Please review the enclosed notice and resolution pertaining to the aforementioned annexation proposal and
return any comments to the Town of Windsor at the address shown below within thirty (30) days of the
receipt of this memorandum. If the Town has not received comments from your agency within this 30-day
review period, the Town will consider the lack of a response to be a positive response to the proposal in its
current form. However, for the purposes of having a complete file on this proposal, the Town would
appreciate a response from your office even if your only comment below is "no comment." Thank you
very much for your participation in this process and your input concerning this proposal.
Public Meeting: The Windsor Planning Commission will hold a public hearing at 7:00 p.m. on
Wednesday, February 21, 2007 and the Windsor Town Board will hold a public hearing at 7:00 p.m. on
Monday, February 26, 2007 to receive public comments on the enclosed annexation, both of these public
hearings will be held in Windsor Town Hall, 301 Walnut Street.

GREAT WESTERN FIFTH ANNEXATION.
WHEREAS, the Town Clerk, pursuant to Section 31-12-107, CRS, has received a
petition to annex to the Town of Windsor certain real property known as the Great Western Fifth
Annexation, the legal description of which is attached hereto as Exhibit A and incorporated
herein by this reference; and
WHEREAS, the Town Board desires to initiate the annexation proceedings in
accordance with the requirements of the Windsor Municipal Code and the Municipal Annexation
Act of 1965.

ESTABLISHING A DATE FOR A PUBLIC HEARING BEFORE THE TOWN BOARD OF THE
TOWN OF WINDSOR, COLORADO, WITH REGARD TO THE GREAT WESTERN FIFTH
ANNEXATION.
WHEREAS, the Town Clerk, pursuant to Section 31-12-107, CRS, has received a petition to
annex to the Town of Windsor certain real property known as the Great Western Fifth Annexation, the
legal description of which is attached hereto as Exhibit A and incorporated herein by this reference;and
WHEREAS, the Town Board heretofore accepted the annexation petition and annexation
proceedings were initiated by resolution on January 8,2007; and
WHEREAS, pursuant to The Municipal Annexation Act of 1965 (the "Municipal Annexation
Act"), the Town Board is required to determine whether or not the aforesaid petition is in substantial
compliance with the requirements of the Municipal Annexation Act; and
WHEREAS, upon such determination, the Town Board is required to establish a public bearing
date in accordance with the requirements of the Municipal Annexation Act.
NOW, THEREFORE, IT IS FOUND AND RESOLVED BY THE TOWN BOARD OF THE
TOWN OF WINDSOR, COLORADO,AS FOLLOWS:
1. That the annexation petition for the Great Western Fifth Annexation is in substantial
compliance with the requirements of the Municipal Annexation Act.
2. That a public hearing on the Great Western Fifth Annexation shall be held at a meeting of
the Town Board of the Town of Windsor, Colorado which is scheduled to commence at 7:00 p.m. on
Monday,February 26,2007.
3. That the Town Clerk, or her designee, shall give notice of the aforesaid hearings in
compliance with the Municipal Annexation Act.

Broe Land Acquisitions II, LLC, a Colorado limited liability company, Broe Land
Acquisitions 10, LLC and Nancy D. Likarish ("Petitioners"), the landowners of more than
50% of the territory, excluding public streets and alleys, containing 88.98 acres more or
less and legally described on Exhibit A attached hereto and incorporated herein by this
reference (the "Property"), to be known upon annexation as the "Great Western Fifth
Annexation", allege the following to be true and correct:
The perimeter of the Property to be annexed has a distance of 12,828.95 feet of which
3,724.63 feet are contiguous to the existing limits of the Town of Windsor (the "Town").
A minimum of 1/6 of the perimeter of the proposed annexation is contiguous to the
Town.
Petitioners further allege:
1 It is desirable and necessary that the Property be annexed to the Town.
2 A community of interest exists between the Property and the Town
3 The Property is urban or will be urbanized rn the near future.
4 The Property is integrated or capable of being integrated with the Town
5 In establishing the boundaries of the Property being annexed. no land held in
identical ownership is divided into separate parcels unless the owner of said land
has consented in writing or joins in this Petition.
6. No land held in identical ownership, comprising 20 acres and together with
improvements having an assessed valuation in excess of $200,000.00 in the
year preceding the filing of this Petition, is included unless the owner of such land
has consented in writing or joins in this Petition
7 No proceedings for annexation of the Property have been commenced for
annexation to another municipality.
8. The signers hereof comprise the landowners of more than 50% of the Property
proposed to be annexed exclusive of streets and alleys and comprise more than
50% of the landowners of the Property.
9. The mailing address of each signer and the date of signing of each signature are
all shown on this Petition for Annexation.
10 The legal description of the land owned by each signer of this Petition for
Annexation is set forth on Exhibit B attached hereto and incorporated herein by
this reference.
Therefore, the undersigned Petitioners hereby request that the Town approve the
annexation of the area described on Exhibit A and do herewith pay the required fees.
In addition to the annexation, the undersigned Petitioners request that the property
described on Exhibit A be initially zoned Heavy Industrial I-H District.
This annexation and all promises and obligations of Petitioners contained herein are
specifically conditioned upon the Town approving concurrently with this annexation (i) a
master plan for the Great Western Fifth Annexation as an amendment to the Master
Plan for the Great Western Second, Third and Fourth Annexations with conditions
acceptable to Petitioners; (ii) the zoning of the Property as herein requested; (iii) an
amendment to the Great Western Annexation and Development Agreement with terms
and conditions acceptable to Petitioners; and (iv) a subdivision of the Property with

ANNEXATION IMPACT REPORT
GREAT WESTERN FIFTH ANNEXATION & MASTER PLAN
The parcels proposed for annexation contain approximately 89 acres generally
located south of and adjacent to Eastman Park Drive (Weld County Road 64.75);
and east of and adjacent to Weld County Road 23 (directly south of the Owens-
Illinois Bottle Plant); being more particularly described in the attached legal
description.
1) (a) Please see the enclosed master plan and vicinity map for current and
proposed municipal boundaries.
(b) Please see the enclosed master plan (see also Item #3 below).
(c) Please see the enclosed annexation map and master plan for the current
and proposed land use patterns of the proposed annexation and the
enclosed Town of Windsor Land Use Plan map for the proposed land use
patterns for the subject property to be annexed and for surrounding
properties.
2) A draft or final preannexation agreement has not been prepared. An addendum to
the existing agreement regarding the Great Western 2nd 3rd and 4th Annexations
will be prepared to address the Great Western Fifth Annexation. The
aforementioned existing agreement is available for review in the office of the Town
of Windsor Planning Director.
3) Municipal services will be provided as follows:
➢ Water — The Town of Windsor will provide potable water service to the

STATEMENT OF COMMUNITY NEED
The approximately 89-acre property subject to this application represents a
significant addition of industrially zoned property to the Town of Windsor. The
annexation, zoning, master plan and subdivision approval as proposed will provide
the opportunity for approximately 200,000 square feet of heavy industrial use,
which is expected to generate property and use tax revenues and employment
opportunities for the Windsor community. The industrial use will be well served
by the existing railway spurs and mainlines.

The above referenced annexation is for approximately 89 acres planned to be zoned heavy
industrial. This letter summarizes the implications of the proposed area for Windsor School Disnict i
Re-4 given the stated use of the land, as requested by Eric D. Swanson.
Windsor School District understands that this project would be zoned heavy industrial and
would be developed by a single heavy industrial user. District Re-4 further understands that at this
time, there are no further uses proposed for the property and will not generate students. Given the
stated industrial use of the land, Windsor School District does not object to the approval of this
annexation. If use of the land should change, however, the School District respectfully requests the
opportunity to respond with comments regarding the impact of any re-zoning or land use changes.
