ARCHIVE BOX MISSING AS OF 12/ 19/2017 RESOLUTION RE: APPROVAL OF SPECIAL USE PERMIT FOR AIRPORT, HANGAR AND SKY- DIVING SCHOOL FOR JAMES McDONALD, 11940 WEST INDEPENDENCE AVENUE, GOLDEN, COLORADO 80401 . WHEREAS, the Board of County Commissioners of Weld County , Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners of Weld County, Colorado held a public hearing on the 19th day of November, 1980 at the hour of 2: 00 o 'clock p.m. in the Chambers of the Board of County Commissioners for the purpose of hearing the application of James McDonald, 11940 West Independence Avenue, Golden, Colo- rado 80401 , for a Special Use Permit for an airport, hangar and skydiving school on the following described real estate, to-wit : E2Wz SWa Section 25, Township 2 North, Range 68 West of the 6th P.M. , Weld County, Colorado. WHEREAS, the petitioner was present, and WHEREAS, evidence was presented in support of and in opposi- tion to, the granting of the Special Use Permit for an airport, hangar and skydiving school on the above described real estate, and WHEREAS, Section 3 . 3 (E) (2) of the Weld County Zoning Resolution authorizes such a use in an Agricultural District upon approval by the Board of County Commissioners , and WHEREAS, the Board of County Commissioners of Weld County, Colorado heard all of the testimony and statements of those present, has studied the request of the petitioner and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter, and having been fully informed, is satisfied that the request for a Special Use Permit for an airport, hangar and skydiving school on the hereinabove described real estate, conforms to the purposes of Section 3. 3 (E) (2) of the Weld County Zoning Resolution, and 054-‘) WHEREAS, the Board of County Commissioners feels that Develop- ment Standard #8 should be amended by deleting the words "a four strand barbed wire or" and further feels that a condition #5 be added stating that there shall be no overnight camping on the property, and WHEREAS, the Board of County Commissioners finds that said Special Use Permit for an airport, hangar and skydiving school should be approved for the following reasons : 1 . The proposed use will be compatible with the surrounding area and in harmony with the charac- ter of the neighborhood and existing agricul- tural uses in that no additional farmland will be taken out of agricultural use. 2 . The Board of County Commissioners feels that with compliance with the conditions and de- velopment standards contained in the Special Use Permit, any potential adverse impacts upon the immediate area and future development of the area can be mitigated; and the health, safety and welfare of the inhabitants will be adequately protected. NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado that the application of James McDonald for a Special Use Permit for an airport, hangar and sky- diving school on the hereinabove described tract of land be, and hereby is, granted subject to the following: 1 . The Development Standards contained in the Special Use Permit. 2. No building or electrical permits shall be issued on the Special Use Permit area until the Development Standards for the Special Use Permit have been placed on the Special Use Permit plat and said plat has been de- livered to the Department of Planning Services . 3. The Special Use Permit plat being amended as follows prior to being accepted for recording by the office of the Department of Planning Services : a) Parking areas for the airport use and parachutist use shall be clearly shown and labeled for that use. b) The two accesses (one for the airport and one for the skydiving school) shall be identified on the map. c) Fencing shall be shown on the West line of the property. d) The location of the mobile home on the property. e) All facilities and structures used by the parachute operation shall be labeled . f) Areas of tie downs for the planes shall be identified. g) The location of the water storage tank shall be shown. 4 . The Longmont Fire District shall approve building and fuel storage plans prior to a Certificate of Occupancy being issued. 5. There shall be no overnight camping permitted on the property. BE IT FURTHER RESOLVED by the Board that Development Standard #8 be, and hereby is , amended as stated herein. FOR AN AIRPORT AND JUMP SCHOOL. Today's hearing was continued from October 29, 1930 Mr. Honn read the Planning Commission's favorable recommendation and development standards. Mr. Honn stated that the aiipurt and jump school has been determined to be legal nonconforming use since they were in operation prior to establishment of the zoning resolution. However, any expanison of the operation .does require a special use permit. The item for consideration today is a new hanger facility. Mr. Honn reviewed the past action regarding this property and the new hanger. • James McDonald was present and answered questions regarding his request. Mr. Pete Terry, owner/operator of the parachute operations, was also present and answered questions. The following area residents were present and offered testimony in opposition to this request and the operation in general; Pat & Dave Birge and Chuck Stewart. CHANGE TAPE 80-101 Following presentation of testimony from both sides and discussion by the Board Commissioner Roe made a notion to change development standard $8 to read "a four foot woven welded wire.fence or a four foot chain link fence" in lieu of "a four strand barbed wire fence". Mr."-McDonald asked for a deletion or extension of time beyond the 60 days for construction of this fence as required by the development standards. Mr. Honn stated that this requirement should remain and if the applicant had not completed the work in 60 days he could come to the Board and request an extension at that time. Commissioner Dunbar seconded the motion and it carried unanimously. Commissioner Steinmark made a notion to add development standard ;;5 to read "no over- night camping is allowed". Commissioner Roe seconded the notion and it carried uanimously. Commissioner Roe made a notion to approve the SUP with the conditions and development standards„as amended. Commissioner Steinmark seconded the motion and it carried ' unanimously. Their continuation is based on the fact that the Tri-Area Planning Commission was unable to make a recommendaiton regarding this request at their October 8, 1980 meeting because Mr . McDonald was not present at the review hearing. The Tri-Area Planning Commission had additional questions for Mr. McDonald which could not be answered from the application materials . The Tri-Area Planning Commission requests a second meeting on November 12, 1980to review the proposed special use permit. In light of this information Commission Roe made a motion to continue this hearing until November 19, 1980 at 2 : 00 P.M. and further that all adjacent landowners be notifyed by mail of this continuation. The permitted uses on the hereon described parcel shall be an airport and parachuting operation and shall be limited to the facilities show hereon which are designed to handle a total of 12 planes and a maximum of 25 takeoffs and 25 landings per day and all other uses permitted by right in the Agricultural Zone District of the Weld County Zoning Resolution. 2. The Special Use Permit area shall be maintained in such a manner so as to prevent soil erosion, fugitive dust, and the growth of noxious weeds. 3. Separate toilets shall be installed for each sex at the rate of two for the first 100 persons and one for each additional 100 persons or fraction thereof. (6 CCR 1010-10) Applicant shall be responsible for adhering to the provisions of CRS 25-12-103 regarding noise emissions. All phases of the operation shall comply with all County and State Health Standards regarding regulations pertaining to air quality, water quality, sanitary disposal systems and building. 4. Two accesses for the airport shall be permitted. Said accesses shall be clearly labeled on the property. All accesses shall have the approval of the Weld County Engineering Department. All accesses shall be constructed in accordance with the recommendations and/or requirements of the Weld County Engineering Department. 5. The hangar shall be used strictly for the storage, maintenance, and repair of aircraft. Maintenance and repair of aircraft shall be permitted only between the hours of 8:00 a.m. and 8:00 p.m. for uses which create noise and/or vibration noticeable at or beyond the property line. Commercial repair of aircraft on the property is prohibited. 6. Hours of operation for the aiip.rt and the taking off and landing of planes shall be Liam 8:00 a.m. until 8:00 p.m. or sunset, whichever occurs first. 7. Trash and refuse shall be removed from the property regularly. All trash not removed shall be stored inside a building or an enclosed container to prevent blowing of refuse onto surrounding properties. 8. A four strand barbed wire or a four foot high woven welded wire fence shall be constructed along the entire west side of the property. Except for two access points along the south side of the piuperty, the owner/operator shall maintain a ditch for traffic control. The property owner(s) and/or operator(s) of the airstrip shall be responsible for maintaining the fence in good repair and free from debris. The fence shall be constructed within sixty (60) days of the date of approval by the Weld County Board of County Commissioners. 9. A sign shall be posted on the property containing the limitations as to use, including hours of operation, and number of takeoffs and landings permitted. 10. The permitted uses on the hereon described parcel shall be an aiipurt and parachuting operation and shall be limited to the facilities shown hereon which are designed to handle a total of 12 planes and a maximum of 25 takeoffs and 25 landings per day and all other uses permitted by right in the Agricultural Zone District of the Weld County Zoning Resolution. 2. The Special Use Permit area shall be maintained in such a manner so as to prevent soil erosion, fugitive dust, and the growth of noxious weeds. 3. Separate toilets shall be installed for each sex at the rate of two for the first 100 persons and one for each additional 100 persons or fraction thereof. Hours of operation for the airport and the taking off and landing of planes shall be from 8:00 a.m. until 8:00 p.m. or sunset whichever occurs first. 7. Trash and refuse shall be removed fran the property regularly. All trash not removed shall be stored inside a building or an enclosed container to prevent blowing of refuse onto surrounding properties. r8. A four strand barbed wire or a four foot high woven welded wire fence shall be constructed along the entire west and south sides of the property, except for two access points along the south side of the property. Dear Board Members: My name is James McDonald, I am 45 years old, have lived in Lakewood, Colorado the past 20 years , have been in self service car wash business for 15 years . I started flying in 1963, have a private pilot licence, started flying from the Firestone Air Strip approximately 1966 or 1967 . I liked the freedom and friendly people in the area . I purchased the air strip a year or two later. I became interested in antique flying club activity and now have several Vintage Aircrafts myself, also several friends from Firestone have small planes which are tied down there, As you are probably aware high winds , snow, hot sun and numerous other things play havick with small planes making them a maintenance problem. Last fall several of the club fellows from Firestone and myself decided with the prime' s and inflation the way things are going if we were ever going to be able to afford some protection for our aircraft it should be done now. The new hanger which is partly built is for storage and repair of our planes . We have about 10 local people in the township which are planning to keep their planes in the new building. Car parking is planned on the east side of the building, which could handle at least 100 cars , but there hardly a time when over 3 or 4 of us get together at one time. As far as noise level the closest house to the runway is a good block away, and a take off in approximately 30 seconds and 20 take offs in one day is a big day. (Sanitation) We have water bottle and pop machine and a san-a-let toilet, for what time is spent on the ground . (Lighting) We are thinking of public service yard light system. (Trash) We use 50 gallon barrel in side of the hanger and haul our own trash. (Sky diving) There is a sky diving club at the far south end of the field , they operate on weekends , they start 9 to 10 o'clock and last till 8 evenings with weather and wind permitting. The operation consist of the pilot and 3 helpers to assist in training jumpers how to fall and packing chute and etc. Well as you can see it' s no big operation just a place to gather and have a little enjoyment. Typically the surface layer is a grayish brown sandy loam about 8 inches thick. The subsoil is a brown fine sandy loam about 15 inches thick. The substratum, to a depth of 60 inches, is a sandy .---....,m or loamy sand. Permeability is moderately rapid. Available water capacity is moderate. Effective rooting depth is 60 inches or more. Surface runoff is medium and erosion hazard is low. Where irrigated this soil is suited to the commonly grown crops in the area. However, perennial grasses and alfalfa or close grown crops should be grown at least 50 percent of the time. Close grown crops and pasture can be irrigated with contour ditches and corrugations. Furrows, contour furrows and cross slope furrows will work on row crops. Sprinkler irrigation is also recommended. Minimum tillage and crop residue utilization will help control erosion. Included in this unit arc sore soils with dark surface layers. Some leveled areas wore also included in mapping. Typically the surface layer is grayish brown fine sandy loam about 10 inches thick. The subsoil is yellowish brown to very pale brown fine sandy clay loam about 14 inches thick. The substratum, to a depth of inches, is calcareous fine sandy loan, Permeability is moderate. Available water capacity is moderate, Effective rooting depth is 60 inches or more. Surface runoff is medium and erosion hazard is low. Where irrigated this soil is suited to all crops adapted to this area, (r Gua4 i3) including corn, sugar beets, beans , alfalfa; small grains, potatoes .. and onions. An example of a suitable cropping system is alfalfa 3 to 4 years followed by corn, corn for silage, sugar beets, small grain, beans and back to alfalfa. Some conservation practices such as land leveling, ditch lining and pipelines may ae needed for proper water plication. All methods of irrigation are suitable with furrow irrigation the most common type used. Barnyard manure and commercial fertilizers are needed for top yields along with maintaining good organic matter content. For pheasants, the inclusion of undisturbed nesting cover is vital and should be included in plans for habitat development; this is especially true in areas of intensive agriculture. Rangeland wildlife, exemplified by the pronghorn antelope, can be assisted and encouraged by development of livestock watering facilities, proper live- stock grazing management, and range reseeding where needed. This Vona soil has good potential for urban and recreational develop_ cent. Lawns, shrubs and trees, when once established, will do well. The primary limiting soil feature is the rapid permeability in the substratum_ and the hazard of contamination of ground water from sewage lagoons. As a matter of fact this is the fourth time this issue has been brought before this board. On June 12, Yr. Ia onald presented a request for a non -conforming use permit to build a hangar. The request was denied. On June 26th ,1990 another hearing- was held. for: the _ame request for a non conforming use permit to b-iil.d a hangar. The request was denied. Enclosed is a copy of the letter form the office of the county attorney for Weld County. In that letter you can clearly see that the county ad-r sed 7r. Ye Donald that if the request for the non conforming use permit was denied that he would have to dissassemble the hangar that was already a third of the way constructed. This was never enforced. The date was June 3, 1980. Cn October 10,1980m(approsimately) the county filed for a restraing for _:cjorald to stop construction on the denied hangar and was granted permission to continue building on a hangar or building that he had no rermit for. All this leads me to believe that people can ignore the laws and regulations estahlished in Weld County. That the courts even sanction the misuse of laws. '.'r. ?"c Donald has been allowed to disregard these laws. This is and will be the fourth time we have attempted to inform this board of the seriousness of this entire issue of the airport and parachuting business. It is however much easier for people like those applying for the permit and those others who do not live in this area to continue to ignore these issues. For what is worth I will attempt once again to make the board aware of the entire situation as it relates to this matter. Airport Use Now that the facts are clearly out that the operation that is being applied for is not a little hangar to house antique planes we can look at the matter more seriously. 1) The parachuting business which is operating on the airport in question does operate . Large groups of people are gathered at the airport approximately 50-100 people every weekend some weekdays and holidays . 2) Planes fly in and out of the airport at about twia±y minute intervals . These planes start flying from early in the morning as early as 7 a.m. till later very late at night around 12:00 p.m. Parachutists 1) Parachutists who gather at the airport often make a camping g;-ound'out of the airport inluding staying all night with campfires, loud music and general other activites, which keeps many of the local residents awake until all hours of the night. 2) Parachutists jump directly over many of our homesa and often land on our property. •.y major concern is that I do not want to 4 3 walk out in to my field and find someones body splashed all over my property. Several people have been killed in this area due to parachuting accidents. 3) Parachutists have little concern or respect for property of residents in the area and have torn down our fences on various occasions. Hazardous Conditions 1) A review of the present airstrip will make clear the hazard of the entire situation . :he nnway runs north and south at the south end of the runway is a county road. At the north end of the runway are several residences. ':lhile taking off and landing the pilot barely misses the home and the road which is frequently used. 2) Directly west of the airstrip itself are four large oil and gas storage tanks and two oil wells. These structures are approsimately 25-50 yds from the runway. Any problem in landing or take off could result in a major explosion causing serious injury or death to near by residents. Also there are many pipelines running underground below or near the run way. 3) Also the hangar which is being constructed is withing five feet of my property line and no more than approsimately 100yds of our bedroom window. This means of course machinery , equipment and gasoline storage tanks will be even closer to o:- residence and the oil storage tanks. At this point there exists no barrier between the airport and cur residence. 4) Last but certainly not least is the fact that here are five small chilren all under ten yrs of a^e living in the immediate area. 4 ror the final time I would like to make an appeal to the board of Adjustment to make a responsible decision, to protect the safety and welfare of its residents. The facts are clear that the residents opposing the airport and parachuting school only want to protect our homes and families. These requirements are not intended to pre—empt or limit the authority of any town, city, or county to con— currently regulate group gatherings. 2.0 DEFINITIONS For the purpose of these regulations: _ 2.1 Group patherina area means any place maintained, operated or used for a group gathering, or assemblage, except an established permanent stadium, athletic field, arena, auditorium, coliseum, fairground, or other similar permanent place of assembly. 2.2 Group 'lathering means a group of 25 or more persons assembled together for a meeting, festival, social gathering, or other similar purposes ( sue: THE CODE OF COLORADO REGULATIONS 6 CCR 1010 - 10 t r� Page 2 that can be anticipated to exceed 10 hours. Group gatherings of 25 1 • to 500 persons shall be exempt from meeting provisions of Sections 4.5; 4.6c, d;• 4.7; 6.7; 6.8; 8.2; 11 . 1 ; 11 .2; 11 .3; 11 .4; 11 .5; and 13.1a, b of these standards. 2.3 Health Deoartment means the "Colorado Department of Health' and its authorized inspectors, agents and employees. 2.4 Operator means the person responsible for managing the group gathering area. In the event that no "manager" exists, the owner, or in the event of his unavailability, the lessee of the ground encompassing the group gathering area, shall be deemed to be the "operator" under these regulations. 2.5 Person means an individual , group of individuals, association, partner- ship or corporation, firm, or company. - 2.6 Refuse means all combustible or noncombustible, putrescible or non- putrescible solid or liquid wastes. 2.7 Sanitary facilities means toilet, privies , lavatories, urinals, drinking fountains, and the service building or room provided for installation and use of these units. 2.8 Nuisance: The following shall be defined as nuisances: a. Any public nuisance known at common law or in equity -jurisprudence; b. An attractive nuisance known at common law or in equity jurisprudence; c. Whatever is dangerous to human life or detrimental to health; d. Overcrowding an area or a room with occupants; e. Whatever renders air, food or drink unwholesome or detrimental to the health of human beings. 3.0 ACCESS _ 3. 1 Each group gathering area shall be provided with convenient and safe I access for the ingress and egress of pedrestrian and vehicular traffic. 4.0 GROUNDS 4.1 Each group gathering area shall be well drained and so arranged as to provide sufficient space for people assembled, vehicles, sanitary . facilities, and appurtenant equipment. 4.2 Trees, underbrush, large rocks and other natural features shall be left intact and undisturbed whenever possible. Natural vegetative cover shall be retained, protected and maintained so as to facilitate drainage, prevent erosion and to preserve the scenic attributes. • 4.3 The grounds shall be maintained free from dust wherever possible, accumulations of refuse, and other health and safety hazards con- stituting a nuisance as defined. 4.4 The size.of the group gathering should be limited to the number of persons for which the facilities are designed to accommodate and provisions should be made to prevent people in excess of the maximum permissible number from gaining access to the group gathering area. Service road and parking spaces shall be so located as to permit convenient and safe movement of vehicular and pedestrian traffic and free passage of emergency vehicles. c. Width of service roads shall be not less than the following: one traffic lane - 11 feet; two traffic lanes - 22 feet; parallel parking lane - 7 feet. kJ( d. Adequate parking space shall be provided. Drinking fountains shall be of approved types and common drinking cups shall be prohibited. 7.0 EXCRETA AND LIQUID WASTE DISPOSAL 7. 1 Facilities shall be provided and properly maintained for the disposal or treatment and disposal of excreta and liquid wastes. 7.2 Where a public sewer system is available, all plumbing fixtures and all building sewers shall be connected thereto. If a public sewer system is not available, a private sewage disposal facility meeting the regulations of the Colorado Water Pollution Control Commission shall be installed and connected to all plumbing fixtures and building sewers. Refuse c`ontaine rs shall be readily accessible. 8.3 All refuse shall be collected from the assembly area at least' once each day of the assembly and disposed of at a lawful disposal site. 8.4 The grounds and immediate surrounding properties shall be cleaned of refuse within 24 hours following an assembly. 9.0 VECTOR CONTROL 9.1 a. Insects, rodents and other vermin shall be controlled by proper sanitary practices, extermination, or other safe and effective control methods. b. Where necessary, animal ecto-parasites, and other disease transmitting and nuisance insects shall be controlled. 10.0 SAFETY 10.1 Where an electrical system is installed, it shall be installed and maintained in accordance with provisions of the National Electrical Code.
