HomeMy WebLinkAbout20072449.tiff RESOLUTION RE: APPROVE ENERGY AND MINERAL IMPACT ASSISTANCE PROGRAM APPLICATION FOR COUNTY ROAD 2 (PHASE 2) AND AUTHORIZE CHAIR TO SIGN WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board has been presented with an Energy and Mineral Impact Assistance Program Application for County Road 2 (Phase 2)from the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Department of Finance and Administration, to the Colorado Department of Local Affairs, commencing upon full execution, with terms and conditions being as stated in said application, and WHEREAS,after review, the Board deems it advisable to approve said application, a copy of which is attached hereto and incorporated herein by reference. For example:2-bay,2,000 sq.ft.metal fire building This is the second phase of a two part improvements project to CR 2, between CR 39 and CR 45. This three mile section serves as a major transit corridor for both Weld and Adams counties. This roadway has been identified as one of the major roadways running through the Wattenberg Energy Field. (See attached map of all the wells located within this area) Traffic studies show this roadway is heavily utilized on a daily basis by not only local traffic but energy drilling vehicles, trucks gathering oil in the area, and oil and gas servicing vehicles. The heavy truck traffic and traffic counts of over 700 VPD necessitate the improvements to the road for safety, dust abatement, and traffic flow. Weld and Adams County will share in the costs of construction, and Weld will serve as the lead jurisdiction on the project 7. a. PROJECT INFORMATION The statutory purpose of the Energy and Mineral Impact Assistance program is to provide financial assistance to "political subdivisions socially or economically impacted by the development, processing or energy conversion of minerals and mineral fuels." 1. Social and Economic Impact a. Describe how the applicant is impacted by the development, production, or conversion of energy and mineral resources Weld County has over 19,500 oil and gas wells dispersed throughout the county with over 10,000 of these being active wells. According to DPT, this represents over fifty percent of all active wells in Colorado. The biggest effect of this production is seen on the impacts to the local transportation network system. The numerous oil trucks gathering oil, and drilling wells produce a constant impact to county roads. The intensity of this use requires heavier maintenance and increased functionality of the impacted roadways. Adams County has over 1000 wells. The roadway proposed for improvements runs through the Wattenberg field which has over 6,000 active wells. The passage of recent legislation resulted in a modification to historic spacing of the Wattenberg field resulting increase to 20 acre spacing. This is likely to result in a higher concentration of well placement in the near future. b. To further document impact, cite the type of past, current or proposed energy/mineral impact activities in the area, the names of the companies involved, the number of employees associated with the activities impacting the jurisdiction and other relevant, quantitative indicators of energy/mineral impact. The attached map delineates the active oil and gas activity in this area. In the first six months of 2007 six-hundred and thirty five(635)permits for oil and gas were issued. c. Cite actual usage statistics that document impact and the need for the project. For example, "heavy truck traffic related to energy development activities is impacting a county road that needs improvement. A traffic count done in May 2006 showed that heavy truck traffic increased from 100 trips per day to 300 trips". (If documentation is not available, consider undertaking the necessary research before submitting an application.) In the spring of 2007, the Weld County Public Works Department conducted a traffic study on CR 2 from CR 45 to CR 39. In this stretch of CR 2 traffic accounts exceeded 700 VPDs. This represents more than three times the acceptable levels of traffic for this gravel roadway. Because of this heavy use, Weld County routinely places Magnesium Chloride on roads to help lessen the impact of dust. While this application is useful, it is not a long term solution to the dust concerns regarding this roadway. 2. Project Significance a. Why is the project needed and what are the goals of the project? The project is needed to increase the overall functional capacity on this roadway thereby ensuring a safer and more efficiently designed roadway. Of primary concern is the amount of dust abatement efforts required to keep the road within State air compliance standards. This road is uniquely situated in Weld County and as such provides a major link between 1-76 and CR 45. As the area continues to grow and oil and gas productions continues to increase, this road will only become more utilized and further congested. b. How will project implementation benefit public health and safety, improve the effectiveness or efficiency of service delivery systems and/or generally improve the quality of life for residents? The public benefits of this project are numerous: reduction in air pollution, increase in overall design and functionality of the road, heightened safety standard, and this project affords the public increased efficiency in the transportation system. Page 5 of 6 Pages c. . What are the consequences if the project is not awarded funds? Should funding not be available the continuation of applications of Magnesium Chloride to control dust, will be required. Additionally, continued congestion in the existing roadway system is likely. 3. Local Commitment a. Explain the origin of your local cash match. (Note: Local government cash match on a dollar for dollar basis is encouraged.) The two counties will provide $1,215,000 in local match split between the two counties. The funds are committed by both counties and an IGA exists for this project. b. Describe any in-kind contributions (type and value). Weld County Public Works is committed to managing the grant and overall construction of this project. c. Does the applicant have sufficient financial capability in reserve funds and/or unused debt capacity that can be used to secure local matching funds?Yes_X_No Explain: d. Has the applicant's tax rate, user charges or fees been reviewed recently to address funding for the proposed project? Weld County and Adams County Road and Bridge Fund dollars to support capital road construction costs. Highway User Trust Fund allocations, industry assessment or contributions, sales or property taxes are also used to fund capital projects. Weld County assesses a$1,000 per oil/gas rig move, and imposes a transportation impact fee on new development in additional to traditional road way funding options. Weld County also imposes a capital expansion fee for new development to offset the cost of future new county facilities. 4. Relationship to Community Goals a. Is the project identified in the applicant's budget, capital improvement plan, equipment replacement plan, comprehensive plan, utility plan or other local or regional strategic management or planning document? Yes, this roadway is identified as a major collector status road in the Weld County Code. As proposed, this roadway is classified with one of the most urbanized design classification standards in the Weld County's roadway system. This road way is identified as a county-line roadway recognized as having unique transportation significant. b. How did the applicant develop project cost estimates? If applicable, has a preliminary architectural/engineering study been completed?Yes_X No What additional design work must still be completed? Explain. For construction, renovation or equipment acquisition projects, does the applicant maintain reserve funds for capital improvement, or replacement of equipment items? Yes, Weld County's Public Works 2007 Operating Budget is 35,983,234 and Adams County's 2007 Public Works Operating Budget is$44,715,000. c. Does the applicant have the technical,financial and managerial capacity to operate and maintain the facilities or services developed through the project for the entire life cycle? Explain. (If applicable,attach the operational/maintenance plan for the project.) Yes, in 2007, Weld County Public Works Department will manage seven major roadway construction projects, and maintain a total of 3,062 miles of county roads. d. Have a number of implementation options been considered? Can the project be accomplished within budget? Are contingencies considered within the project budget? Does the project duplicate service capacity already established? (Has consolidation of services with another provider been considered?) This is the second phase of a two part project. In July of 2007, Energy and Mineral Impact funds in the amount of $940,000.00 were awarded to the first phase of this project. At this time, both Weld and Adams counties had cash matches of approximately 50%. This phase also is supported by an approximate 50% local cash match by both communities. Combining the construction of these two projects together provides a great deal of economy of scale in regard to buying power and general overall efficiencies. e. Has the applicant managed similar projects in the past with success? Yes, for example this is the second phase of a two part project for CR 2 funded by Energy and Mineral Impact dollars. Weld and Adams Counties have a proven history of being able to adequately manage this complexity and type of construction project. E. TABOR COMPLIANCE 1.
