HomeMy WebLinkAbout20072878.tiff RESOLUTION RE: APPROVE INTERGOVERNMENTAL AGREEMENT FOR PARAMEDIC SUPPORT TO THE GREELEY SWAT TEAM AND AUTHORIZE CHAIR TO SIGN - CITY OF GREELEY POLICE DEPARTMENT WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board has been presented with an Intergovernmental Agreement for Paramedic Support to the Greeley SWAT Team between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Weld County Paramedic Service, and the City of Greeley Police Department, commencing upon full execution, with further terms and conditions being as stated in said agreement, and WHEREAS, after review, the Board deems it advisable to approve said agreement, a copy of which is attached hereto and incorporated herein by reference. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Intergovernmental Agreement for Paramedic Support to the Greeley SWAT Team between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Weld County Paramedic Service, and the City of Greeley Police Department be, and hereby is, approved. BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized to sign said agreement. WHEREAS, WCPS and GPD recognize the dangerous condition and high potential for physical injury may occur to members of law enforcement agencies and other individuals who may be present within the immediate vicinity of a tactical police deployment; and, WHEREAS, both parties agree that such conditions warrant the provision for on-scene medical care; and, WHEREAS, the parties have agreed to the terms and conditions for the assignment and responsibilities of a paramedic to be assigned to the Greeley SWAT Team; and, WHEREAS, in accordance with C.R.S. §29-1-201 and §29-1-203, governments are permitted and encouraged to make the most efficient and effective use of their powers and responsibilities by cooperating and contracting with other units of government for funding and services lawfully authorized by each other; and, WHEREAS, this Agreement is in the best interests of the citizens of both entities and hereby reduce their Agreement to writing. NOW THEREFORE, IN CONSIDERATION OF THE TERMS AND CONDITIONS CONTAINED HEREIN, THE ADEQUACY OF WHICH IS ACKNOWLEDGED BY AND BETWEEN THE PARTIES, THE PARTIES AGREE AS FOLLOWS: 1. General Provisions. a. WCPS agrees to provide medical support for the GPD's SWAT Team (hereinafter referred to as "the Team") in the form of paramedics (hereinafter referred to as "Tactical Medics"), and necessary on-scene medical equipment. WCPS will provide medical supplies and resources for the Tactical Medic to carry out his/her mission. b. The Tactical Medics involved in this program must be full-time employees of the WCPS. Participation in this program is voluntary and the Tactical Medic remains an employee of WCPS and is at all times compensated and entitled to benefits provided by WCPS during actual call-outs. c. Only paramedics completing the training course designated by the Greeley Police Department may participate as a Tactical Medic. GPD will provide tactical training and safety equipment to assigned Tactical Medics. 1 n 2007-2878 - I L'I d. GPD will incorporate the Tactical Medics as full team members, notifying the WCPS on all Team call-outs. The parties agree that the Tactical Medics will be required to train with the Team a minimum of one training session per month, and maintain active practice and training in the paramedic profession. If GPD finds that additional training may be required or beneficial to any Tactical Medic assigned to train with the Team, the Team Commander will discuss the additional training requirements with the Director of WCPS and the two parties will attempt in good faith to meet any identified additional training requirements, subject to the budget and the requirements for the safety and protection of the citizens of Weld County. e. The Tactical Medic assigned to the Team, subject to the terms and conditions as set forth in this Agreement, will be available on an "on call" basis to respond to Team mission call-outs. f. The Tactical Medic's role on the Team is one solely of medical support. Therefore, the Tactical Medic will be unarmed and positioned at the discretion of the Team commander as the situation dictates. As a general guideline, the Tactical Medic will be positioned somewhere just outside the inner perimeter of the area of operations. 2. WCPS Responsibility: a. WCPS shall ensure that the Tactical Medic assigned to the Team maintains medical skills at a level higher than the average paramedic, through additional appropriate training. b. WCPS understands and agrees that the Tactical Medic or.Tactical Medics assigned to assist with the Team will perform the following duties: 1. Acquire and maintain important medical history, immunization status and current health status on each Team member. The confidentiality of this information will be ensured by the Tactical Medic, and HIPPAA requirements will be complied with. The Tactical Medic shall be responsible for ensuring the transfer of information to appropriate medical personnel to save valuable time during the treatment of injury or illness. 2. Monitor the medical effects of environmental conditions on individuals and Team performance. The Tactical Medic will immediately bring any problems to the attention of the Team Commander. 3. Provide field medical treatment to Team members injured or taken ill while engaged in a mission activity. The Tactical Medic ensures that Team members are afforded the best possible treatment under the circumstances, and that Team members are transferred in a timely manner to an appropriate level of care. Humanitarian medical assistance will also be provided by the Tactical Medic to non-law enforcement personnel injured or taken ill during an operation until appropriate transfer to the EMS System can be safely affected. 4. Provide medical care under the direction of the WCPS, using medical protocols and standing orders as established by the Physician Advisor for the WCPS. 2 t The Tactical Medic will provide medical and operational documentation to the Director of the WCPS for review. 5. Serve as the patient advocate for officers who are treated by other medical providers. The Tactical Medic will establish good working relationships with local EMS Systems and with receiving medical institutions and assure appropriate integration of the Team's medical program with local health care delivery systems. The Tactical Medic will keep commanding officers apprised of any new information which becomes available to the Tactical Medic, and recommend actions which should be taken to insure optimum recovery outcomes for the Team member and the Team following injury or illness. 6. Serve as a health information resource for Team members, and serve as the Team Commander's advisor on matters relating to the health of the Team. The Tactical Medic will conduct Medical Threat Assessments to determine the potential impact of medical/health factors on a mission and serve as the Medical Intelligence Officer. c. In the sole judgment of the WCPS Director, if the response of the Tactical Medic called to join the Team is at all times consistent with the safety and protection of citizens and property in the jurisdiction of the WCPS, the Tactical Medic shall respond to such calls within thirty (30) minutes of the call. The WCPS shall have complete discretion to determine whether or not any particular Tactical Medic may respond to any such call to join the Team. A responding Tactical Medic shall be supplied with a pager/beeper at all times, while on call, and shall maintain and operate a UHF radio during all responses to maintain communication with Weld County Dispatch. d. In the event that a WCPS ambulance is requested by the Team Commander, and is made available to a Team mission activity by WCPS, the Team Commander will designate where the ambulance should be located in a stand-by mode. 3. GPD Responsibility. a. The Team and the Team Commander constitute a division under the authority of GPD. GPD represents, and the parties acknowledge, that the Team Commander, while receiving advice from the Tactical Medic, maintains ultimate command responsibility for the health and safety of the Team, which cannot be abrogated. The Team Commander has the following responsibilities: 1. Provide command level support to the Tactical Medic, as Team Medical Officer, for matters relating to health and safety. The Commander should demonstrate through intent and action a true interest and concern for the physical and psychological welfare of Team members. 2. Ensure appropriate safety measures for and by the Tactical Medic are maintained during an operation, including, but not limited to, the following: i. Position the Tactical Medic at the scene of the operation in a safe zone, but near the inner perimeter of the area of operation; 3 ii. Ensure that the scene is safe and secure, as much as practical, prior to calling the Tactical Medic into the inner perimeter of operation; iii. Ensure the victims needing medical care are brought out of an unsafe or unsecured location and taken to a safe zone for treatment by a paramedic. 3. Ensure appropriate medical coverage for all Team activities. 4. Ensure that adequate safety equipment, supplies, and other resources are provided for the Tactical Medic to carry out the mission. 5. Facilitate implementation of the Tactical Medic, acting as the Team Medical Officer's recommendations when determined to be in the best interests of the Team. 4. Goals of Tactical Medical Support Activity. The parties agree that the Tactical Medical Support program is directed at achieving these important goals: a. Provide for a safer environment at which the paramedic performs medical duties at the scene of a tactical operation. b. Enhance Team mission accomplishment. c. Reduce death, injury and illness, and related effects, among officers, paramedics, innocents, and perpetrators. d. Reduce line of duty injury and disability cost to both agencies. e. Reduce lost work time for specially trained, hard-to-replace paramedics and officers. f. Maintain good Team morale when true concern for the Team members' good health is realized. 5. Minimum Training and Qualifications of Tactical Medic. Each applicant and selectee for the parties of Tactical Medic shall complete and maintain the following minimum qualifications. a. Tactical Medics will be trained to at least the PARAMEDIC level and will be required to maintain current certification through the STATE OF COLORADO EMS DIVISION. Tactical Medics will also maintain certification in Basic Trauma Life Support("BTLS"). b. Tactical Medics, as Team Medical Officers, must be familiar with, and able to effectively coordinate with the entire Emergency Medical System, from the area of operation to the receiving medical facility. c. In order to function effectively in support of the Team, the Tactical Medic must have working knowledge of the Team, its tools and tactics. Tactical Medics must therefore train with the Team on a regular basis, as previously set forth in this Agreement, and must be trained to understand mission objectives, tactics used, 4 9r7 weapons, pyrotechnics, and other devices likely to be employed, and communication policies and procedures. d. Tactical Medics shall complete specialized training which teaches the skill necessary to operate in the austere environment and receive federal certification as "Emergency Medical Technician-Tactical". e. All paramedics assigned as Tactical Medics must maintain their clinical skills by actively participating in patient care activities on a regular basis in their employment with WCPS. 6. Miscellaneous Provisions. a. Term. This Agreement shall become effective upon signing, and shall remain in effect for one year, with an automatic renewal from year to year unless sooner terminated as provided herein. This Agreement may be terminated at any time by either party giving the other party 30 days written notice of intent to terminate. b. No Employment Relationship. The parties to this Agreement intend that the relationship between them by this Agreement is that of independent entities working in mutual cooperation. No employee, agent or servant of one party shall be or shall be deemed to be an employee, agent, or servant of another party to this Agreement. Notwithstanding any term or condition contained in this Agreement to the contrary, the parties acknowledge that the Tactical Medic is at all times an employee of WCPS. c. Insurance. GPD and WCPS agree that each party shall provide adequate worker's compensation insurance for each of its respective employees engaged in the performance of activities described in this Agreement. d. Governmental Immunity. Nothing contained herein shall be construed as a waiver of any and all rights, limitations and protections afforded the parties by virtue of the Colorado Governmental Immunity Act, section 24-10-101, et. Seq., C.R.S. The parties specifically reserve unto themselves, their officers, employees and agents any and all defenses, rights, limitations and immunities provided by law. e. Agreement Subject to Adequate Appropriation. Nothing in this Agreement shall be construed to require either party to provide funding not previously budgeted. f. No Third Party Beneficiary. It is expressly understood and agreed that enforcement of the terms and conditions of this Agreement and all rights of action relating to such enforcement, shall be strictly reserved to the undersigned parties and nothing contained in this Agreement shall give or allow any claim or right of action whatsoever by any other person not included in this Agreement. It is the express intention of the undersigned parties that any entity, other than the undersigned parties, receiving services or benefits under this Agreement shall be deemed an incidental beneficiary only. g. Law/Severability. The laws of the State of Colorado shall govern construction, interpretation, execution and enforcement of the Agreement. In the event any provision of this 5 CT ! • Agreement shall be held invalid or unenforceable by any court of competent jurisdiction, such holding shall not invalidate or render unenforceable any other provision of this Agreement. City staff is hereby authorized to make changes and modifications to the Agreement, so long as the substance of the Agreement remains unchanged PASSED AND ADOPTED, SIGNED AND APPROVED THIS 17th day of July , 2007.
