SUBJECT: USR-1607
The applicant for USR-1607, Donald Eymann has addressed the following item prior to scheduling a
Board of County Commissioners hearing:
The applicant shall either submit a copy of an agreement with the property's
mineral owner/operators stipulating that the oil and gas activities have been
adequately incorporated into the design of the site or show evidence that an
adequate attempt has been made to mitigate the concerns of the mineral
owner/operators. Drill envelopes can be delineated on the plat in accordance
with the State requirements as an attempt to mitigate concerns. The plat shall be
amended to include any possible future drilling sites. A letter was received from
Molly Summerville Buchanan with Vandenverf and Buchanan, LLP
Attorneys at Law dated 4/13/07(exhibit D) which states that, "At this time,
the Anadarko entities and Kerr-McGee do not intend to file an objection to
the application because of the oil and gas interests they own for the
property."

Michelle,
I would like to respectfully request that our hearing date with the County Commissioners be delayed
until late July so that we may get our financing in order. Our land contract is written such that we owe
full payment on 7/27/07 or 5 days after the County Commissioners ruling, which ever comes first. If
possible I would like the hearing date to be set for 7/18/07, and if that date is not available I would like
7/25/07 as an alternate date.
