TO: Jacqueline Hatch, Planner III COLORADO DATE: June 29, 2007 FROM: Kim Ogle, Planning Manager v,V SUBJECT: KN Wattenberg Transmission, LLC Joe Lorenzo, Applicant Landscape Referral - AmUSR-428 The Department of Planning Services reviewed the above referenced Use by Special Review documentation and drawings and offers the following comments: The Use by Special Review Plat shall be prepared in accordance with Section 23-2-260.D of the Weld County Code. In addition to these requirements, the plat scale shall be 1" = 100 feet, with a detailed Site Plat delineated at a scale of 1" = 50 feet. The Vicinity Map shall be delineated at a scale of 1" = 2000 feet. Further, it is requested that a Legend of Symbols be employed to call out the specific equipment associated with this facility. The text on the submitted plat is difficult to read given the font selected. This application shall be in compliance with Section 23-3-350 and is address in the following • comments, as applicable. Section 23-3-350 addresses the Design Standards applicable to this proposed facility. Per Section 23-3-350.B, the applicant shall delineate all areas associated with outdoor storage. These areas shall be screened from adjacent properties and public rights-of-way. The applicant shall delineate an opaque visual screen on all sides of the property to mitigate the potential negative impact and aesthetic concerns on surrounding properties. Section 23-3-350.F addresses the setback and offsets for structures from the future right-of- way line. For this case, the setback is twenty (20) feet from the County Road and the offset is one foot for every three feet of building height or five feet whichever is greater. Section 23-3-350.G addresses the Required Landscape areas. The USR Plat has not identified areas for landscape treatment. Given the type of facility, Staff will not request a Landscape Plan for this facility. Staff does request that a Screening Plan be submitted for review and approval prior to recording the USR Plat. Section 23-3-350.H addresses the issue of trash collection areas. Areas used for storage or trash collection shall be screened from adjacent public rights-of-way and adjacent properties. These areas shall be designed and used in a manner that will prevent wind or animal scattered trash. This structure shall be delineated on the USR Plat. • Section 23-3-350 I and Section 23-3-350. J addresses the water and sewage disposal for the site. The application materials state water is to be provided by bottled water for consumption and via a commercial well for sanitary and cleaning of equipment purposes. Effluent will be handled via an engineered ISDS system. The applicant shall provide evidence from the State • Engineers Office establishing that the use of the well water is in compliance with the existing well permit. The Department of Public Health and Environment will address additional requirements as warranted. Section 23-3-360 addresses operation standards. The applicant shall address the issue of noise, air quality, water quality, radiation and radioactive material, heat light, and property maintenance. Section 23-3-360.A addresses noise. The Department of Public Health and Environment will regulate the maximum permissible noise levels allowed for this facility. Further, the application materials propose that the hours of operation be twenty-four hours per day, seven days per week each calendar year. Section 23-3-360.F addresses the issue of on-site lighting, including security lighting if applicable, this section.states "any lighting ... shall be designed, located and operated in such a manner as to meet the following standards: sources of light shall be shielded so that beams or rays of light will not shine directly onto adjacent properties...." Staff shall require a Lighting Plan be submitted for review and approval prior to recording the USR Plat. Section 23-3-360.G addresses property maintenance. Should noxious weeds exist on the property or become established as a result of the proposed development the applicant/ landowner shall be responsible for controlling the noxious weeds, pursuant to Chapter 15, Articles I and II of the Weld County Code. • All other operation standards will be addressed by other referral agencies as warranted. The applicant shall delineate all on-site signs. The signs shall adhere to Article IV, Division 2 of the Weld County Code. Further, the location of the signs shall be delineated on the USR Plat. All structures, including signs, on site must obtain the appropriate building permits. The applicant shall enter into an Improvements Agreement according to policy regarding collateral for improvements and post adequate collateral for all transportation and non- transportation components as required. The Department of Public Works will address additional requirements as warranted Should the Improvements Agreement be required for this facility, the agreement and form of collateral shall be reviewed by County Staff and accepted by the Board of County Commissioners prior to recording the USR plat. State Engineer 4209 CR 24.5 Longmont, CO 80504 Re: AMUSR-428—An amended site specific development plan and special review permit for a mineral resource development facility including oil and gas support and services and one radio tower over seventy feet in height Dear Ms. Hatch: This referral does not appear to qualify as a"subdivision" as defined in Section 30-28- 101(10)(a), C.R.S. Therefore, pursuant to the State Engineer's March 4, 2005 memorandum to county planning directors, this office will only perform a cursory review of the referral information and provide comments. The comments do not address the adequacy of the water supply plan for this project or the ability of the water supply plan to satisfy any County regulations or requirements. In addition, the comments provided herein cannot be used to guarantee a viable water supply • plan or infrastructure,the issuance of a well permit, or the physical availability of water. According to the referral information the compressor station will be served by an existing well constructed under well permit no. 115364. The well is permitted for drinking and sanitary facilities only in an individual commercial business and is limited to a maximum pumping rate of 15 gallons per minute and an average daily withdrawal of 800 gallons. According to item 3.5.7 of the executive summary, in addition to the well being used for drinking and sanitary use at the compressor station, it will also be used for the intermittent cleaning of the equipment at the station. Such use for cleaning of the equipment is not allowed under the existing well permit. Therefore, if the well will be used for equipment cleaning the well must be re-permitted for commercial use pursuant to C.R.S. 37-90-137(4). The subject well can be used to serve the compressor station only if the well is operated in accordance with the terms and conditions of the well permit. If the well will be used for any other uses or the quantity of water required will be greater than that allowed by the well permit, a new well permit must be obtained prior to expanding the use. AmUSR-428 1. A building permit shall be obtained prior to the construction of the radio tower. 2. A plan review is required for each building for which a building permit is required. Plans shall bear the wet stamp of a Colorado registered architect or engineer.Two complete sets of plans are required when applying • for each permit. 3. Structures shall conform to the requirements of the various codes adopted at the time of permit application. Currently the following has been adopted by Weld County: 2006 International Building Code; 2006 International Mechanical Code; 2006 International Plumbing Code;2006 International Fuel Gas Code; and the 2005 National Electrical Code and Chapter 29 of the Weld County Code. 4. The radio tower will require an engineered foundation based on a site-specific geotechnical report or an open hole inspection performed by a Colorado registered engineer. Engineered foundations shall be designed by a Colorado registered engineer. 5. The structure will probably be classified as U (Tower occupancy. Fire resistance of walls and openings, construction requirements, maximum building height and allowable areas will be reviewed at the plan review. Setback and offset distances shall be determined by the Zoning Ordinance. 6. Building height shall be measured in accordance with the 2006 International Building Code for the purpose of determining the maximum building size and height for various uses and types of construction and to determine compliance with the Bulk Requirements from Chapter 23 of the Weld County Code. Building height shall be measured in accordance with Chapter 23 of the Weld County Code in order to determine compliance with offset and setback requirements. When measuring buildings to determine offset and setback requirements,buildings are measured to the farthest projection from the building. Property lines shall be clearly identified and all property pins shall be staked prior to the first site inspection. 7. This project falls primarily under the purview of the Use by Special Review Standards, Weld County Code, Chapter 23, Article II, Division 4, Section 23. Our comments and requirements are as follows: COMMENTS AND REQUIREMENTS: WCR 19 is a collector road and requires an 80-foot right-of-way at full build out. There is presently a 60-foot right-of-way. The road is maintained by Weld County. Pursuant to the definition of setback in the Weld County Zoning (23-1-90), the required setback is measured from future right- of-way line. WCR 10 is a local gravel road and requires a 60-foot right-of-way at full build out. There is presently a 60-foot right-of-way. This road is NOT maintained by Weld County. Pursuant to the definition of setback in the Weld County Zoning (23-1-90), the required setback is from the future right-of-way. The site is currently existing with the only addition requested being the proposed tower. The site currently has 3 access points off of public roads. The site is fenced with gates on all access points. The existing onsite cads are all-weather material with good circulation. Additional information is requested on the plat/site plan. A north arrow for the detailed site plan is requested along with adjacent road information, existing right-of-way, and future dedicated right-of-way. A new site plan is requested prior to final approval. Additional parking near/next to the tower with the ability to accommodate pickup truck and utility trucks should be added to avoid interrupting the ability of traffic to enter or circulate around the site. Tower facilities will comply with all applicable rules and regulations. Access: Existing access along WCR's 19 & 10 will be utilized. No new access points are proposed. Storm Water Drainage: The historical flow patterns and run-off amounts will be maintained on site in such a manner that it will reasonably preserve the natural character of the area and prevent property damage of the type generally attributed to run-off rate and velocity increases, diversions, concentration and/or unplanned ponding of storm run-off. The plan shall include at a minimum, the following: 1) A list of wastes which are expected to be generated on site (this should include expected volumes and types of waste generated). 2) A list of the type and volume of chemicals expected to be stored on site. 3) The waste handler and facility where the waste will be disposed (including the facility name, address, and phone number). • • We recommend that the following requirements be incorporated into the permit as conditions that must be met prior to operation: 1. A stormwater discharge permit may be required for a development/redevelopment/construction site where a contiguous or non- contiguous land disturbance is greater than or equal to one acre in area. The applicant shall inquire with the Water Quality Control Division (WQCD) of the Colorado Department of Public Health and Environment at www.cdphe.state.co.us/wq/PermitsUnit if they are required to obtain a stormwater discharge permit. Alternately, the applicant can provide evidence from WQCD that they are not subject to these requirements. We recommend that the following requirements be incorporated into the permit as development standards: 1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. • 2. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended. 3. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, fugitive particulate emissions, blowing debris, and other potential nuisance conditions. 4. The applicant shall operate in accordance with the approved "waste handling plan". 5. Fugitive dust and fugitive particulate emissions shall be controlled on this site. The facility shall be operated in accordance with the approved dust abatement plan at all times. 6. The operation shall comply with all applicable State noise statutes and/or regulations. 7. Adequate handwashing and toilet facilities shall be provided for employees and visitors of the facility. • 2 • 8. A permanent, adequate water supply shall be provided for drinking and sanitary purposes. (Well permit # 115364 and bottled water) 9. Sewage disposal for the facility shall be by septic system. Any septic system located on the property must comply with all provisions of the Weld County Code, pertaining to Individual Sewage Disposal Systems. 10.All potentially hazardous chemicals must be stored and handled in a safe manner in accordance with product labeling and in a manner that minimizes the release of hazardous air pollutants (HAP's) and volatile organic compounds (VOC's). 11. If applicable, the applicant shall obtain a stormwater discharge permit from the Colorado Department of Public Health & Environment, Water Quality Control Division. 12.The operation shall comply with all applicable rules and regulations of the State and Federal agencies and the Weld County Code. • 3 Hello
