reviewed the Agrigenics Corporation application for a replat
of Lots 1-4, Block 4, Sekich Business Park, and have the following comments.
The replatting of these lots has no direct impact on our interests;
however, we note that the access easement along the north end of these lots
is not shown on this replat. That easement should be retained since it is
intended to provide alternative access to these lots in the event that traffic
and/or accident experience makes use of the access easement along State
Highway 66 undesirable. This issue was specifically addressed during review
of the original plat of this Business Park.
