GE STENBERGER WH EAS, he Board of County Commissioners of Weld County, Colorado, pursuant to Colorad tatute a the Weld County Home Rule Charter, is vested with the authority of administering the a airs of Weld County, Colorado, and WHEREA the Department of Building Inspection informed the Board that Richard J. Gerstenberger ha a bu• ••- - - '- property,located at 33039 County Road 39, Lucerne,Colorado, 80646,and such uil' con • ered to be dangerous to persons under Section 302 of the 1997 Uniform Code f the Abatement of ngerous Buildings, as adopted by Chapter 29 of the Weld County Code, and WHEREAS,said pro rty is d cribed as 33039 Weld County Road 39, Lucerne,Colorado 80646; being further described pa f Lots 1 nd 5, Block 1,Town of North Greeley,aka Town of Lucerne, County of Weld, Sta f Co o nd WHEREAS,the Board of Coun Commissioners held a public hearing on the 2nd day of July,2007,for the purpose of hearing th estimon garding this matter, at which time Richard J. Gerstenberger was neither present nor repres ted, and WHEREAS,the Board considered the r port re he amount of asbestos present in said building, as set forth in the Report prepared HL Eng' eering, Inc., attached hereto as Exhibit A, which report was prepared at a cost of$1,400.00 nd WHEREAS,after hearing all of the testimony and st e s o ose present and the recommendation of the staff, the Board determined it advi ble t orize the Department of Planning Services to proceed with the abatement of the buil n ordering that said building be made safe by fencing and boarding the building, and by remo I of •- • -bris and junk, as more particularly described in the letter from Agritack, Inc., date May ':7W47, attached hereto as Exhibit B, and that the final costs of such abatement work, in the am• nt of$5,380.00, become a lien on the subject real property, pursuant to Section 29-2-60.M of the Weld County Code ding Section 801.2.1 to the Uniform Code for the Abatement of Dangerous Build' gs, 1 7 • on),and NOW,THEREFORE,BE IT RESOLVED by the Board of County Com sioners of Weld County, Colorado, that the Department of Planning Services be, and here y is, authorized to proceed with the demolition of the buildings at the above location and to remov he junk and debris from the property;however,leaving the concrete foundations since they do not constitute a danger to the public, and that the final costs of such abatement work become a lien on the subject real property, pursuant to Section 29-2-60.M of the Weld County Code(adding Section 801.2.1 to the Uniform Code for the Abatement of Dangerous Buildings, 1997 Edition). 2007-2034 PL0343 e• : fit on F S/3/a.b7 RE: AUTHORIZATION FOR ABATEMENT OF DANGEROUS BUILDING - RICHARD GERSTENBERGER PAGE 2 The above and foregoing Resolution was,on motion duly made and seconded,adopted by the following vote on the 16th day of July, A.D., 2007.
