I have reviewed the right of way situation you presented on WCR 29, south of WCR 32 and this is what I
found:
The right of way in Section 20 (West half of road)did come to the County in 1889 as part of that
Resolution, Bk 86 Page 273. Whether or not the road was ever constructed does not matter. The right of
way (30') is ours.We have many unimproved right of way miles within the County.
The right of way in Section 21 (East half or road)was not secured by the 1889 Resolution. It was a rail
road section, meaning the Federal Government gave this section of land to the railroads. The
Railroads only requirement was to file a map of the sections they wanted and they couldn't be adjoining
sections. These maps were filed with the General Land Office and can now be seen at the BLM office in
Lakewood. Generally, title to the land happened when the map was filed. Since most of the Railroad
maps were filed in the 1860's, 1870's and early 1880's, this land was taken out of the public domain prior
to the 1889 Resolution so the Resolution did not apply and Weld County does not have right of way
based on the 1889 Resolution
In 1890 a petition was filed to open this road. Land was acquired by that petition. Land in Section 20 was
not secured because the County already had this right of way by the 1889 Resolution. The land
in Section 21 was acquired with a payment of$1.00 to the Railroad, as indicated on the document. The
document found in Book 48 at Page 334 indicates that the road was declared a public right of way.
Whether or not the road was built is another matter. It may have been, and when the coal mining in the
area subsided, the road was no longer maintained. Early roads in the County are not of the character that
roads are built to today. Lack of road maintence could quickly remove traces of the road. Whether or not
the road was even constructed is, again, of little consequence because of the road declaration.
Lack of maintenance is not an abandonment. Vacations require documents. No vacation documents were

a
found to indicated the road was vacated or legally abandoned. A title commitment may have indicated if a
road vacation happened, but my quick research did not provide one. You could ask if the surveyor has a
title commitment, but if he had one,this question probably would not have come up.
In summary, Weld County has 30'of right of way in Section 20 under the 1889 Resolution found in Book
86 at Page 273. Weld County probably has right of way in Section 21 because of the road petition in
1890, found in Book 48 at Page 334 and because of the lack of a document vacating or abandoning the
right of way. If the surveyor can produce the document, by either a title commitment or a title
search, then Weld County would not have right of way in Section 21.
I would recommend the survey indicate the County has right of way in Section 20 by the 1889 Resolution.
If, after the surveyor has completed a title search, or reviewed the title commitment, and a vacation
document was not discovered, then the survey could show right of way in Section 21 by Book 48 at Page
334.

To Whom It May Concern:
A site inspection was conducted on September 27, 2007, to determine the structural stability of the
building under construction at 14016 CR 32. As a result of the inspection the Building Department
agrees to temporarily lift the Stop Work order placed on the property in order to allow for additional
bracing/support of the structure by installing the lower roof rafters to secure the center of the
building. The only building permit issued at the above address is for the footings and foundation and
no work is to proceed beyond the installation of the lower roof rafters until a full building permit is
issued for the project. If work is done in excess of the above, an investigation fee will be assessed to
the building permit as allowed per Appendix 5-K of the Weld County Code.

The building department does not have any issues with changing the occupant load
from 175 to 130 as long as the new occupant load is posted at the final inspection. If the
planning department is going to release the building permit with conditions to be met
before the C/O please list what those conditions are on the building permit so that the
inspectors are aware. I will do a site inspection on Thursday to determine if the
structure is safe until the stop work order can be lifted and the permit is released. I will
let you know the results.

Based on the recommendation letter from Wernsman Engineering received on 10/18/07, the building
department agrees to temporary lift the stop work order placed at 14016 CR 32. The stop work order
is only lifted to allow the roof sheathing to be installed as requested by the engineer of record. No
work is to proceed beyond that point without the appropriate building permits being issued.

State of Colorado,Office of the State Engineer,Division of Water Resources,letter dated
August 3e,2006,prepared by Kevin G.Rein,P.E.,Chief of Water Supply addresses the
quality of the water supply. The water was going to be sent and tested once the
construction of the pump and filtration system was constructed to the building. Quality
Well and Pump is engineering a special pump system to draw water to be tested prior to
this to satisfy the State testing requirement. It will meet State standards.

The Department of Planning Services reviewed the above referenced Use by Special Review
documentation and drawings and offers the following comments:
The Use by Special Review Plat shall be prepared in accordance with Section 23-2-260.D of
the Weld County Code. In addition to these requirements,the plat scale shall be 1"=20 feet.
The Vicinity Map scale of 1"=2000 feet scale accurately be delineated on the plat.
COMMENT:ACKNOWLEDGED, REFER TO SHEETS 1,2,AND 3 OF 3 FILING PLATS
This application shall be in compliance with Section 23-3-250 A. and B and is address in the
following comments.
COMMENT:ACKNOWLEDGED.
Section 23-3-250A1
Stormwater Management. All users of land shall provide and maintain stormwater retention
facilities designed to retain the stormwater runoff in excess of historic flow from the developed
site. The stormwater retention facility on a developed site shall be designed for a one-hundred-
year storm. The stormwater retention facility shall be designed and operated to release the
retained water at a quantity and rate not to exceed the quantity and rate of a five-year storm
falling on the undeveloped site. The application materials do not specifically address this issue.
The applicant shall contact the Storm water Engineering Staff of the Weld County Department
of Public Works, to further discuss this issue. Written evidence of compliance shall be
submitted to the Department of Planning Services.
COMMENT: UNAPPLICABLE
Section 23-3-250.A.2
Parking. Sufficient screened, off-street, paved parking areas shall be provided to meet the
requirements of visitors and customers of the Uses Allowed by Right and Accessory Uses.
Appendix 23-A describes the design requirements for parking spaces and Appendix 23-B
delineates the number of parking spaces required by use for this property.
COMMENT:ACKNOWLEDGED, REFER TO SHEET 2 OF 3 FILING PLAT.
The proposed,facility is a single story structure of approximately 2000 SF. The application
materials state there are no persons employed at this facility other than the persons of the
caretaker's residence.
COMMENT:ACKNOWLEDGED.
Given the numbers of potential users to this facility, 175 persons as stated in their application
materials, the Department of Planning Services Has determined that 88 spaces are required.
Further the area delineated as"Future Parking"should be labeled as"Overflow Parking"and
constructed at the time of the primary"Parking Area'as delineated on the supporting
documents.

The facility will utilize catered food for all events. A minimum of ten parking spaces shall be
reserved for the catering staff and support personnel.
The total parking for events at this facility shall be 98 spaces.
COMMENT: DUE TO THE MAXIMUM DAILY DISCHARGE FOR THE SEPTIC SYSTEM THE
U.S.R. RESOLUTION WILL HAVE TO BE AMENDED FROM 175 PERSONS TO 130
PERSONS. THIS WOULD TECHNICALLY REDUCE THE REQUIRED PARKING SPACES
FROM A TOTAL OF 98 TO 74 SPACES.
Section 23-3-250.A.3
Street Access. Lots shall have safe access to an approved public or private street. The design
designation of any street or highway as to type shall be in conformance with that shown on the
county thoroughfare plan and/or the master plan of the affected municipality. Visual inspection
of the USR Plat identifies two points of ingress and egress, one which is part of a gated private
drive. The Further,the points of ingress and egress do not interconnect at a perpendicular
angle with the County Road. The applicant shall delineate on the plat the proposed wheel stops
and surface lighting as warranted. The applicant shall coordinate all transportation related
activities with the Department of Public Works. Written evidence of compliance shall be
submitted to the Department of Planning Services.
COMMENT:ACKNOWLEDGED REFER TO SHEET 2 OF 3 FILING PLAT WHICH
ILLUSTRATES COMPLIANCE.
The Fire District of record may require a second point of ingress and egress for this facility,
including, potentially the upgrade and maintenance of County Road 32 right-of-way. All
approved access roads shall be graded and drained to provide all weather access.Accesses
shall be placed in such a location as to have adequate sight distance in both directions, shall
not be placed below the crest of a hill or where physical obstructions are present. Written
evidence of compliance shall be submitted to the Department of Planning Services.
COMMENT:ACKNOWLEDGED ALL FIRE DEPARTMENT ISSUES HAVE BEEN
ADDRESSED AND SATISFIED.

Required Yards-Setback
No use or accessory use may be located closer than twenty(20)feet to the existing or
proposed (whichever represents the greater right-of-way width)highway or street right-of-way.
Off-street parking areas may be permitted in the required setback area when the area is
screened from direct view of persons on the public rights-of-way. Fences over six(6)feet in
height are not required to comply with the minimum setback and may be located on the
property line. Fences located on corner lots abutting public right-of-way shall not obstruct the
view of vehicular traffic at an intersection. Written evidence of compliance shall be submitted to
the Department of Planning Services.

Required Yards-Offset
No use or accessory use may be located closer than ten (10)feet to its lot line. Off-street
parking areas may be permitted in the required offset area when the area is screened from
adjacent lots zoned R-1, R-2, R-3, R-4 or R-5. Fences over six (6)feet in height are not
required to comply with the minimum Offset and may be located on the property line. Prior to
the release of building permits, the offset shall be verified. Written evidence of compliance shall
be submitted to the Department of Planning Services.

Section 23-3-250.A.5.A
Required Landscaped Areas
No more than eighty-five percent(85%) of the total area of a lot shall be covered. Land shall
not be deemed covered if it is used for growing grass, shrubs, trees, plants or flowers or if
covered by decorative gravel or wood chips, or if it is otherwise suitably Landscaped. There
was a schematic Landscape and Screening Plan submitted with the application materials. The
applicant shall address this issue and provide additional documentation including all proposed
fencing, lighting, adjacent property screening and landscape treatment to meet this section of
the Weld County Code.
Further, given that the site is irrigated, the Department of Planning Services will require a plant
material list to coincide with the submitted Landscape Plan. Staff will require an approved weed
management plan and a reseeding/post construction plan to facilitate soil stabilization and
plant material growth.
COMMENT: ACKNOWLEDGED REFER TO SHEETS 2 AND 3 OF 3 FLUNG PLATS WHICH
ILLUSTRATES COMPUANCE.
Section 23-3-250.A.5.B
That portion of a lot which abuts a public or private street right-of-way shall be landscaped for a
distance of ten (10)feet, measured at a right angle from the lot line towards the interior of the
lot. Driveways may pass through the required landscaped areas.Additional information is
required prior to accepting the plat for recording. Written evidence of compliance shall be
submitted to the Department of Planning Services.

Areas used for trash collection shall be screened from public rights-of-way and all adjacent
properties. These areas shall be designed and used in a manner that will prevent wind-or
animal-scattered trash. The application materials did not identify the location of the dumpster
on the plat. Future submittals shall address this issue as outlined in this Section of the Code.
Written evidence of compliance shall be submitted to the Department of Planning Services.

Water Supply. Uses shall have an adequate source of potable water. The application
materials state that water is provided via a Commercial Well. Further,the applicant provide
written evidence that this well is for the sole use of this facility, and if it is a shared well, that the
State Engineers Office recognizes that this well is permitted to provide water to other
structures. The applicant shall meet the requirements of the Weld County Department of Public
Health and Environment at all times. Written evidence of compliance shall be submitted to the
Department of Planning Services.
COMMENT: ACKNOWLEDGED
Section 23-3-250A8
Sewage Disposal. Uses shall have adequate sewage disposal facilities. The application
materials state that individual sewage disposal systems(ISDS)will handle the effluent flow.
Further, the applicant shall meet the requirements of the Weld County Department of Public
Health and Environment. Written evidence of compliance shall be submitted to the Department
of Planning Services.
COMMENT: ACKNOWLEDGED
Section 23-3-250A9
Outside Storage. Uses involving outdoor storage of vehicles, (including the parking of

employee vehicles)equipment or materials when permitted shall be screened from public
rights-of-way and all adjacent properties. The applicant shall submit documentation as to how
the outside storage win be screened during the construction period, and for periods thereafter
as applicable.
COMMENT: ACKNOWLEDGED NO OUTSIDE STORAGE IS TO EXIST.
Section 23-3-350.B.
Operation Standards. Uses shall demonstrate conformance with the following operation
standards to the extent that they are affected by location, layout and design prior to
construction and operation.
Further, the applicant shall submit to the Department of Planning Services written evidence of
compliance with all Department of Building Inspection regulation.

Noise. Uses and structures shall be located, designed and operated in accordance with the
noise standards as established in Section 25-12-101 C.R.S. The applicant shall meet the
established standards set by the Weld County Department of Public Health and Environment.

Air Quality. Uses shall be located, designed and operated in accordance with the air quality

of Public Health and Environment and State Engineers Office as applicable,with written
evidence provided to the Department of Planning Services.

APPLIED FOR AND RELEASED. POND DESIGN MEETS AND EXCEEDS STANDARDS
PONDS ARE LINED AND FILTRATED.
Section 23-2-250.8.4
Radiation and Radioactive Materials. The handling, use, storage and processing of radioactive
materials shall be in accordance with the applicable regulations of the State and the United
States government The application materials do not indicate this is applicable, should this not
be the case, the applicant shall provide additional information to the Weld County Department
of Public Health and Environment.
COMMENT:ACKNOWLEDGED
Section 23-2-250.B.5
Heat. Uses shall not emit heat in such an amount sufficient to raise the temperature of the air
or of materials at or beyond the Lot line more than five (5) degrees Fahrenheit. The application
materials do not indicate this is applicable, should this not be the case, the applicant shall
provide additional information to the Weld County Department of Public Health and
Environment and the Department of Building Inspection. Further, the applicant shall obtain a
written approval from the jurisdictional Fire Protection District stating that the facility is in
compliance with the Fire Code. COMMENT: ACKNOWLEDGED NOT APPLICABLE.

Section 23-2-250.B.6
Light. Any lighting, including light from high temperature processes such as welding or
combustion, shall be designed, located and operated in such as manner as to meet the
following standards: sources of light shall be shielded so that beams or rays of light will not
shine directly onto adjacent properties; neither the direct nor reflected light from any light
source may create a traffic hazard to operators of motor vehicles on public or private streets;
and no colored lights may be used which may be confused with or construed as traffic control
devices. The application materials did not include a Lighting Plan. Should exterior lighting be a
part of this facility, all light standards shall be delineated on the USR Plat.

Property Maintenance. Property shall be maintained in such a manner that grasses and weeds
are not permitted to grow taller than twelve(12) inches. In no event shall the property owners
allow the growth of noxious weeds. The application materials do not address property

I would like to extend my deepest apology to you and your staff if I have made you feel
personally attacked over the past few days. I have had some physical problems the past
few months that put me in the hospital the end of last week through the weekend and the
medications and stress with that has made me not myself to say the least. For this I do
want you to know my comments about the inner coordination of departments,and melt-
downs,in addressing the U.S.R.issues were not to be taken as a personal attack on you
or your professional abilities.
As you know we have been working on this for a very long time now and you have been
instrumental in getting us this far. The pressures from all parties involved along with my
physical problems have been quite overwhelming. You and I both know our primary
goal is to finalize the U.S.R.and that is my only interest. Your conversations with me

130. The need for the change from 175 to 130 is due to the design standards set by the
Weld County Health Department for septic system design. The septic system must be
designed to stay under a flow rate of 2,000 gallons per day,i.e. 15 gallons per person
