Below is a list of the key issues outlined in your comments and are responses to these issues. We have addressed all of the outstanding issues presented in your comments and the referral responses. 1. The applicant shall submit written evidence that indicates all of the State of Colorado Geological Survey concerns have been addressed, including their concern pertaining to the depth of • groundwater; specific site investigation shall address the potential need for an area drain underneath all foundations and for all major utilities. Groundwater monitoring and analyses has been occurring on the subject property since late summer, 2006. A complete investigative report will be forwarded to Weld County and to the Colorado Geological Survey office showing groundwater mitigation techniques,prior to when the Final Plat and Construction documents are submitted to Weld County. See attached letter to Jill Carlson, Colorado Geologic Survey. 2. The applicant shall include in future applications a copy of a surface use agreement with the properties mineral owners(Kerr McGee)stipulating that the oil and gas activities have adequately been incorporated into the design of the site or show evidence that an adequate attempt has been made to mitigate their concerns. Additionally, this agreement shall address the use of oil and gas setback areas. County regulations do not prohibit the use of oil and gas setback areas for open space uses. The setback from oil and gas encumbrances in an urban scale development is three hundred fifty(350) feet. Evidence of an agreement or signed understanding shall be submitted with the Change of Zone application. The applicant is in negotiations with Kerr McGee and it has been determined that the project will have 150'setbacks from wells, tank batteries,separators,meter houses and emission control devices for existing and new facilities on the property,for residential and commercial areas, and 350'from any structures classified as assemblage occupancies. These setbacks have been negotiated through the previous letter from Kerr McGee to Weld County, a Letter of • Understanding and a Surface Use Agreement. A Surface Use Agreement is currently being negotiated between Kerr McGee and Waterfront at Foster Lake,LLC. A memorandum of the Letter Agreement will submitted to Weld County with the Change of Zone, with the executed • • Mr. Kim Ogle February 27, 2007 Page 2 of 8 • Surface Use Agreement to follow. The Change of Zone Development Guide will further address the oil and gas uses within the project. See attached letter from Kerr McGee. 3. The applicant shall address the County Road Impact Fee Program(Ordinance 2002-11)and adhere to the fee structure, or any adopted fee structure in place,as required per the Weld County Code. The County Road Impact Fee Program will be adhered to at the time of building permits for the project. 4. The applicant shall submit written evidence that indicates the Colorado Division of Wildlife's concerns have been addressed, including their concern pertaining to the roosting sites, threatened and endangered species, and the placement of a pedestrian trail closer than one hundred(100) feet from the Outlet Number 3 irrigation ditch which presently provides for an active wildlife corridor .Evidence of an agreement or signed understanding shall be submitted with the Change of Zone application. The project has been designed with sensitive wildlife habitats considered Approximately 35% of the property is open space,primarily in floodplain areas,following ditch and natural waterway alignments, existing ponds and buffer areas around Foster Lake where wildlife can coexist with development and travel through those corridors back to the river. There is no • development planned along the river and the area around the lake is planned with substantial setbacks. The setbacks from the edge of the river to the back of the lot lines range from 325- 1000'and the setbacks along the lake are an average of 120'from the back of lot lines. See attached letter to Mark Leslie, Colorado Division of Wildlife. 5. The applicant shall submit written evidence that indicates the Weld County Department of Public Health and Environment concerns have been addressed. Further, the applicant shall incorporate the comments received from this office into the overall site plan and so delineate on all future drawings. Evidence of an agreement or signed understanding shall be submitted with the Change of Zone application. The Change of Zone application has incorporated the Weld County Department of Public Health and Environment's concerns regarding water service. A water service agreement will be submitted with the Change of Zone application. It is acknowledged that any commercial development will be subject to the Site Plan Review process. The sanitation issues within the project where people work, live and congregate will be addressed with the Change of Zone application. Any existing, inhabited residences will acquire the appropriate septic permits from the Department of Public Health and Environment. All environmental impacts of Section 27- 6-40 have been addressed. Well Permit number 72605 is actually located in Section 34, Township 2N Range 68W, and is for a house located on Lot 22, Grandview Highlands Estates. The Division of Water Resources has the wrong township on their permit. The applicant shall submit written evidence that indicates the City of Longmont, Department of Community Development's concerns have been addressed, including the alignment of the trail and separation of the riparian areas. Evidence of an agreement or signed understanding shall be submitted with the Change of Zone application. Transportation issues have been addressed. The Weld County Public Works Department has worked extensively with the City of Longmont and the Town of Mead to resolve the transportation concerns in the area of the Waterfront project The Sketch Plan and the Change of Zone show connectivity to adjacent projects, both vehicular and pedestrian. The Weld County Road 28 alignment has been approved by Weld County Public Works. There were a few comments regarding the view sheds and a pedestrian bridge connection to St Vrain State Park. We understand the viewpoint of the City of Longmont, however, over 35% of the overall property has been set aside as open space,primarily in the sensitive wildlife and floodplain areas. The lots located on the southern edges of the project are located outside of the floodplain and are setback from the river a minimum of 325 feet and maximum 1000 feet on the southeast portion of the development It is our opinion that this is an adequate buffer from the river corridor and locating a pedestrian bridge from the Waterfront property to the St Vrain State Park is harmful to the environment and sensitive habitat areas and is a safety issue for the future residents of the Waterfront development See attached letter to Erin Fosdick,Department of Community Development, Planning and Development Services, City of Longmont. • 7. The Weld County Department of Building Inspection in their referral dated October 4, 2006, stated their concerns specific to foundations,bulk requirements. The applicant shall indicate how the concerns of the Weld County Department of Building Inspection will be addressed. All requirements of Weld County Building Inspections will be met at the time of building permits for any new structures requiring building permits. There will be some deviation from the bulk requirements for Residential and Commercial zone districts as listed in the Weld County Code, and may include minimum lot size,minimum building setbacks, oil and gas setbacks,building heights,signage and animal units. These deviations will be more specifically shown on the Change of Zone plan sets. See attached letter to Bryon Horgen, Weld County Building Inspections. 8. The Department of Public Works has several concerns and requirements to be addressed pertaining to this application. It is highly recommended that the applicant meet with Peter Schei, Civil Engineer for the Weld County Department of Public Works to discuss the options available for development. Evidence of an agreement or signed understanding between this office and the applicant`shall be submitted with the Change of Zone application. The Department of Public Works concerns and requirements have been addressed as indicated in their attached memo. The Lot Study map that is referred to is also attached as an exhibit It is our understanding there will be a follow-up memo for guidance on the Change of Zone and Final Plat stages of the project. The Colorado Department of Transportation has several concerns concerning access and access requirements. The applicant shall indicate how the concerns of the Colorado Department of Transportation will be addressed. Evidence of an agreement or signed understanding shall be submitted with the Change of Zone application. The referral from Gloria Hice-Idler, CDOT, dated October 2, 2006 states: "The developer should continue to work with CDOT on the improvements at the state highway connection." The applicants will continue to work with CDOT through the Change of Zone and Final Plat processes. See attached letter to Gloria Hice-Idler, Colorado Department of Transportation. 10. The Department of the Army,Corps of Engineers has requirements to be addressed pertaining to this application,should development require a 404 Permit. The applicant shall indicate how their concerns will be addressed. If development requires a 404 Permit, the applicant will obtain the appropriate permits. See attached letter to Timothy Carey,Department of the Army, Corps of Engineers. 11. The State of Colorado,Office of the State Engineer has requirements to be addressed specific to evidence that the Long's Peak Water District is able to provide water for the proposed development. The applicant shall indicate how their concerns will be addressed. Evidence of an agreement or signed understanding shall be submitted with the Change of Zone application. • A Subdivision Service Agreement will be provided at the time of the Change of Zone application submittal. A Water Supply Information Summary Form has been provided to the State of Colorado, Office of the State Engineer. See attached letter to Dick Wolfe,Division of Water Resources, along with a copy of the Water Supply Information Summary Form. 12. The Longmont Soil Conservation District has requirements to be addressed pertaining to this application specific to the Outlet#3 Lateral Ditch. The application materials state that the Ditch is to be relocated; however,there was not an agreement between the Ditch Company and the applicant submitted with the application materials providing their approval. Evidence of an agreement or signed understanding shall be submitted with the Change of Zone application. See enclosed letter from the Outlet#3 Lateral Ditch Company. There have been on-going discussions with the Outlet#3 Ditch Company representatives. They do not want to enter into any agreements until Final Construction Documents are completed An agreement with the Ditch Company will be executed at the time of Final Plat. • • • Mr. Kim Ogle February 27, 2007 Page 5 of 8 • 13. The applicant shall provide further clarification on the standing of the existing farmhouses delineated on all sheets associated with this application. The applicant shall indicate how this issue will be addressed. The existing farmhouses located on the property are occupied and will remain on site until construction commences for the phase in which they are located. During that construction phase the houses will be moved or removed and the appropriate permits will be acquired. 14. The applicant shall address vehicular circulation from this development onto County Road 28 and County Road 7. County Road 7 has been annexed by the Town of Mead. The applicant shall provide written documentation stating that access onto County Road 7 has been granted by the Town. The Weld County Public Works Department has approved the alignment and circulation of Weld County Road 28 and County Road 7. (Refer to letter and exhibit from item #8) The intersection of Weld County Roads 28 and 7 will remain in the same location as it currently exists. Other access points onto Weld County Road 7 are located on the north side of the future St. Vrain Valley High School and at WCR 26%. These accesses will be utilized by the future schools, as well as the Waterfront development. The traffic study is being updated and if it shows that traffic operates safely, an access from WCR 7 into the Commercial site will be shown on the Change of Zone. Additionally,access from WCR 28 into the Commercial/Multi- • family area will be determined through the updated traffic study and shown on future plans. The accesses north of the high school site and at Weld County 26 Y.2 have already been approved by the Town of Mead. 15. The applicant shall provide additional detail concerning the treatment of open space, the proposed hierarchy of landscapes, the proposed park amenities,the treatment of jurisdictional and non- jurisdictional wetland areas, the riparian areas, specific to the referral comments contained herein, and the measures to be implemented specific to onsite erosion and sedimentation, i.e., what"Best Management Practices"will be employed for this development. Additional detail concerning the treatment of open space, the proposed hierarchy of landscapes and the proposed park amenities will be provided with the Change of Zone application. According to the letter from the Department of the Army, Corps of Engineers (enclosed)there are no jurisdictional wetlands on the property. If it is determined that any jurisdictional wetlands would be disturbed, the appropriate permits will be acquired The measures to be implemented specific to onsite erosion and sedimentation will be addressed at the Change of Zone and"Best Management Practices"will be implemented with final construction drawings. 16. The applicant shall take under consideration a modification to the PUD application to include oil and gas production facilities. Appropriate language may include: "Request for a PUD Change of Zone from(A)Agricultural to PUD with(E)Estate; (R-1) Low Density Residential; (R-2) Duplex Residential; (R-3)Medium Density Residential; (R-4)High Density Residential; (C-1) Neighborhood Commercial and(C-2)General Commercial and continuing Oil and Gas Production Uses in the Mixed Use Development Overlay District,"or appropriately determined • land use designations. • • Mr. Kim Ogle February 27, 2007 Page 6 of 8 • The Change of Zone application and maps will include the following language, "Request for a PUD Change of Zone from (A)Agricultural to PUD with (E)Estate;(R-1)Low Density Residential;(R-2)Duplex Residential; (R-3)Medium Density Residential; (R-4)High Density Residential;(C-1)Neighborhood Commercial and(C-2) General Commercial and continuing Oil and Gas Production Uses in the Mixed Use Development Overlay District,"and will identify the existing and proposed oil and gas facilities per the Surface Use Agreement with Kerr McGee. 17. The applicant shall provide written evidence from the Mountain View Fire Protection District stating that the issues raised in this referral have been addressed. Evidence of an agreement or signed understanding shall be submitted with the Change of Zone application. The applicant has met with LuAnn Penfold,Mountain View Fire Protection District and incorporated input from the District into the project plans. The project will attempt to address the requirements of the District See attached letter to LuAnn Penfold,Mountain View Fire Protection District 18. The applicant shall indicate how the issues raised by the Weld County School District RE-1J specifically requesting a land dedication for future school site(s) for this project. Evidence of an agreement or signed understanding shall be submitted with the Change of Zone application. • The applicant has met with the Planner for the St. Vrain Valley School District, Glen Segrue. At the time of the meeting, Glen indicated that a school site would not be necessary on the Waterfront Development. It is also stated on Attachment A (2) which states "The School District is not anticipating the need for another school site in this area. Since no land dedication is required, Cash-in-lieu fees will be assessed per the attached chart." The applicants will provide an agreement with School District to address the Cash-in-lieu payments. See attached e-mail and letter to Glen Segrue,St Vrain Valley School District. 19. The applicant shall indicate how the issues raised by the Colorado State Parks have been incorporated into the proposed developments plan. Evidence of an agreement or signed understanding shall be submitted with the Change of Zone application. The applicants have met with the Colorado State Parks and have incorporated several of their comments into the design of the project. There is a respectful disagreement regarding the pedestrian bridge connection between the park and the Waterfront project. The applicants have concerns regarding safety of the residents of Waterfront and parking within the development project to avoid paying fees into the park. Additionally, as mentioned previously, there is concern regarding the placement of a pedestrian bridge over the river due to disturbance to wildlife along the river andfloodplain issues. See attached letter to David Giger, Colorado State Parks. 20. The applicant shall indicate how the issues raised by the Outlet#3 Ditch Company and their • Corporate Counsel have been incorporated into the proposed development's plan. The applicant shall provide written and graphic evidence delineating the areas identified as"flex" on the Sketch Plan submittal. The Department of Planning Services will require the applicant to specify the use as commercial, residential or a mix of residential-commercial with the appropriate Floor Area Ratio(FAR). The areas previously shown as `flex"will be specified on the Change of Zone plat as Commercial and Multi family Residential and the appropriate Floor Area Ratio will be determined. This information will also be included in the Specific Development Guide, as a part of the Change of Zone application. 22. The plat shall be modified to maintain a consistent scale in accordance with Section 27-9-10 of the County Code. The Change of Zone plat will maintain a consistent scale in accordance with the Code. A. All ponds and associated water bodies shall be delineated and accurately dimensioned on all sheets associated with this application. The location of the#3 Lateral Ditch as it exists today and as modified per undocumented stipulated agreement. The location shall be delineated and accurately dimensioned on all sheets associated with this application. The#3 Lateral Ditch is shown as it exists today and the modifications per the CDOT construction plans are shown on the Change of Zone plat. All associated legal documents will be submitted with the Change of Zone application. C. The location of all internal trails shall be accurately delineated. There are instances where the trail ends at an internal road with no additional trail configurations noted. The trails should provide interconnectivity to other developments and adjacent parks. The trails have been redesigned to provide interconnectivity to other developments and adjacent parks, with the exception of a connection to the St. Vrain State Park,for reasons stated previously. All internal trails are accurately delineated and connect to sidewalks at internal road locations,for pedestrian use throughout the development. D. The location of the unknown number of Kerr-McGee oil and gas wells,existing and future tank batteries and other associated oil and gas encumbrances, including all gathering lines associated with the new proposed wells and all existing wells located on site. The Change of Zone plat identifies all existing and future oil and gas wells, existing and future tank batteries and other associated oil and gas encumbrances, including all gathering lines associated with the new proposed wells and all existing wells located on site. Due to the complexity of this site, a separate sheet set will be provided for Weld County staffs use. Additional detail is required to address internal to the development parking associated with the active and passive recreational facilities. The Change of Zone will incorporate additional detail regarding parking associated with the active and passive recreational facilities. The use of on-street parking will adequately address many of the recreational areas. It is our understanding that all issues from the Sketch Plan application and referral agencies have been adequately addressed, including the concerns of the Weld County Public Works Department. Written evidence has been submitted where required. Please respond to this letter with your approval of the Sketch Plan application, so that we may proceed with the Pre-application conference and submittal of the Change of Zone application. It is our understanding that your concerns include the possibility of shallow groundwater, soil and bedrock properties and individual perimeter drains. Through the Change of Zone and Final Plat processes, a more extensive study of the soils and • groundwater will help us evaluate your concerns. A groundwater study has been on-going since Summer,2006 and will assist in our Final Construction plans for the project. Information from our geotechnical study will be utilized when doing all final design. As the process continues, the Weld County Planning Department will continue to send you referrals which include any of the additional studies that have occurred regarding the project. We currently are in the process of working on a Surface Use Agreement which will formalize our discussions regarding the possible relocations of gas lines and access roads,relocation of any existing facilities,the use of low profile equipment and the locations for any new facilities. We have had preliminary discussions regarding:directional drilling of new wells and have had • discussions regarding proposed setbacks. It is our understanding that as long as Waterfront at Lake, LLC and Kerr McGee agree on setbacks, Weld County Planning staff will also concur,as long as a Surface Use Agreement includes those agreed upon setbacks. At this stage we are open to the proposed 150' setbacks from wells, tank batteries, separators,meter houses and emission control devices for existing and new facilities on the property,for residential and commercial areas and 350' from any structures classified as assemblage occupancies. As you know,we will finalize the setbacks with you in the Surface Use Agreement,which will be completed during the Change of Zone for your Planned Unit Development project. We have reviewed your comments and are addressing • them as follows: • Careful thought was given in designing the project with approximately 35% of the development as open space, which exceeds the amount required by Weld County. We designed the open space areas around the ditches, natural drainage ways, the edges of Foster Lake and the floodplain areas along the St. Vrain Creek, with wildlife in mind. These areas will not be developed, with the exception of some park and trail areas and can continue to be corridors for animals to move from Foster Lake to the St. Vrain creek. • Buffer areas along the Foster Lake shores average 125' to the back edge of any lot lines; buffer areas along drainage ways (including the Outlet #3) are a minimum of 150' and in some areas are substantially wider; buffer areas from St. Vrain Creek are a minimum of 325' and are up to 1000' feet in some areas. It is our opinion that these setbacks are adequate to minimize any impacts or conflict with wildlife. • The small pond area referred to in your letter will actually be a series of four ponds and will be designed to remain on the property as a natural area, with some trails and possibly some recreational opportunities, such as fishing and wildlife viewing. It is our intention to incorporate as much of the existing vegetation around these ponds as feasibly possible. We have reviewed your comments and are addressing . them as follows: • Water quality: Storm water will be designed with "Best Management Practices" incorporated into the construction plans and will follow all requirements of Federal and State laws, as required through the development review through Weld County. • Development impacts and trail access: Careful thought was given in designing the project with approximately 35% of the development as open space, which exceeds the amount required by Weld County. We designed the open space areas around the ditches, natural drainage ways, the edges of Foster Lake and the floodplain areas along the St. Vrain Creek, with wildlife and environmental concerns in mind. These areas will not be developed, with the exception of some park and trail areas and can continue to be corridors for animals to move from Foster Lake to the St. Vrain Creek. • The project has buffer area setbacks a minimum of 325' from the St. Vrain Creek to the back of lot lines and over 1000' in some areas on the south eastern developed area of the project. It is our opinion that this is an extensive setback and is adequate to protect any view sheds, wildlife or environmental concerns. • The trails, roads (some with bike lanes) and sidewalks connect to adjacent properties, including the new high school and planned developments in the area. The applicant is not willing to incorporate a pedestrian bridge from the development into St. Vrain State Park at this time.
