We have no objections to the proposal, however, we do recommend that the following conditions be part of any approval: We recommend that the following requirements be met prior to allowing the plat to be recorded: 1. The existing septic system serving the clinic and residence shall be reviewed by a Colorado Registered Professional Engineer. The review shall consist of observation of the system and a technical review describing the systems ability to • handle the proposed hydraulic load. The review shall be submitted to the Environmental Health Services Division of the Weld County Department of Public Health and Environment. In the event the system is found to be inadequately sized or constructed the system shall be brought into compliance with current Regulations. 2. The applicant shall submit a dust abatement plan for review and approval, to the Environmental Health Services, Weld County Department of Public Health & Environment. 3. The applicant shall submit a waste handling plan (chemicals, drug disposal, carcass removal/disposal, etc) for approval, to the Environmental Health Services Division of the Weld County Department of Public Health & Environment. The plan shall include at a minimum, the following: 1) A list of wastes which are expected to be generated on site (this should include expected volumes and types of waste generated). 2) A list of the type and volume of chemicals expected to be stored on site. 3) The waste handler and facility where the waste will be disposed (including the facility name, address, and phone number). • EXHIBIT rr 2007-3605 We recommend that the following requirements be incorporated into the permit as • conditions that must be met prior to operation: 1. A stormwater discharge permit may be required for a development/redevelopment/construction site where a contiguous or non- contiguous land disturbance is greater than or equal to one acre in area. The applicant shall inquire with the Water Quality Control Division (WQCD) of the Colorado Department of Public Health and Environment at www.cdphe.state.co.us/wq/PermitsUnit if they are required to obtain a stormwater discharge permit. Alternately, the applicant can provide evidence from WQCD that they are not subject to these requirements. We recommend that the following requirements be incorporated into the permit as development standards: 1. The applicant shall remove, handle, and stockpile manure from the livestock area in a manner that will prevent nuisance conditions. The manure piles shall not be allowed to exist or deteriorate to a condition that facilitates excessive odors, flies, insect pests, or pollutant runoff. 2. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for • final disposal in a manner that protects against surface and groundwater contamination. 3. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended. 4. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, fugitive particulate emissions, blowing debris, and other potential nuisance conditions. 5. The applicant shall operate in accordance with the approved "waste handling plan". 6. Fugitive dust and fugitive particulate emissions shall be controlled on this site. The facility shall be operated in accordance with the approved dust abatement plan at all times. 7. This facility shall adhere to the maximum permissible noise levels allowed in the Commercial Zone as delineated in 25-12-103 C.R.S., as amended. • 2 8. Adequate handwashing and toilet facilities shall be provided for employees and • patrons of the facility. 9. Sewage disposal for the facility shall be by septic system. Any septic system located on the property must comply with all provisions of the Weld County Code, pertaining to Individual Sewage Disposal Systems. 10.The facility shall utilize the existing public water supply. This project falls primarily under the purview of the Use by Special Review Standards, Weld County Code, Chapter 23, Article II, Division 4, Section 23. Our comments and requirements are as follows: COMMENTS AND REQUIREMENTS: Weld County Road Classification Plan (FHU): (June 2003) WCR 53 is a local gravel road and requires a 60-foot right-of-way at full build out. There is presently a 60-foot right-of-way. This road is maintained by Weld County. Pursuant to the definition of setback in the Weld County Zoning (23-1-90), the required setback is from the future right-of-way. Colorado State Highway 392 is a state highway. Colorado Department of Transportation has jurisdiction over this roadway. Weld County does NOT maintain CSH 392 liccess: Existing access will be utilized. No new access points are proposed. A 40' radius is required on all accesses to public roads for accesses designed to accommodate truck traffic. {A minimum effective turning radius of forty (40) feet shall be used for accesses intended to accommodate truck traffic. (Weld County Codification Ordinance 2000-1)} Sec. 8-2-40 B. Road access design standards. Current traffic counts for the section of road are 179 ADT as of the most recent traffic count between the sites entrance and State Highway 392. The applicant will have an approximate impact of 52 ADT per their application. The applicant shall apply dust suppression chemical (magnesium chloride or calcium chloride) on Weld County Road (WCR) 53 between State Highway 392 and WCR 66 no less than twice a year, or more often as determined by the Department of Public Works. Storm Water Drainage: The historical flow patterns and run-off amounts will be maintained on site in such a manner that it will reasonably preserve the natural character of the area and prevent property damage of the type generally attributed to run-off rate and velocity increases, diversions, concentration and/or unplanned ponding of storm run-off. A building permit shall be obtained prior to the construction of structures or changes of use of any building on the parcel including any sign. An electrical permit will be required for any electrical service to equipment or building. A plot plan shall be submitted when applying for building permits showing all structures with accurate distances between structures, and from structures to all property lines. 2. A plan review is required for each building for which a building permit is required. The Occupancy Class will be a B Occupancy(Business) Plans shall bear the wet stamp of a • Colorado registered Architect or Engineer. The proposal is for one Equine Veterinary and Dentistry Clinic, office, boarding barn and hay storage shed. Additional information shall be provided stating their typical daily requirements, including approximate square footage of Equine Veterinary and Dentistry Clinic facility including all ancillary uses. • The applicant's USR Map delineates and irrigated pasture with improvements set back from County Road 53 near the western property line. Per the graphic, there is an existing clinic and boarding building, an existing single family residence and one proposed horse barn sited south of the residence. Parking has been delineated on the plat, however dimension, number of spaces, and ADA access is unclear or has not been delineated. At a minimum, 26 parking spaces will be required, with additional spaces required as determined by staff taking into consideration the size of structures as outlined in Appendix 23-B of the County Code. The application does not provide information concerning the date of construction for all on-site structures. The Assessors record indicates that many of the structures were constructed in the last two to three years. The Department of Building Inspection will address building related issues associated with the proposed facility.. The application states that domestic water is obtained from North Weld County Water District. Staff requests verification that a commercial tap has been obtained from the water district for the facility, outside of the single family residence. Irrigation water for the pasture lands associated with the facility is from an unknown number of shares of water from Larimer/Weld Irrigation Company and the Owl Creek Ditch. The application states that there is a leach field on site. Horse manure and bedding is land applied on an unknown adjacent pasture on a daily basis, with the material stockpiled in the • Simmons- Equine Veterinary and Dentistry Clinic Page 1 of 2 winter months until favorable conditions are present thus allowing for the materials to be land • applied. Other wastes are disposed of through a refuse hauler. The Environmental Health Department will provide additional comment on this issue. Section 23-3-250.A.6 states "Areas used for trash collection shall be screened from public rights-of-way and all adjacent properties. These areas shall be designed and used in a manner that will prevent wind- or animal-scattered trash." It is unclear from the applicant's drawing whether the trash collection area is screened from the public rights-of-way and adjacent properties. Written and /or graphic evidence shall be submitted to the Department of Planning Services for review and approval. Section 23-3-250.B addresses Operation Standards. Section 23-3-250.B.6 addresses the issues of Light. "Any lighting, including light from high temperature processes such as welding or combustion, shall be designed, located and operated in such as manner as to meet the following standards: sources of light shall be shielded so that beams or rays of light will not shine directly onto adjacent properties; neither the direct nor reflected light from any light source may create a traffic hazard to operators of motor vehicles on public or private streets; and no colored lights may be used which may be confused with or construed as traffic control devices." It is unclear from the applicant's drawing whether there is any exterior lighting. The applicant shall provide written and /or graphic evidence to the Department of Planning Services for review and approval. A Lighting Plan may be required, if applicable. Section 23-3-250.B.7 states "Property shall be maintained in such a manner that grasses and weeds are not permitted to grow taller than twelve (12) inches. In no event shall the property • owners allow the growth of noxious weeds. (Weld County Codification Ordinance 2000-1) The existing on-site landscape treatment is adequate for this facility. The proposed • Veterinary Clinic is also in close proximity to the established aircraft traffic pattern for Runway 16/34. Although the Authority has no specific objection to this Site Specific Development Plan, its proximity to the airport and location within the above noted areas should be documented for the record with the current and any future property owners.
