WHEREAS , the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS , the Board of County Commissioners held a public hearing on the 23rd day of May, 1984 , at the hour of 2 : 00 o ' clock p.m. in the Chambers of the Board for the purpose of hearing the application of Mizel Gas Processing, Inc. , 3600 South Yosemite, Denver, Colorado 80237 , for a Use by Special Review for a gas processing plant on the following described real estate , to-wit: Part of the SWa NW4, Section 27 , Township 5 North, Range 64 West of the 6th P .M. , Weld County, Colorado WHEREAS , Section 24 . 4 . 2 of the Weld County Zoning Ordinance provide standards for review of said Use by Special Review, and WHEREAS , the Board of County Commissioners heard all of the testimony and statements of those present, has studied the re- quest of the applicant and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence pre- sented in this matter , and having been fully informed, finds that this request shall be approved for the following reasons: 1 . The submitted materials are in compliance with the application requirements of Section 24 . 7 of the Weld County Zoning Ordinance. 2 . It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 24 . 4. 2 of the Weld County Zoning Ordinance as follows: a. The proposal is consistent with the Comprehensive Plan policies in that the use does not infringe on continued agricultural use in the vicinity or County. The proposal does not appear to have any adverse impacts on the agricultural interests of the County or the environment. b. The proposal is consistent with the intent of the Agricultural Zone District and is provided for as a Use by Special Review. c. The proposal was reviewed by the Town of Kersey and was found to comply with their long-range Comprehensive Plan. d. No overlay district affect the site. Use by Special Review Operation and Design Stan- dards provide adequate protection of the health, safety and welfare of the neighborhood and County. NOW, THEREFORE , BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado, that the application for a Use by Special Review for a gas processing plant on the here- inabove described parcel of land be, and hereby is , granted sub- ject to the following conditions : 1 . The attached Standards for Use by Special Review be adopted and placed on the Use by Special Review plat prior to recording. 2 . No building or electrical permits shall be issued for the Use by Special Review Permit area until the plat has been delivered to the Department of Planning Ser- vices Office and compliance with Operation Standard #7 has been met. The prescribed Use by Special Review activity shall not occur and building or electrical permits shall not be issued until the Use by Special Review plat has been recorded in the office of the Weld County Clerk and Recorder. U.S.R. - 625:84:21 1. The uses permitted shall be a natural gas processing facility as described in the application materials on file with the Department of Planning Services. 2. A six (6) foot chain link fence, topped with three (3) strands of barbed wire, shall enclose the area as diagramed on the plat of USR - 625:84:21. 3. The appearance of the facility shall be maintained in a neat and orderly condition through periodic painting and maintenance. 4. Upon cessation of the proposed use, the natural gas processing facility shall be removed and the land shall be reclaimed to its prior use. 5. A closed-system (vented) septic tank shall be utilized on the Use by Special Review site for each of the proposed pits. Construction of a flare pit shall be prohibited in the Use by Special Review area. 6. The liquid storage vessel shall be bermed to contain all potential content spillage or leakage. 7. Liquified petroleum gas (LPG) is considered a hazardous substance per C.R.S. 29-22-107(2) (a) . Prior to the issuance of building permits the applicant shall list the maximum quantity of LPG expected at the site with the State Health Department - Division of Waste Management and with the Weld County Emergency Response Coordinator. Evidence of this listing shall be provided to the Department of Planning Services prior to the issuance of building permits. 8. The Use by Special Review area shall be limited to two (2) access points on Weld County Road 55. 9. To ensure adequate fire protection, the operator shall provide the Platte Valley Fire Protection District a list of four (4) names, phone numbers and addresses of responsible parties it can contact in case of an emergency. The operator shall provide instructional training on the gas processing plant to the Platte Valley Fire Protection District. 10. Prior to the operation of the natural gas processing facility, the operator and/or owner shall submit a copy of a policy of insurance in the amount of five hundred thousand dollars ($500,000.00) insuring the applicant and the County against all claims for damages to persons or property resulting from the Use by Special Review activity. The policy shall be written by a company authorized to do business in the State of Colorado. Evidence of the insurance policy shall be filed with the Department of Planning Services. The Use by Special Review Permit shall cease to exist if for any reason whatsoever, the insurance policy were to become void or lapse. 11. The applicant shall comply with the design standards for the Use by Special Review, Section 24.5 et seq. , of the Weld County Zoning Ordinance. 12. The applicant shall comply with the Operation Standards for Uses by Special Review, Section 24.6 et seq. , of the Weld County Zoning Ordinance. 13. Representatives or members of the Weld County Health Department and Weld County Department of Planning Services shall be granted access onto the site at any reasonable time in order to insure the operations carried out on the site comply with the Development Standards stated hereon and all applicable Weld County Regulations. 14. The Use by Special Review area shall be limited to the plans shown hereon and governed by the Standards as stated above and all applicable Weld County Regulations. Any material deviations from the plans and/or Standards as shown or stated above shall require the approval of an amendment of the Permit by the Weld County Planning Commission and the Board of County Commissioners before such changes from the plans and/or Standards are permitted. Any other changes shall be filed in the office of the Department of Planning Services. 15. The property owner and/or operator of this operation shall be responsible for complying with all of the above stated Standards. Noncompliance with any of the above stated Standards may be reason for revocation of the Permit by the Board of County Commissioners. HEARING CERTIFICATION DOCKET NO. 84-28 RE: USE BY SPECIAL REVIEW, GAS.PROCESSING PLANT, MIZEL GAS PROCESSING, INC. A public hearing was conducted on May 23 , 1984, at 2:00 P.M. , with the following present: Commissioner Norman Carlson, Chairman Commissioner Jacqueline Johnson, Pro-Tem Commissioner Gene Brantner, Excused Commissioner Chuck Carlson Commissioner John Martin, Excused Also present: Acting Clerk to the Board, Mary Reiff Assistant County Attorney, Lee D. Morrison Planning Department Representative, James Mayerl The following business was transacted: I hereby certify that pursuant to a notice dated May 9, 1984, and duly pub- lished May 10, 1984 in the La Salle Leader, a public hearing was conducted to consider the application of Mizel Gas Processing, Inc. for a Use by Special Review for a gas processing plant. Chairman N. Carlson explained that since only three Commissioners were present, the applicant could request a continuance of this hearing to a date when all five Commissioners will be present. The applicant chose to continue with today's hearing. Lee Nbrrison, Assistant County Attorney, read this application into the record. Jim Mayerl, representing the Planning Department, read the favorable recommendation of the Planning Commission into the record. He stated that the Planning Department recommends that proposed Operation Standard -#8 be amended to read: "The Use by Special Review area shall be limited to two (2) access points on weld County Road 55" deleting any reference to culverts, because llEEngineering Department has determined that no culverts are needed. Dean Goedeker, chief engineer for Mizel Gas Processing, Inc. , came forward to present the request to the Board. He stated that his company wished to ask that Operation Standard #2 be amended. Due to the size of the plot of ground involved, they requested to be allowed to erect a four-strand barbed wire fence around the entire plot, and confine the plant and compressor system within a chain link fence. Considerable discussion was held, with the Board concluding that Operation Standard #2 should remain as proposed. Mr. Goedeker presented a map showing what his company plans for this area and also distributed brochures of the plant which will be placed on the site. He stated the plant will be electric powered and equipped with an emergency shut down system. Melvin E. Thoutt asked questions concerning dangers arising from this plant and requested continuance of this hearing to allow more time to review the plans. Roger De Muth, who has helped install several similar plants in this area, came forward and compared the proposed plant with others which have been installed in the area. Virginia Hall stated that her house is closest to the proposed installation and she is satisfied with the plans. Com- missioner Johnson moved to approve the Use by Special Review application of Mizel Gas Processing, Inc. for a gas processing plant, based upon the recommendation of the Planning Commission, with Operation Standard #8 to be amended as earlier requested by the Planning staff. Commissioner C. Carlson seconded the motion which carried unanimously. The following Subdivision Exemption requests were heard at this time because they are associated with the USR request of Mizel Gas Processing, Inc. SE #218, MARY ELLEN ALT, ET AL: Mr. Mayerl presented the request for Subdivision Exemption #218 to the Board. Dean Goedeker, representing the applicant, stated that this property is the site for the plant which had just been approved. Commissioner C. Carlson moved to approve Subdivision Exemption #218, requested by Mary Ellen Alt, et al. Commissioner Johnson seconded the motion which carried unanimously. SE #219, RICHARD AND SONJA KLEIN: Mr. Mayerl presented the request for Sub- division Exemption No. 219. Mr. Goedeker represented the applicant, stating this .086 acre tract will be used for a natural gas metering station. Com- missioner Johnson moved to approve Subdivision Exemption #219, requested by Richard and Sonja Klein. Commissioner C. Carlson seconded the motion which carried unanimously. OPERATION STANDARDS Mizel Gas Processing, Inc. U.S.R. - 625:84:21 1. The uses permitted shall he a natural gas processing facility as described in the app]ication materials on file with the Department of Planning Services. 2. A six (6) foot chain link fence, topped with three (3) strands of barbed wire, shall enclose the Use by Special Review area. 3. The appearance of the facility shall be maintained in a neat and orderly condition through periodic painting and maintenance. 4. Upon cessation of the proposed use, the natural gas processing facility shall be removed and the land shall be reclaimed to its prior use. 5. A closed-system (vented) septic tank shall be utilized on the Use by Special Review site for each of the proposed pits. Construction of a flare pit shall be prohibited in the Use by Special Review area. 6. The liquid storage vessel shall be bermed to contain all potential content spillage or leakage. 7. Liquified petroleum gas (LPG) is considered a hazardous substance per C.R.S. 29-22-107(2) (a) . Prior to the issuance of building permits the applicant shall list the maximum quantity of LPG expected at the site with the State Health Department - Division of Waste Management and with the Weld County Emergency Response Coordinator. Evidence of this listing shall be provided to the Department of Planning Services prior to the issuance of building permits. 8. The Use by Special Review area shall be limited to two (2) access points on Weld County Road 55; an eighteen (18) inch in diameter by forty (40) foot in length CMP culvert shall serve each access point. The culverts shall be installed within ninety (90) days from the date of approval by the Board of County Commissioners. -9. To ensure adequate fire protection, the operator shall provide the Platte Valley Fire Protection District a list of four (4) names, phone numbers and addresses of responsible parties it can contact in case of an emergency. 10. Prior to the operation of the natural gas processing facility, the operator and/or owner shall submit a copy of a policy of insurance in the amount of _five hundred thousand dollars ($500,000.00) insuring the applicant and the County against all claims for damages to persons or property resulting from the Use by Special Review activity. The policy shall be written by a company authorized to do business in the State of Colorado. Evidence of the insurance policy shall be filed with the Department of Planning Services. The Use by Special Review Permit shall cease to exist if for any reason whatsoever, the insurance policy were to become void or lapse. 11. The applicant shall comply with the design standards for the Use by _Special Review, Section 24.5 et seq. , of the Weld County Zoning Ordinance. 12. The applicant shall comply with the Operation Standards for Uses by Special Review, Section 24.6 et seq. , of the Weld County Zoning Ordinance. 13. Representatives or members of the Weld County Health Department and Weld County Department of Planning Services shall be granted access onto the site at any reasonable time in order to insure the operations carried out on the site comply with the Development Standards stated hereon and all applicable Weld County Regulations. 14. Me Use by Special Review shall be limited to the plans shown hereon and governed by the Standards as stated above and all applicable Weld County Regulations. Any material deviations from the plans and/or Standards as shown or stated above shall require the approval of an amendment of the Permit by the Weld County Planning Commission and the Board of County Commissioners before such changes from the plans and/or Standards are permitted. Any other changes shall be filed in the office of the Department of -Planning Services. 15. The property owner and/or operator of this operation shall be responsible for complying with all of the above stated Standards. Noncompliance with any of the above stated Standards may be reason for revocation of the Permit by the Board of County Commissioners. DETERMINATIONS TO BE MADE BY THE BOARD OF COUNTY COMMISSIONERS ON USE BY SPECIAL REVIEW REQUESTS 24.4.2 The Board of County Commissioners shall hold a public hearing to consider the application and to take final action thereon. In making a decision on the proposed Use by Special Review, the Board shall consider the recommendation of the Planning Commission, and from the facts presented at the public hearing and the information contained in the official record, which includes the Department of Planning Services case file, the Board of County Commissioners shall approve the request for the Special Review Permit unless it finds that the applicant has not met one or more of the standards or conditions of Sections 24.2. 2, 24.5 (design standards) and 24.6(operation standards) . The applicant has the burden of proof to show that the standards and conditions of 24.4.2, 24.5 (design standards) and 24.6 (operation standards) are met. The processing plant will have a positive impact upon agricul- tural interests as the facility will process gas and related hydrocarbons piped to the site from farms in the area, affording farm and mineral owners a place for the sale of their gas and related hydrocarbon products. The proposal is consistent with the intent of the agricultural zone district as such a use is allowed and provided for as a use by special review pursuant to the Weld County zoning ordinance. The processing plant will be compatible with existing uses and future devel- opment as future development is not expected. Existing uses on all locations are agricultural with significant oil and gas development located upon the agricultural lands. The comprehensive plan map for the Town of Kersey generally indicates that this property is not in an area of residential growth. Thus, the use is compatible with and projected by the Town of Kersey com- prehensive plan. This facility is not located within a flood plain hazard development as de- termined by the Army Corps of Engineers. Should the site be in an "over- lay" district within the Weld County zoning requirements, the applicant will comply with any special requirements or regulations for the flood hazard construction and will apply for and receive all necessary permits for con- struction of the facilities as needed. The facility will be constructed and installed so the site will not be a hazard in the event of flooding. Finally, storage structures at the facility will be engineered and constructed with holding berms of sufficient size and capacity to hold any accidental spillage or leakage. Rd. 53 and north of Weld Co. Rd. 52. The predomiaent soil in the -subject area is Valent sand, 0-3% slope, however, soil unit Aquolls and Aquepts, flooded, is close to and may be associated with the Valent sand. This particular area has a high water table and may have water on or near the surface on a seasonal basis. Subsurface water pre- sence is dependent on seasonal precipitation amounts and the annual irrigation requirements in the local area. There are references in the accompanying plan as to the use of pits for collection of materials at the site. In some years, these pit-s may be influenced by the presence of the high water table. -In addition to a possible water table, the Valent sand soil has a very rapi-d _permeability and any leachable materials or liquids that would be put into the shallow pits could percolate very rapidly into the shallow water table. I would suggest that the site designers become aware of these limitations and consider lining the pits if any potential toxic materials are to be -expelled at the site.
