Home My WebLink About20073037.tiff RESOLUTION RE: APPROVAL OF RENEWAL APPLICATION FOR TAVERN LICENSE FROM SIPRES LOUNGE, INC., DBA SIPRES LOUNGE AND AUTHORIZE CHAIR TO SIGN - EXPIRES OCTOBER 11, 2008 WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners, as the local liquor licensing authority for Weld County, Colorado, pursuant to Section 12-47-302, C.R.S., and Sections 12-2-30, 12-2-40 and 12-2-50, Weld County Code, may cause a hearing to be held on the application for renewal of any liquor license previously issued by it to determine if good cause exists to refuse to renew said license, and WHEREAS, Sipres Lounge, Inc., dba Sipres Lounge, presented to the Board of County Commissioners of Weld County, Colorado, an application for the renewal of a Tavern Liquor License, for the sale of malt, vinous and spirituous liquors, WHEREAS, pursuant to Exhibit 5-H of the Weld County Code, said applicant has paid the sum of$125.00 to the County of Weld for the renewal of the existing license, and WHEREAS,a hearing before the Board was held on the 26th of September, 2007, at which time the Board deemed it advisable to continue the matter to October 1, 2007, to allow staff from the Weld County Department of Public Health and Environment adequate time to provide an update regarding the new water well,and to have a representative from the Sheriffs Office present, and WHEREAS, on October 1, 2007, the Board of County Commissioners considered said request for renewal, having heard the testimony of Weld County Sheriff Deputy Mike Ornelas and the Sipreses, and WHEREAS, said applicant has exhibited a State Liquor License for the sale of malt, vinous and spirituous liquors for consumption by the drink on the premises only, outside the corporate limits of any town or city in the County of Weld at the location described as follows: 1490 Weld County Road 27 Brighton, Colorado 80603 NOW,THEREFORE, BE IT RESOLVED that the Board of County Commissioners of Weld County, Colorado, having examined said application and the other qualifications of the applicant, does hereby grant License Number 2007-16 to said applicant to sell malt, vinous and spirituous liquors for consumption by the drink on the premises only at said location; and the Board does hereby authorize and direct the issuance of said license by the Chair of the Board of County Commissioners, attested to by the Clerk to the Board of Weld County, Colorado, which license 2007-3037 LC0028 4 ; s& 4-PA-- RENEW LIQUOR LICENSE - SIPRES LOUNGE, INC. PAGE 2 shall be in effect until October 11, 2008, providing that said place where the licensee is authorized to sell malt, vinous, and spirituous liquors for consumption by the drink on the premises only, shall be conducted in strict conformity to all of the laws of the State of Colorado and the rules and regulations relating thereto, heretofore passed by the Board of County Commissioners of Weld County, Colorado, and any violations thereof shall be cause for revocation of the license. Said license is conditioned upon the applicant's compliance with the following conditions: 1. The applicant and licensed premises shall remain in substantial compliance with Enforcement Order Number: DT-040830-6 of the Colorado Department of Public Health and Environment. 2. That immediately and without cessation, the applicant and/or licensed premises shall comply with the following: a. Water shall not be served or ice made for consumption with water obtained from the well that is currently serving the licensed premises. b. Signs in English and Spanish shall be posted in the bathrooms and at every faucet or spigot available or accessible to patrons. c. Bacteriological testing shall be conducted monthly and nitrate testing conducted quarterly at the licensed premises. Results shall be provided to the Weld County Department of Public Health and Environment. d. The Licensee shall host"responsible vendor" training every six (6) months as agreeable to the Colorado Department of Revenue Liquor Enforcement Division, and this training shall be open to other area licensees. Each employee shall be "responsible vendor" trained, and the Licensee shall provide documentary evidence that each employee has been "responsible vendor"trained to the Weld County Clerk to the Board within thirty(30)days of the first available "responsible vendor" class after hiring. They have done everything they can possibly can up to this point. The new well is in, the new treated water storage tanks are on site, and all else looks good. The new well is not operational yet however since they have not gotten CDPHE to sign off on their system operation plan and design documents. The whole project is at a standstill at the state level. All they need is a signature from CDPHE and at the most they got two weeks of work to tie in the new well and storage tanks into the facility. Water tests for the new well have already been taken and analyzed and Nitrate levels are well below the MCL 10ppm, My Inspection report of the facility will be sent to state and will also note a CDPHE signature is needed to bring the new well online.
