Upon review of my case files and computer, an active Zoning Violation (VI-0600219) was noted. This
violation was initiated due to the operating of a landscaping business without the necessary Weld County
Zoning Permits. This case has not been presented to the Board of County Commissioners through the
Violation Hearing process.
This application if approved by the Board of County Commissioners will correct the violation. If this
application is denied, please ask the Board of County Commissioners to refer this case to the County
Attorney's Office, but to delay legal action for 30 (thirty) days in order to give them adequate time to
ensure that all landscaping material storage and operations shall be removed from the property.

Thank you for the opportunity to comment on a Development Plan and Special Review Permit that is proposed for
the address 3161 Johnson Lane, Erie, Colorado. The applicant is Alex Nguyen.
The applicant is proposing to use some of his 4.75 acre property to store landscaping and lawn service equipment.
No construction or building will occur on the land.
The Colorado Division of Wildlife does not believe that this proposal will negatively affect wildlife in the area,and
has no objections.

Dear Mr. Ogle:
I have reviewed the submitted material pertaining to the Site Specific Development Plan and
Special Review Permit for a home landscaping business and the storage of landscaping
equipment at 3161 Johnson Lane (Case Name: Nguyen, Case Number: USR-1581). The Fire
District does not object to the proposed business and storage of equipment provided there is no
conflict with the requirements of the Fire District.
• There is very limited water supply for fire protection along this portion of Johnson Lane.
It the storage building is used solely for the purposes of storage of equipment and
materials used for the landscaping business then water supply for fire protection would
not be required. If the building is used for any type of hazardous activity such as vehicle
repair, storage or use of flammable/combustible liquids, or hazardous materials including
pesticides, herbicides, and fertilizers, then water supply for fire protection requirements
may apply as well as certain fire code and building code requirements for the building
itself.
• It does not appear new construction is proposed, but it should be noted should the
applicant decide to construction an addition to existing structures or construct any new
buildings, water supply requirements apply.
• Fire apparatus access to the existing barn is not adequate as shown on the plans
submitted. Apparatus access road shall be a minimum of 20 feet in width and be
designed and maintained to support the imposed loads of fire apparatus (75,000 pounds).
Roads must have a surface that provides all-weather driving capabilities and be free from
obstructions, which includes locked gates, unless otherwise approved. Roads in excess of
150 feet in length must be provided with approved provisions for the turning around of
fire apparatus.
• If not already provided, approved address numbers shall be placed on the building or at
the entrance to the property in such a position to be plainly visible and legible from the
street fronting the property. Address numbers or letters shall contrast with their
background.

The Weld County Public Works Department has reviewed this proposal. This project falls primarily under the
purview of the Use by Special Review Standards, Weld County Code, Chapter 23, Article II, Division 4, Section
23. Our comments and requirements are as follows:
COMMENTS:
Weld County Road Classification Plan (FHU): (June 2002)
Johnson Lane is a local paved road within the Ranch Eggs Subdivision. It requires a 60-foot right-of-way at full
build out. There is presently a 60-foot right-of-way. This road is maintained by Weld County. Pursuant to the
definition of SETBACK in the Weld County Zoning Ordinance (23-1-90), the required setback is measured from
the future right-of-way line.
VCR 7 is a major arterial road, which requires a 140-foot right-of-way at full build out. There is presently a 60-
foot right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld
County Zoning Ordinance (23-1-90), the required setback is measured from the future right-of-way line.
REQUIREMENTS:
Access: The home business access is identified as pea gravel surface and gated. Utilize this access point
from Johnson Lane. There is an existing landscape circle drive associated with the home. This will be used
for residential purposes only.
Parking and Circulation: The applicant needs to show on the plat drawing equipment parking and
landscaping material area. The circulation and parking plan should accommodate outdoor parking or stage
equipment and material.
Storm Water Drainage: The historical flow patterns and run-off amounts will be maintained on site in such a
manner that it will reasonably preserve the natural character of the area and prevent property damage of the
type generally attributed to run-off rate and velocity increases, diversions, concentration and/or unplanned
ponding of storm run-off.
The applicant must take into consideration storm water capture/quantity and provide accordingly for best
management practices.

Environmental Health Services has reviewed this proposal for landscaping business
and storage of landscaping equipment. We have no objections to the proposal,
however, we do recommend that the following conditions be part of any approval:
We recommend that the following requirements be met prior to allowing the plat to be
recorded:
1. The applicant shall submit a dust abatement plan for review and approval, to the
Environmental Health Services, Weld County Department of Public Health &
Environment.
2. The applicant shall submit a waste handling plan, for approval, to the
Environmental Health Services Division of the Weld County Department of Public
Health & Environment. The plan shall include at a minimum, the following:
1) A list of wastes which are expected to be generated on site (this should
include expected volumes and types of waste generated).
2) A list of the type and volume of chemicals expected to be stored on site.
3) The waste handler and facility where the waste will be disposed (including
the facility name, address, and phone number).
We recommend that the following requirements be incorporated into the permit as
development standards:
1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for
final disposal in a manner that protects against surface and groundwater
contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is not
meant to include those wastes specifically excluded from the definition of a solid
waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.,
as amended.
3. Waste materials shall be handled, stored, and disposed in a manner that controls
fugitive dust, fugitive particulate emissions, blowing debris, and other potential
nuisance conditions.
4. The applicant shall operate in accordance with the approved "waste handling
plan".
5. Fugitive dust and fugitive particulate emissions shall be controlled on this site.
The facility shall be operated in accordance with the approved dust abatement
plan at all times.
6. This facility shall adhere to the maximum permissible noise levels allowed in the
Residential Zone as delineated in 25-12-103 C.R.S., as amended.
7. Adequate handwashing and toilet facilities shall be provided.
8. Sewage disposal for the facility shall be by septic system. Any septic system
located on the property must comply with all provisions of the Weld County Code,
pertaining to Individual Sewage Disposal Systems.
9. The facility shall utilize the existing public water supply. (Left Hand Water District)
10.All pesticides, fertilizer, and other potentially hazardous chemicals must be
stored and handled in a safe manner in accordance with product labeling and in
a manner that minimizes the release of hazardous air pollutants (HAP's) and
volatile organic compounds (VOC's).
11.The operation shall comply with all applicable rules and regulations of the State
and Federal agencies and the Weld County Code.
