RE: APPROVAL OF LOT SIZE VARIANCE NO. 130 - DARRELL AND NELVA
BEARSON
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners has determined,
at a public meeting held on the 12th day of August, 1981, in the
Chambers of the Board of County Commissioners of Weld County,
Colorado, that a certain tract of land is owned by Darrell
and Nelva Bearson, which land is more particularly described
as follows :
Part of the North Half of the Southeast
Quarter of Section 7, Township 2 North,
Range 66 West of the 6th P.M. , Weld
County, Colorado
WHEREAS, the owners of said tract of land desires to
obtain a variance from the minimum lot size requirement so
that said applicants may apply for a recorded exemption, as
set forth in Section 9-A.A. (6) of the Subdivision Regulations,
and
WHEREAS , the Board of County Commissioners of Weld County,
Colorado feels that the applicants have shown good cause for
granting a lot size variance under Section 9-4.A. (6) of the
Weld County Subdivision Regulations.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado that a variance from
lot size requirements be, and hereby is, granted to Darrell
and Nelva Bearson for the above described parcel of land.
The above and foregoing Resolution was, on motion duly
made and seconded, adopted by the following vote on the 12th
day of August, A.D. , 1981.

Re: Lot Size Variance #130
Dear Commissioners:
The attached letter and related materials are in reference to a request
for a lot size variance from Darrell and Nelva Bearson. The property
on which this request has been made is described as part of the N1,
Section 7, T2N, R66W of the 6th P.M. , Weld County, Colorado. This property
is located 31 miles north of Fort Lupton, Colorado. The request is to
obtain a variance from the minimum lot size requirement, Section 9-4 A.
(6) so that they may make application to apply for a recorded exemption.
If this lot size variance is granted, the Berason's will proceed with
their application for a recorded exemption to divide the property into
two parcels. Mr. and Mrs. Bearson wish to create a five acre and a
37 acre parcel more or less, both of which contain existing improvements.
The balance of the property will be used as a dairy operation.
Based upon the information and the adopted policies in the County, the
Department of Planning Service's staff recommends this request be
approved for the following reasons:
1. The request is in compliance with the intent clause of the
recorded exemption procedure (Section 9-2 of the Weld County
Subdivision Regulations) in that the proposed use of the property
will be compatible with the surrounding agricultural land uses.
2. The request is in compliance with the intent clause of the
Agricultural Zone District (Section 3.3.A. of the Weld County
Zoning Resolution) and the Weld County Comprehensive Plan in
that the request will be encouraging agriculture and related
uses to continue as the predominant land uses.

3. The request complies with Section 9-4 A. (6) of the Weld
County Subdivision Regulations.
It should be noted that the parcel is partically located in the 100 year
floodplain of the Platte River. However, the improvements on the parcel
already exist and are above the floodplain.

The following purposal for a Lot Size Variance is
being requested by the purchasers . An exemption of the
small house and apprx. 5 acres . Darrell L and Nelva M.
Bearson need this for the following reasons:
1. They have recently sold a dairy farm in Idaho
on which they are carrying back part of the loan.
A large lump sum is due in March of 1982. If this
note is paid in full, their intention is to uae the
existing small dwelling for their milkman in order
for him to be on site. This of course would be their
preference.
2. According to the contract sellers Rolland A and
Esther H. Johnson will provide for a interest only
payment in a lump sum the first year. After which
time a monthly amortized loan will be set up in the
amount of $1690.40. These payments of $1690.40
plus additional expenses of operating and maintaining
a dairy would cause an extreme hardship on the
purchasers if they cannot be provided a possible
alternative namely selling of the second smaller
home and apprx. 5 acres if necessary. The property
is ideally located for such exemption. The requested
amount would be apprx. 5 acres which will be evidenced
by a survey. The exempted land would not affect the
operation of the dairy because that particular 5 acres
already has a oil well with easements and restrictions .
The apprx. useable ground would only be apprs . 2 1/2
acres . The purchasers feel that they can not afford
to purchase even at the loss of their earnest money
without this provision. The property will be home
owner occupied.
The purchasers will be out of state for the next 3 weeks
and have requested that this be submitted immediately in order
that they may make a decision.
