WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rul-e Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners of Weld County, Colorado -held a public rearing on the 2nd day of July, 1980 at the hour of 2 : 00 o' clock p.m. in the Chambers of the Board of County Commissioners for the purpose of hearing the application of -Paul and Peggy Page, P. 0. WHEREAS, the petitioners were present, and WHEREAS, evidence was presented in support of the granting of the Special Use Permit for aircraft storage and salvage on the abovedescribed real estate, and WHEREAS, Section 3.3 (E) (2) of the Weld County Zoning Reso- lution authorizes such a use in an Agricultural District upon approval by the Board of County Commissioners , and WHEREAS, the Board of County Commissioners of Weld County, Colorado heard all of the testimony and statements of those present, has studied the request of the petitioners and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter, and having been fully informed, is satisfied that the request for a Special Use Permit for aircraft storage and salvage on the hereinabove described real estate, conforms to the purposes of Section 3. 3 (E) (2) of the Weld County Zoning Resolution. NOW, THEREFORE, BE LT RESOLVED by the Board of County Com- missioners of Weld County, Colorado that the application of the petitioners for a Special Use Permit for aircraft storage and salvage on the hereinabove described tract of land be , and here- by is, granted subject to the Development Standards contained in the Special Use Permit. BE IT FURTHER RESOLVED by the Board that the reasons for approval contained in the Planning Commission recommendations dated May 20, 1980 be, and hereby are, adopted as the findings of fact of the Board of County Commissioners in this matter. The uses permitted on the hereon described parcel shall be an aircraft, heavy equipment and mobile home salvage and storage yard and structures as shown hereon and all uses permitted by right in the Agricultural Zone District as listed in the Weld County Zoning Resolution. 2. The Special Use Permit area shall be maintained in such a manner so as to prevent soil erosion, fugitive dust, and the growth of noxious weeds. The appearance of the facility shall be maintained in a neat and orderly condition through periodic painting and maintenance. 3. All phases of the operation shall comply with all County and State Health Standards and Regulations pertaining to air quality, water quality, noise emission, and sanitary disposal systems. 4. All accesses shall have the at Weld County Engineering Department. All accesses shall be constructed oinl of accordance with the recommendations and/or requirements of the Weld County Engineering Department. 5. All refuse shall be disposed of at a designated landfill. Burning trash is prohibited. 6. Fill material to elevate the property above the boundary of the 100 year flood plain shall be stabilized to prevent erosion into Coal Creek in compliance with the Weld County Flood Hazard Overlay District Regulations. 7. No bridge or crossing shall be constructed across the Erie Coal Creek Ditch and Reservoir right-of-way on the hereon described property. No fencing or structure shall obstruct the ditch right-of-way in order that the ditch may be cleaned and maintained in accordance with the right-of-way agreements. 8. The west perimeter of the storage yard and building shall be screened by means of appropriate landscaping. Said landscaping being a row of trees and shrubs consisting of a mixture of lombardi poplar, juniper, spruce and cottonwood planted six feet apart. These trees shall be watered and maintained and dead ones replaced for two years. Trees in the area of the existing building will be planted within six months of approval of this Special Use Permit and trees in the area of the north end of the storage yard and proposed building shall be planted within six months of final grading. 9. The present office trailer will be removed within 30 days of completion of proposed new office addition. 10. All salvage storage will be east of screening and north of the present building. No storage or structure shall be within the 100 year flood plain boundaries unless said storage or structure meets the requirements of the Weld County Flood Hazard Overlay District Regulations. 11. The culvert across Coal Creek shall be removed. The owners may replace said culvert with a bridge which shall meet with the approval of the Weld County Engineering Department and the town of Erie. The bridge shall either be a low water crossing or shall be designed to pass the 100 year flood flow of 12,080 cfs. DEVELOPMENT STANDARDS SUP-413:80:3 Paul and Peggy Page Page 2 12. The Special Use Permit shall be limited to the plans shown hereon and governed by the Development Standards stated above and all applicable Weld County Re- gulations. Any material deviations from the plans and/or Development Standards as shown or stated above shall require the approval of an amendment to the Special Use Permit by the Planning Commission and the Board of County Commissioners before such changes from the plans and/or Development Standards shall be permitted. Any other changes from the plans and/or Development Standards shall be filed in the office of the Department of Planning Services. 13. The property owner and/or operator of this operation shall be responsible for complying with all of the above stated Development Standards. Noncompliance with any of the above stated Development Standards may be reason for revocation of the Special Use Permit by the Board of County Commissioners. The uses permitted on the hereon described parcel shall be an aircraft, heavy equipment and mobile home salvage and storage yard and structures as shown hereon and all uses permitted by right in the Agricultural Zone District as listed in the Weld County Zoning Resolution. 2. The Special Use Permit area shall be maintained in such a manner so as to prevent soil erosion, fugitive dust, and the growth of noxious weeds. The appearance of the facility shall be maintained in a neat and orderly condition through periodic painting and maintenance. 3. All phases of the operation shall comply with all County and State Health Standards and Regulations pertaining to air quality, water quality, noise emission, and sanitary disposal systems. 4. All accesses shall have the approval of the Weld County Engineering Department. All accesses shall be constructed in accordance with the recommendations and/or requirements of the Weld County Engineering Department. 5. All refuse shall be disposed of at a designated landfill. Burning trash is prohibited. 6. Fill material to elevate the property above the boundary of the 100 year flood plain shall be stabilized to prevent erosion into Coal Creek in compliance with the Weld County Flood Hazard Overlay District Regulations. 7. No bridge or crossing shall be constructed across the Erie Coal Creek Ditch and Reservoir right-of-way on the hereon described property. No fencing or structure shall obstruct the ditch right-of-way in order that the ditch may be cleaned and maintained in accordance with the right-of-way agreements. 8. The west perimeter of the storage yard and building shall be screened by means of appropriate landscaping. Said landscaping being a row of trees and shrubs consisting of a mixture of lombardi poplar, juniper, spruce and cottonwood planted six feet apart. These trees shall be watered and maintained and dead ones replaced for two years. Trees in the area of the existing building will be planted within six months of approval of this Special Use Permit and trees in the area of the north end of the storage yard and proposed building shall be planted within six months of final grading. 9. The present office trailer will be removed within 30 days of completion of proposed new office addition. 10. All salvage storage will be east of screening and north of the present building. No storage or structure shall be within the 100 year flood plain boundaries unless said storage or structure meets the requirements of the Weld County Flood Hazard Overlay District Regulations. 11. The culvert across Coal Creek shall be removed. The owners may replace said culvert with a bridge which shall meet with the approval of the Weld County Engineering Department and the town of Erie. The bridge shall wither be a low water crossing or shall be designed to pass the 100 year flood flow of 12,080 cfs. DEVELOPMENT STANDARDS SUP-413:80:3 Paul and Peggy Page Page 2 12. The Special Use Permit shall be limited to the plans shown hereon and governed by the Development Standards stated above and all applicable Weld County Re- gulations. Any material deviations from the plans and/or Development Standards as shown or stated above shall require the approval of an amendment to the Special Use Permit by the Planning Commission and the Board of County Commissioners before such changes from the plans and/or Development Standards shall be permitted. Any other changes from the plans and/or Development Standards shall be filed in the office of the Department of Planning Services. 13. The property owner and/or operator of this operation shall be responsible for complying with all of the above stated Development Standards. Noncompliance with any of the above stated Development Standards may be reason for revocation of the Special Use Permit by the Board of County Commissioners. F, Peggy Page Special Use Permit Application. (e) The proposed use is primarily an aircraft salvage, rebuilding, and storage operation. Items are sold to business and the retail trade. Wrecked and damaged aircraft are brought to the site; some are dis- mantled (instruments, engines, flight controls etc. and other use- able parts removed and stored) and then cut up for scrap. Some are rebuilt and some stored awaiting final disposition. Heavy equipment - ( bulldozers, graders etc.) and damaged mobile homes will also be repaired and stored awaiting disposition. The effect on air, water, glare, and noise pollution will be slight. The yard is fenced and most active operation are carried out inside metal and concrete buildings, which minimize fire hazard. Normal operation will only require approximately 3-5 workers during daylight hours and the effect on traffic is minimal. There are some drive-in customers but most business is done by mail order. (f) Sewage is disposed of in a County approved septic system. (g) Water requirements are small (toilet and sink) and are supplied by a well and storage lake. Ms. Trailer; Regarding the special use permit for the Aircraft Storage and Salvage Yard, owned and operated by Paul and Peggy Page, northeast of the town of Erie, Colorado, in the Dacono Area Fire Protection District, we enclose the following information. I have made an on sight investigation of the premises and find no particular fire dangers or fire hazards above the normal for any salvage yard. We found access ways from three seperat-e points, and the on sight water supply is far excess of any demands we could have need for. For this water supply we will utilize the year around storage lake on the premises, which has a 6 inch pipe down to the yard area. Mr Page has agreed to put a 6 inch Tee on this pipe and we will make up a pumper fitting for one side of the tee, to hook directly to our pumpers. This pipe is gravity filled and we can pump any needed amount of water from it at no problem. Mr Page will also be installing a pump house at this location in the future which will only add to the ability of our usage of the water supply. I find the storage areas to be satisfactorily seperated with room to prevent fire spread of any major proportions. Fuel, oil and gasoline storage is minimal on sight. This application, if approved would permit the expansion of their present non—conforming use — an airplane storage and salvage yard . The Planning Commission objects to the granting of this request . First, this request , if granted , would not only sanction an existing non—conforming use , but would permit it to expand . The Town of Erie believes that this, in general, is a precedenL which should not be established. From Erie ' s perspective , the permitted expansion of this activity would indicate County approval of its appropiateness for the area. If this is the case , and Erie con- tends it is not, rezoning, not a request for a Special use permit , should be iniated. More specifically, Erie objects to the propsed expansion of this activity on the following grounds: 1 . Incompatibility with existing land uses patterns. The land in question is adjacent to an area zoned and devel- oped for residential land uses. The industrial use is incompatible with the residential character of the area. Any expansion of this activity will excrbate this pro- blem. 2. Insufficient justification. The following background information is relevant as it pertains to the questions of whether this activity should be permitted to expand: a. This activity was iniatially located in Erie on commercially zoned land. An industrial use, it was non-conforming. b. In May, 1977, Mr. and Mrs. Page requested that Erie annex to the Town this same parcel of land. The Board of Trustees, dissatisfied with Mr. Page ' s manage- ment of this activity in Erie , directed Mr. Page to return to the Board when his current business was brought into compliance with city ordinances. Mr. Page did not return. X Page 2 Weld County Department of Planning Services c. Between the years of 1975 and 1978, the property located at "105 Cheesman and used for storage was in violation of Town ordinances . The land was owned initially by Yr. Jack Clark (with whom Mr. Page was affiliated) and later by Mr. Page. Records of citations prior to 1976 were not -maintained. How— ever, the Erie Chief of Police believes he issued approximately three citations during the years 1974 and 1975. Records show that in 1976 , Mr. Clark was issued a citation for junk. This was subsequently dismissed when it was revealed that Fir. Page owned the property. She. next violation occurred May 23 , 1977. This was not pursued since Mr. Page removed all his personal property from Erie and placed it in Weld County. d. In 1977, Mr. Page moved the location of his aircraft storage and salvage yard from Erie to Weld County. The land was and is zoned for agricultural use . Erie is not aware of any attempt on the applicant ' s part to obtain the appropriate zoning. Taking the above circumstances into consideration, the Erie Planning Commission sees no reason to grant this request . No hardship, other than that brought about by the applicants earlier actions, will result if this request is denied. Conversely, any additional expan- sion will further adversely affect the Town of Erie . 3 . The Comprehensive Plan. Erie adopted their Comprehensive Plan December 6, 1979. The area in question is outside but adjacent to our urban service area, as well as ad- jacent to Town boundaries. Lands outside the urban ser- vice area are designated as agricultural. Goals and policies specifically addressing this issue are as follows: a. Outside the urban service area, "the Town will not support urban development. b. "Take steps to encourage Boulder and Weld Counties to continue and strengthen their policies aimed at not allowing urban type development to occur outside of unincorporated areas and preserving agricultural lands. c . "In order to preserve agricultural lands, minimize governmental service costs and reduce sprawl, both Boulder and Weld Counties are -encouraged to continue enforcing and strengthening their policies aimed at limiting development in the fringe areas to very large lot residential development. In addition to the above , the proposed use could potentially weaken and are in conflict with the following parts of the Comprehensive Plan. Specifically: K Page 3 Weld County Department of Planning Services a. "Industry is to be located south of the new community business center and south of the existing Town". . . b. "Assure that residential areas within the community are desirable places to live" 1 . "Residential neighborhoods should be protected from any land use activity -involving an excessive level of noise , pollution or traffice volume ." 2. "Efforts should be made to maintain and conserve exist- ing desirable residential areas and housing units in Erie . " c . "Encourage new development to be undertaken in such a way that it is financially, socially, and visually beneficial to the Erie community." 1 . "Take steps to encourage Boulder and Weld Counties to continue and strengthen their policies aimed at not allowing urban type development to occur outside of unincorporated areas and preserving agricultural lands. " 2. "All future zoning approvals should be in conformance with the Town's adopted land use plan and policies." On the basis of the proposal' s incompatibility with the Erie Comprehensive Plan and on the basis of the stated intent of the Weld County Comp Plan to co-operate and assist local municipalities in implementing land use plans, we find this proposal unaccepta- ble. 4� Resource Development. Large coal reserves underlay this property; the mineral rights are not owned by Mr. Page . Last fall Impel submitted an application to mine this and the surrounding property. The application was subse- quently withdrawn so that it could be made more complete. It is our understanding that it will be resubmitted this spring. Erie envisions a potential conflict in approving further developemt of this land. Erie believes that the proposed change will affect subsurface as well as surface owners and, as such, requests that the owners of the miner- al rights be notified and that this aspect of the request be thoroughly investigated. Erie thanks Weld County for the opportunity to review this request. The Town of Erie , for the reasons cited above, believe that this request is inappropiate. Aircraft Salvage Yard Portions of this application are effected by the Coal Crock Flood Plain. There is a note on the drawing stated, "Base Flood Elevation 100 Year Water Surface Evelvation 5010.00." The Flood Hazard Analysis study prepared by the U.S. Department of Agriculture Soil Conservation Service, dated October, 1976, indicates a 100 year water surface varies from 5016.0 at Chccsnan Street to 5011.3 at Weld County Road 111. A new study is presently underway and should be published soon. Indications are the new water surface elevations will be somewhat lower but a large portion of the area will still be affected including existing storage areas and buildings. Also the existing access road is built through Coal Crcck over culverts that are far to small to handle flow in the existing channel. This blockage of Coal Crock is un- desireable. During a period of high water, I am sure the crossing will washout leaving the operations area without access. I would proposed the following restrictions be considered: 1. No storage or buildings be allowed within the 100 year flood plain. 2. A Flood Hazard Develcpr ent Permit be acquired. 3.
