RE: ACTION OF THE BOARD OF COMMISSIONERS REGARDING VIOLATION VI#0700077
AGAINST PAUL AND AMY SHERLING, FLOSS BLACKBURN AND DENKAI ANIMAL
SANCTUARY FOR VIOLATION OF THE WELD COUNTY CODE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Paul and Amy Sherling, Floss Blackburn and Denkai Animal Sanctuary,
VI #0700077, are allegedly in violation of the Weld County Code, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 10th day of July, 2007, a public hearing was held before the Board of
County Commissioners for the purpose of hearing testimony relating to said violation,at which time
this matter was continued to August 14, 2007, to allow adequate time for the tenant to be able to
attend the violation hearing.
WHEREAS, on the 14th day of August, 2007, a public hearing was held before the Board
of County Commissioners for the purpose of hearing testimony relating to said violation, and
WHEREAS, Floss Blackburn, Denkai Animal Sanctuary, tenant, was present at said
hearing, and
WHEREAS, the Board deems it advisable to dismiss said matter due to the tenant bringing
the number of animals to the allowed amount and agreeing to keep all animals at the legal amount
to correct said violation.
NOW, THEREFORE, BE IT RESOLVED by the Board of County commissioners of Weld
County, Colorado, that VI #0700077 against Paul and Amy Sherling, Floss Blackburn and Denkai
Animal Sanctuary be, and hereby is, dismissed.

That is fine, however each time you hit us with a violation prior to this,
it was dismissed and we were found to be in compliance, why would we still
need to continue with a hearing considering these facts? This Sanctuary has
had some incredibly malicious people trying to hurt it, which is where the
complaints are coming from, not because we are irresponsible with the dogs
that we rescue.
I hope you and your kids are feeling better and realize that you are just
doing your job.

attend the June 19, 2007 hearings . However, I was informed that this violation will still
need to be heard before the Board of County Commissioners on July 10, 2007 instead. I will
send you out a letter today giving you the new date and time so you have that for your
records. I understand that you have sent a letter stating that you are currently in
compliance with the number of household pets, however because of the ongoing complaints
and the numerous times this type of violation has been initiated, the County Attorney' s
office has instructed me to continue with the hearings .
Continuing to keep the number of dogs at eight will be a great benefit to this case when
it is heard in July.

In response to your letter and in regards to speaking with you via telephone regarding this zoning
violation matter;
1. I do not personally own any dogs located on the above referenced property.
2. Currently housed on the property are 14 household pets of two or more species and are
located on 80 acres with use of an extra 100,equaling 160 total acres. These animals are
not permanently here and cycle out on a continuing basis.
According to your regulations: "Property that is zoned A (Agricultural) and not part of a
platted subdivision or unincorporated town and which is larger than ten (10) acres shall
he permitted to keep or maintain the following without being considered a Kennel: eight

Dear Ms. Blackburn:
The property referenced above remains in violation of the Weld County Code. I have scheduled a
meeting with the Board of County Commissioners on June 19, 1007 at 10:00 a.m., to consider the
violations occurring on the property. The above mentioned property remains in violation of the
following Section(s) of the Weld County Code:
Chapter 23, Article Ill, Div 1 "A (Agricultural)Zone District"
Section 23-3-20 "Uses allowed by right"
Section 23-3-30 "Accessory Uses"

To bring the property into compliance:
As discussed during an office visit on April 17, 2007 it was recommended that the
number of dogs be reduced to eight (8), closing the violation. The tenant then may
consider purchasing her own property, should the intent remain to increase the number
of household pets, mat this qualify as a KENNEL.
Prior to the addition any more than eight (8) household pets a Use by Special Review
(USR) permit will be obtained.
For questions regarding the permits or application process I suggest you speak to one of
our "On-Call" Planners. To better serve the public, we have two locations open. Our
North office is located at 918 10th Street, Greeley, Colorado. At our North office, an"On-
Call" Planner is available, Monday thru Thursday from 7:30 a.m. - 11:30 a.m. Our
Southwest office is located at 4209 CR 24.5, Longmont, Colorado. At our Southwest
office, an "On-Call" Planner is available Monday thru Thursday from 12:30 p.m.-4:30
p.m. You do not need to schedule an appointment, because individuals are seen on a
sign in basis. Neither office will have a planner available on Fridays for walk-ins. To
better serve you, please bring this letter with you.
This hearing will take place in our Hearing Room, located at 918 10th Street, Greeley, Colorado. It is
recommended that you or a representative be in attendance to answer any questions the Board of
County Commissioners might have about the violations.
Please also be advised that I will be taking video and/or pictures from the road or adjacent properties
the business day before or as soon as possible to the above mentioned Violation Hearing date.
The Department of Planning Services' staff will be recommending that the Board of County
Commissioners authorize the County Attorney to proceed with legal action to remedy the violation. Our
records indicate that you were made aware of the nature of the violation including the action necessary
to correct the violation,and that you were given sufficient time to remedy this violation. If you have any

reduced please send me something in writing and one last inspection will be conducted before
the Department of Planning Services is able to close this violation.
It is the intention of this office to assist and cooperate with you without imposing undue hardships; however,

As a leading non-profit 501(c) 3 organization, Denkai Animal Sanctuary has provided
rescue, rehabilitation and adoption services to many animals since its inception in 2004.
The Sanctuary is unique in that, in addition to providing services to animals in need, it
provides hands-on educational animal husbandry opportunities to at-risk youth. The
bonds we have seen form between our youth and animals have been both inspirational
and, without a doubt, beneficial for both. Educational programs for youth that unite
environmental awareness with compassion for animals are currently being developed by
our Board of Directors and an extended committee. This multi-pronged mission positions
Denkai Animal Sanctuary to become a leading and innovative facility nationwide.
The property located at 10375 WCR 118 in Carr, CO is in compliance with weld county
codes Chapter 23, Article III, Div. 1 Sections 23-3-20, 23-3-30, and 23-3-40.
Chapter 23, Division I Section 23-3-40 "Uses By Special Review"States
"Animal Training and Boarding Facilities where the maximum number of Animal
Units permitted in Section 23-3-50.D is exceeded or when the use adversely
impacts surrounding properties, including noise, odor, lighting, or glare,
traffic congestion, or trash accumulation."
As stated in the attached letter(Exhibit A)to Ms. Siron on May 29, 2007, currently
housed on this property are a total of no more than 16 household pets of two or more
species. Pet Animals enter the Sanctuary as stray, abandoned, neglect cases, and from
other shelters that are over filled. These pet animals do not reside with the Sanctuary
permanently and are adopted into lasting homes successfully. Pet animals that we are not
able to house due to restrictions are referred on to other shelters throughout the United
States. (See attached list, Exhibit B.) Our facility has a working relationship with these
organizations on a regular basis.
It is not feasible for the Sanctuary to gain a USR permit at this point in time due to the
following reasons:
1. The Sanctuary currently leases the above referenced property, this lease expires
June 1, 2008.
2. The Sanctuary has been in compliance with weld county codes, and as stated
in previous letters to Planning and Zoning, plans to pursue a USR permit once a
permanent location has been purchased for the Sanctuary to operate out of.
TRAFFIC
The Sanctuary is neither training nor a boarding facility. The Sanctuary currently houses
less than the number of animal units allowed per acre. The use of this location has not in
any way adversely impacted our surrounding area negatively. Traffic to the Sanctuary is
very minimal. Only those of us living at the Sanctuary and a small number of volunteers
that visit the Sanctuary drive the roads in this area. The haying operation located near us,
gravel pit, and county projects along with neighbors that have hobby riding arenas create
a much larger flow of traffic than the Sanctuary does.
NOISE
Noises produced at our facility are minimal. Occasionally one might hear a horse
whinny, donkey he-haw, or turkey gobble. Sometimes you might even hear a dog bark if
a car pulls in. None of these noises are inconsistent with the area. Every household in
our area has a large number of livestock, horses, cattle, goats, dogs, chickens, and sheep.
The only odor you will find at our facility and any of the surrounding facilities is that
which comes with housing large animals. The facility is properly cleaned, disinfected
and poop scooped on a daily to weekly basis
TRASH COLLECTION
Trash is collected and placed in proper containers, then hauled to the dump on a regular
basis.
LIGHTING/GLARE
There is no excess lighting or glare from this property.
DOG FACILITIES
Dogs are housed in securely fenced areas with chains and locks to prevent break outs or
break-ins. When Sanctuary caretakers are away for any period of time, dogs are kept
indoors and secured in crates/kennels. Dogs are not allowed to run loose without proper
accompaniment. These areas are already monitored by the Pet Animal Care Division of
the Colorado Department of Agriculture through which we are already licensed.
We have an excellent relationship with the residents of Carr and surrounding neighbors
support our work and mission through volunteering, donations, and fostering animals.
The Sanctuary has helped to provide a Trap/Neuter/Release program to local residents for
feral and barn cats aiding in reducing population and stabilizing feral colonies for area
residents.
I encourage you to visit our facility and our website 1,i. • ) to
familiarize with the work that we are doing for this county and our surrounding
communities. Without this facility, there would not be any place for these animals to be
housed and cared for properly in this northernmost area of Weld County. I encourage

This letter is in support of Floss Blackburn and Denkai Animal Sanctuary in Carr,
Colorado. I am a veterinarian that has been providing animal care to the sanctuary
animals for the last year. I am also a member of the board of directors for the sanctuary.
I have visited the santuary many times over the last year and have never seen any of the
problems cited in the complaint (excessive noise, trash piled up, offensive odors or traffic
congestion). The sanctuary has always been clean, organized and the animals are always
well cared for when I have visited. There is a large parking area in front of the sanctuary
which has never been full when I have been there. The areas where horses and livestock
are kept are always well cleaned out and relatively odor free. The area where the dogs are
kept is cleaned up several times during the day and is also odor free.

To whom it may concern:
We are writing this letter with the deepest concern for the future of Denkai Sanctuary.
We as a family have been volunteering time to the animals and the needs of the sanctuary
for two years. The needs of all the animals are great. Due to the neglect and selfishness of
some people's hearts, it is truly the animals that pay the ultimate price. If it were not for
people of deep caring and conviction like Floss Blackburn there would be only one future
for abused, neglected and abandoned animals (an un-timely death).
As the animals are brought to us, you can see in time why animals were put on this earth
for us to care for. Even in a state of near death you can look into the eyes of these animals
and know their love for man is unconditional. A whinny of a horse or the bark of a dog is
just their expression of life. Just like people, when there are more than one in a crowd
they tend to voice themselves over the top of every body else. The animals interact with
each other just as people do. Barking, whinnying, grunting is just their way. It's too bad
most people just don't take the time to listen. These sounds of life may be construed as
noise, but believe me when I say that most of the animals when the come to the
sanctuary are so run down and scared we are lucky to hear a whimper. The whimper is
most of the time heard in pain. So the bark of a dog, the whinny of a horse is music to our
ears and the sound of life. As with all farm and live stock operations there is the fragrant
smell of hay and animals. But unlike the cattle industry horses and smaller live stock are
a breeze to keep clean. We wash down and treat the animals with insecticides and
biocides with frequency that keep the flies down to a minimum and clean manure from
the pens that also reduce the flies. Unlike the local dairy and feed lots the sanctuary is
kept up very well. When Floss took over the property over a year ago it was utilized as a
cattle operation. We have worked diligently to fix and clean the pens of the manure to
eliminate the smell and flies.
The needs of the sanctuary in its self are great. It takes the care and understanding of
people to make it successful. At the sanctuary success is measured in small steps. The
sponsorship and support is small but very dedicated to the cause. As we all work full time
jobs to make our way through our day to day existence, the sanctuary and the needs of the
animals is Flosses' full time job. You don't see them driving around in brand new high
dollar SUV's. They drive donated near death vehicles themselves. All the equipment is
donated or bought with very limited funds. It takes these vehicles and the limited time of
the volunteers to keep the sanctuary up. At times both are in short supply but not at the
fault of the animals or the efforts of Floss. If people would take responsibility to care for
the creatures of the earth to begin with there would not be need for the sanctuaries. But it
is what it is and we do the best we can to rectify the neglect and abuse of some.
We ask on behalf of those who can't speak, (but can bark and whinny)to help us to help
those that failed to up hold their end of the deal at the expense of the animals, allow Floss
and those who do care the opportunity to operate the sanctuary.
