The times of operation have not and will not be observed as demonstrated by their previous disregard to follow the agreements of the Weld Planning Committee in the past. In 2003, I understand that the Simmons were turned in by another party. That party has decided not to come forward at this time. After the violation was issued, they agreed to stay in a one-room barn with a few employees. As soon as the planner was gone, they continued to move forward with a leach field, adding a large addition to the barn, and placing a large ad in the yellow pages. They added more vet techs and the traffic increased. In 2006, after a total disregard for our land and livestock, I reported them to the Planning Department. They were • issued another violation for"obviously not what they agreed to" as I was told by the inspector from the Planning Committee. As soon as she was gone, they added another vet and more vet techs and worked later nights. We have pictures of business operations of late nights and early mornings if they develop. They knew from the start that they needed a special use permit as Wendy Simmons had worked with other vets that had applied for theirs. It appears they chose to ignore it. 2. The lights and traffic from these increased hours of operation cause annoyance as their clinic is located right in front of our home. The traffic also causes dust. 3. County road 53 has deteriorated as a result of the increase in horse trailers and pickup trucks that use this clinic. I question if the access from county road 53 is a business access or residential? 4. We have horses also, but nobody addressed any concerns of having sick horses hauled in next to our property. Again, they just did it. 5. I feel that they have devalued our home as no one would like to live this close to the traffic and dust. I feel if we would have had proper notice of this situation in advance, we could have asked the Planning Committee to locate it further away from our home as they own 50 acres. We had no notice of their intent to have a clinic of this size in front of our home. Again, they just did it. In closing, I would like to add that Wendy Simmons is a good vet and her business will grow. Without some planning and respect for our land and livestock, there will be continued problems. Will the Planning Committee enforce agreements, or will I have to continue to report these violations? I would like to have it known that despite the close proximity to our home, I would • support them having their clinic if they would respect my wife, land, livestock and farm hand. EXHIBIT /3 2007-3611 Solutions to these problems can be addressed with a privacy fence, the hours of operation enforced, dust control on the dirt road, etc. I would like to see the Planners come and see the problems that we deal with, offer answers and enforce agreements and allow everyone to get on with their professional lives. The proximity of this business is too close to our front door of our home. 2. Business activity takes place after the normal work hours and late into the night. 3. Due to the traffic on the dirt road,there is an excessive amount of dust. • 4. The road conditions of CR 53 have deteriorated due to the amount of traffic from this business. 5. Due to the nature of this business in treating sick and diseased animals, we are cautious of the surroundings for our own horses and cattle. 6. Our privacy is violated due to the close proximity and location of the entrance to the clinic. 7. In combination of all of these reasons, the value of our property could be decreased with a private business adjacent. 8. I have worked for Ron Farmer in the afternoons, evenings, and Saturdays as a farm hand since March of 2007. I have observed Ron's neighbor to the east on many occasions yell comments towards us. Most of the times I am too far away to understand the comments that are being said. However, on two separate occasions, I was privy to seeing and hearing Ron's neighbor to the east shout, "F---you Ron Farmer," and flip us both middle fingers. There was an additional occasion where I was walking Ron's fences, when Ron's neighbor came outside and told me that I had better not step foot on his property. I did not acknowledge his neighbor and informed Ron about this incident. Ron had previously instructed me to stay on his property only, and not acknowledge any remarks his neighbor has made toward us. I have honored Ron's wishes and have not provoked these situations in any way, nor has Ron. Throughout all of my time working for Ron, I have never . once seen him get angry towards me or any others. Ron has been nothing but generous to me and anyone whom I have seen him interact with. I work for Ron Farmer around my school schedule and he has been more than willing to accommodate my needs. I have classes and studies in the mornings so I work on his property from 3:00 p.m. until 7:30 or 8:00 p.m. during the week and have differing hours on Saturdays. Usually I work for Ron until it is dark. On many occasions, I have observed horse trailers and other numerous odd vehicles coming and going from his neighbor to the east's property after dark, when I leave to go home for the evening. I usually only work Saturday morning from 8:00 a.m. until 1:00 or 2:00 p.m., and I have seen horse trailers and vehicles on his neighbor's property during that time as well. It is my wish to inform you about the things that I have witnessed as a farm hand on Ron Farmer's property over the past seven months. I have never seen or heard of them being violent in the community. We have had a very good working relationship for those 12 years and we support them in the opposition of USR-1623. I also farm along WC Rd. 53 and I'm concerned about the condition of the road and I don't feel more traffic would help the situation. There is a lot of semi truck and tractor traffic already.
