Dear Ms. Traxler:
We request you amend the Page Special Use Permit Application as per
the enclosed, signed amendment. The Erie Planning Commission agreed to
to recommend approval of this Special Use Permit if Mr. Page would amend
his application as indicated.
Mr. Page expressed his willingness to do so to the Commission at
its May 1, 1980 meeting and affirms his intent by submitting this
amendment to you.
Thank you for your patience in this matter. Mr. Page and _I ap—
preciate you allowing us the time we requested to work out this agree—
ment with the town of Erie. I have attended the last four meetings
of the Commission, met with them in two informal work sessions and
viewed Mr. Page's establishment with members of the Commission and
Gayle Packard—Seeburger. I believe the process has led to an accom—
odation that is to the benefit of those involved.
I request that you refer this to the Erie Planning Commission
in time for consideration at its May 15, 1980, meeting; this would
allow us to remain on the agenda for your May 20, 1980, meeting
in Greeley.

Attachment to Paul E. F, Peggy Page Special Use Permit Application.
(e) The proposed use is primarily an aircraft salvage, rebuilding, and
storage operation. Items are sold to business and the retail trade.
Wrecked and damaged aircraft are brought to the site; some are dis-
mantled (instruments, engines, flight controls etc. and other use-
able parts removed and stored) and then cut up for scrap. Some are
rebuilt and some stored awaiting final disposition. Heavy equipment
- ( bulldozers, graders etc.) and damaged mobile homes will also be
repaired and stored awaiting disposition.
The effect on air, water, glare, and noise pollution will be
slight. The yard is fenced and most active operation are carried
out inside metal and concrete buildings, which minimize fire hazard.
Normal operation will only require approximately 3-5 workers
during daylight hours and the effect on traffic is minimal. There
are some drive-in customers but most business is done by mail order.
(f) Sewage is disposed of in a County approved septic system.
(g) Water requirements are small (toilet and sink) and are supplied by
a well and storage lake. (State tested--see attachment)
(h) The only road is an existing gravel driveway located on land of the
applicants.

Attn; Vickie Traxler --v
Assistant Zoning Administrator.
Ms. Trailer;
Regarding the special use permit for the Aircraft Storage and Salvage Yard,
owned and operated by Paul and Peggy Page, northeast of the town of Erie, Colorado,
in the Dacono Area Fire Protection District, we enclose the following information.
I have made an on sight investigation of the premises and find no particular
fire dangers or fire hazards above the normal for any salvage yard.
We found access ways from three seperat-e points, and the on sight water supply
is far excess of any demands we could have need for. For this water supply we will
utilize the year around storage lake on the premises, which has a 6 inch pipe down
to the yard area. Mr Page has agreed to put a 6 inch Tee on this pipe and we will
make up a pumper fitting for one side of the tee, to hook directly to our pumpers.
This pipe is gravity filled and we can pump any needed amount of water from it at
no problem. Mr Page will also be installing a pump house at this location in the
future which will only add to the ability of our usage of the water supply.
I find the storage areas to be satisfactorily seperated with room to prevent
fire spread of any major proportions.
Fuel, oil and gasoline storage is minimal on sight.
I therefore wish to advise your office that the Dacono Area Fire Protection
District has no objections to this issuance of permit for the usage set forth.

Special Use Review
Dear Vickie:
We have reviewed the above referral and offer the following:
1 . The soils are from the USDA- Soil Conservation Survey and
are an accurate representation of the same. The X30-B
soils would be considered prime, but due to their relative
location to Coal Creek and the 87M-DE soils which are not
prime, we would have no objection to their intended use.
2. While a portion of the land falls within the 100 year flood
plain, the project area is above the flood plain.
3. There are two major irrigation systems that traverse the
property, but neither should be adversely affected by the
special use intended.
4. Since the use seems to be compatible with existing uses , we
find no real conflict with our interests .
Sincerely,
Fred Hartnagle
President

Dear Ms. Traxler:
The Erie Planning Commission met March 6, 1980 and at that time
reviewed the Special Use request submitted by a Mr. and Mrs.
Page . This application, if approved would permit the expansion
of their present non—conforming use — an airplane storage and
salvage yard .
The Planning Commission objects to the granting of this request .
First, this request , if granted , would not only sanction an
existing non—conforming use , but would permit it to expand . The
Town of Erie believes that this, in general, is a precedenL which
should not be established. From Erie ' s perspective , the permitted
expansion of this activity would indicate County approval of its
appropiateness for the area. If this is the case , and Erie con-
tends it is not, rezoning, not a request for a Special use permit ,
should be iniated.
More specifically, Erie objects to the propsed expansion of this
activity on the following grounds:
1 . Incompatibility with existing land uses patterns. The
land in question is adjacent to an area zoned and devel-
oped for residential land uses. The industrial use is
incompatible with the residential character of the area.
Any expansion of this activity will excrbate this pro-
blem.
2. Insufficient justification. The following background
information is relevant as it pertains to the questions
of whether this activity should be permitted to expand:
a. This activity was iniatially located in Erie on
commercially zoned land. An industrial use, it was
non-conforming.
b. In May, 1977, Mr. and Mrs. Page requested that Erie
annex to the Town this same parcel of land. The
Board of Trustees, dissatisfied with Mr. Page ' s manage-
ment of this activity in Erie , directed Mr. Page to
return to the Board when his current business was
brought into compliance with city ordinances. Mr.
Page did not return.
X
Page 2
Weld County
Department of Planning Services
c. Between the years of 1975 and 1978, the property
located at "105 Cheesman and used for storage was
in violation of Town ordinances . The land was
owned initially by Yr. Jack Clark (with whom Mr.
Page was affiliated) and later by Mr. Page. Records
of citations prior to 1976 were not -maintained. How—
ever, the Erie Chief of Police believes he issued
approximately three citations during the years 1974
and 1975. Records show that in 1976 , Mr. Clark was
issued a citation for junk. This was subsequently
dismissed when it was revealed that Fir. Page owned
the property. She. next violation occurred May 23 , 1977.
This was not pursued since Mr. Page removed all his
personal property from Erie and placed it in Weld
County.
d. In 1977, Mr. Page moved the location of his aircraft
storage and salvage yard from Erie to Weld County.
The land was and is zoned for agricultural use .
Erie is not aware of any attempt on the applicant ' s
part to obtain the appropriate zoning. Taking the
above circumstances into consideration, the Erie
Planning Commission sees no reason to grant this
request . No hardship, other than that brought about
by the applicants earlier actions, will result if this
request is denied. Conversely, any additional expan-
sion will further adversely affect the Town of Erie .
3 . The Comprehensive Plan. Erie adopted their Comprehensive
Plan December 6, 1979. The area in question is outside
but adjacent to our urban service area, as well as ad-
jacent to Town boundaries. Lands outside the urban ser-
vice area are designated as agricultural. Goals and
policies specifically addressing this issue are as follows:
a. Outside the urban service area, "the Town will not
support urban development.
b. "Take steps to encourage Boulder and Weld Counties to
continue and strengthen their policies aimed at not
allowing urban type development to occur outside of
unincorporated areas and preserving agricultural lands.
c . "In order to preserve agricultural lands, minimize
governmental service costs and reduce sprawl, both
Boulder and Weld Counties are -encouraged to continue
enforcing and strengthening their policies aimed at
limiting development in the fringe areas to very large
lot residential development.
In addition to the above , the proposed use could potentially
weaken and are in conflict with the following parts of the
Comprehensive Plan. Specifically:
K
Page 3
Weld County
Department of Planning Services
a. "Industry is to be located south of the new community
business center and south of the existing Town". . .
b. "Assure that residential areas within the community are
desirable places to live"
1 . "Residential neighborhoods should be protected from
any land use activity -involving an excessive level of
noise , pollution or traffice volume ."
2. "Efforts should be made to maintain and conserve exist-
ing desirable residential areas and housing units in
Erie . "
c . "Encourage new development to be undertaken in such a way
that it is financially, socially, and visually beneficial
to the Erie community."
1 . "Take steps to encourage Boulder and Weld Counties to
continue and strengthen their policies aimed at not
allowing urban type development to occur outside of
unincorporated areas and preserving agricultural lands. "
2. "All future zoning approvals should be in conformance
with the Town's adopted land use plan and policies."
On the basis of the proposal' s incompatibility with the Erie
Comprehensive Plan and on the basis of the stated intent of the
Weld County Comp Plan to co-operate and assist local municipalities
in implementing land use plans, we find this proposal unaccepta-
ble.
4 Resource Development. Large coal reserves underlay this
property; the mineral rights are not owned by Mr. Page .
Last fall Impel submitted an application to mine this
and the surrounding property. The application was subse-
quently withdrawn so that it could be made more complete.
It is our understanding that it will be resubmitted this
spring. Erie envisions a potential conflict in approving
further developemt of this land. Erie believes that the
proposed change will affect subsurface as well as surface
owners and, as such, requests that the owners of the miner-
al rights be notified and that this aspect of the request
be thoroughly investigated.
Erie thanks Weld County for the opportunity to review this request.
The Town of Erie , for the reasons cited above, believe that this
request is inappropiate. Therefore , Erie urges the denial of
the request to grant a Special Use Permit for an aircraft stor-
age and salvage yard.
Sincerely, r--7)

Special Use Permit
Case No. SUP-413:80:4
Dear Ms. Traxler:
I represent the Erie Coal Creek Ditch and Reservoir Company. Mr.
Kenneth E. Koch, Secretary of the Erie Coal Creek Ditch and Reservoir
Company, has made available to me your referral letter in connection
with the above entitled matter which is now pending concerning the
request for a special use permit for an aircraft storage and salvage
yard.
This letter shall serve to advise you that the Erie Coal Creek Ditch
lies adjacent to the property owned by the applicants, Mr. and Mrs. Paul
E. Page.
This letter shall further serve to advise you on behalf of the Erie Coal
Creek Ditch and Reservoir Company that they have no specific objection
to the granting of the special use permit requested by Mr. and Mrs.
Page, but there are a number of matters which the ditch company believes
need to be considered as a part of the granting of the special use
permit.
The Erie Coal Creek Ditch and Reservoir Company, a Mutual Ditch Company,
must insist, of course, that neither the right of way of the ditch
system nor the ditchbank or any roads utilized by the ditch company
along its right of way be utilized in any manner as an access road to
the business to be established by the applicants, Mr. and Mrs. Paul E.
Page. In connection with this matter, the ditch company desires to make
it clear that the ditch right of way, including the roadway utilized by
the ditch company in the operation of its system must remain clear and
unobstructed.
The ditch company also indicates that it must insist that proper fencing
be constructed to contain materials placed within the salvage yard in
Ms. Vickie Traxler

order to prevent any of these salvage materials from blowing into and
upon the ditch and the ditch right of way.
The ditch company also wishes to insist that all fencing to be constructed
and parking of 'vehicles shall not be allowed at a distance less than 20
feet from the right of way area of the ditchbank.
The ditch company has also requested that the applicants be notified
that permission must be obtained from the ditch company in connection
with any crossings or utility construction or any other activities which
will involve the entry upon the ditch company's right of way.
I am also returning herewith a copy of the map prepared by Freese
Engineering provided to me by Mr. Tom Hohn in connection with this
matter.

Re: Flood -Hazard Evaluation for the Page Aircraft Storage
and Salvage Yard Special Use Permit (Sup-413 :80 :4)
Dear Ms. Traxler :
We offer the following findings and comments for your
consideration on this application:
Project Location:
County - Weld
Community - Adjacent to the northeast corner of the
Town of Erie
USGS Quad Map - Erie, Colorado
Section, Township, Range - Parts of Sections 7 and 8,
T1N, R68W, 6th PM.
Potential Sources of Flooding:
Coal Creek and local drainage area.
Technical Information Available for Review:
1_. "Flood Hazard Analyses, Coal Creek and Rock Creek,
Boulder and Weld Counties, Colorado, " prepared by
the U. S. Soil Conservation Service in October,
1976.
2. "Flood Insurance Study, Town of Erie, Colorado,
Boulder and Weld Counties, " prepared by Gingery
Associates, Inc. , in April, 1978, under a Federal
Insurance Administration contract. Please note
that this study is in complete agreement with the
SCS report (ref. 1) .
Av
Ms . Vickie Traxler
February 27 , 1980
Page two
Findings:
1. Based on the SCS report, the 100-year flood outline
is correctly identified on the permit.
2. Due to the complexisty of the flooding problem at Erie,
the area is presently being studied in greater detail,
with the goal of providing a feasible solution to the
flooding problem, which will provide the maximum
benefits.
Recommendations :
A. No building, storage, or other activity within the
100-year flood limits presently defined in the appli-
cation should be allowed. This means moving to the
east the proposed building site and storage area from
the present location outlined in the application.
B. It may be beneficial to the applicant to re-evaluate
this permit following completion of the floodplain and
flood control study presently in progress for the area
in question.
Should you have any questions, we will be happy to respond.
Very truly yours,

Dear Ms. Traxler RE: PAGE SPECIAL
USE PERMIT,
WELD COUNTY
We have reviewed the plat for the Page special use permit. The soils in
this area have a low to moderate shrink-swell potential . We suggest that
the fill be properly placed and compacted and that building excavations
be examined by qualified personnel to insure proper foundation design.
We also recommend that riprap be placed at the toe of the fill to prevent
erosion from Coal Creek.
If the above recommendations are followed during construction, we have no
objection to the approval of this application.

STORY OF THE PAST . . . KEY TO THE FUTURE

To Vickie Traxler Date Fehr-nary 25. 1980
COLORADO From Drew Srhel ti nga, Fpgi neeri ng Manager
subject: Paul and Pergy Page S.U.P. . Aircraft Salvage Yard
Portions of this application are effected by the Coal Crock Flood Plain. There is a
note on the drawing stated, "Base Flood Elevation 100 Year Water Surface Evelvation
5010.00."
The Flood Hazard Analysis study prepared by the U.S. Department of Agriculture Soil
Conservation Service, dated October, 1976, indicates a 100 year water surface varies
from 5016.0 at Chccsnan Street to 5011.3 at Weld County Road 111. A new study is
presently underway and should be published soon. Indications are the new water surface
elevations will be somewhat lower but a large portion of the area will still be
affected including existing storage areas and buildings.
Also the existing access road is built through Coal Crcck over culverts that are far
to small to handle flow in the existing channel. This blockage of Coal Crock is un-
desireable. During a period of high water, I am sure the crossing will washout leaving
the operations area without access.
I would proposed the following restrictions be considered:
1. No storage or buildings be allowed within the 100 year flood plain.
2. A Flood Hazard Develcpr ent Permit be acquired.
3. A new access be located from Weld County Road 11 which would be out of
the Flood Plain and the existing access be removed and the channel be
restored.

Dear Sirs;
My feeling is that my interests as a citizen and land owner in the
town of Erie, can be best protected by governmental agencies of the town,
rather than of the county. I would prefer, therefore that all developments
of this type be allowed only within the town boundaries and under the
town jurisdiction. I urge you todeny this request.
Many individuals in this town are trying to upgrade their own property
and the town. We would certainly hope that any decision—making—body would
help us in this endeavour by tracing this town as if it was as classy a
community as any.
It is not that a special use of this type can not be accomplished without
being totally reprehensible. It is that such a thing must have the provisions
and controls to insure the neighboring interests— IF it is allowed at all.
The recent county decision to allow a mamoth landfill operation to locate
nearby has me wondering—who on what board, is treating the place as if he
lives here? I suggest you allow the town of -Erie a say in this one.

Gentlemen:
With reference to the request by Paul and Peggy Page, for a
special use permit for an aircraft storage and salvage yard,
which is proposed to be located adjacent to the northeast
cornErbf the Town of Erie, on property described as Pt. Sec-
tion 7 and Pt. Section 18, T1N, R-68W, we wish to state ob-
jections.
As a property owner in the area of the proposed salvage
yard as described above, we object to the issuance of such
a permit.
Our objections are made based on the following.
l} Would remove additional land from agricultural use
2} Would cause an eyesore
3} Would cause damage to Existing roads, due totransport-
ing heavy loads of materials in and out of the area
41- Would result in noise pollution, and be a fire hazard
if any burning would be allowed, would also cause smoke
pollution. Would harbor rodent infestion.
5} Most important, a salvage yard would de-value all pro-
perty in the area.
We, therefore, request this permit be denied. Your under-
standing in this matter will be greatly appreciated.
Sincerely,
r _
