RE: APPROVAL OF LOT SIZE VARIANCE NO. 118 - GEORGE AND CHARLENE
SANDLIN.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of Count" Commissioners has determined
at a public meeting held on the 19th day of November, 1980 in
the Chambers of the Board of County Commissioners of Weld County,
Colorado, that a certain tract of land is owned by George and
Charlene Sandlin, which land is more particularly described as
follows :
The Northwest Quarter of the Northeast
Quarter of Section 29 , Township 1 North,
Range 66 West of the 6th P.M. , Weld
County, Colorado.
WHEREAS, the owners of said tract of land desire to obtain
a variance from the minimum lot size requirement so that they may
apply to the Board of County Commissioners for a recorded exemp-
tion, as set forth in Section 9-4 .A. (6) of the Subdivision Reg-
ulations , and -
WHEREAS , the Board of County Commissioners finds that the
applicants ' request, as presented, does not provide for the re-
quired public road frontage, and deems it advisable to direct
the Department of Planning Services staff to find out whether
or not said road is an existing County road, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado feels that the applicants have shown good cause for
granting a lot size variance under Section 9-4 .A. (6) of the
Weld County Subdivision Regulations .
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that a variance from lot
size requirements be, and hereby is , granted to George and
Charlene Sandlin for the above described parcel of land.

BE IT FURTHER RESOLVED by the Board of County Commissioners
that the Planning Services staff is hereby directed to find out
whether or not said road, as stated herein, is an existing County
road. If said road is not an existing County road, the appli-
cants shall provide the minimum road frontage or apply for a
variance from that requirement prior to approval of a recorded
exemption on this property.
The above and foregoing Resolution was , on motion duly made
and seconded, adopted by the following vote on the 19th day of
November, A.D. , 1980 .

Re: Lot Size Variance #118
Dear Commissioners:
The attached letter and related materials are in reference to a request
for a lot size variance from George and Charlene Sandlin. The property
on which this request has been made is described as the NW1 NE4, Section
29, T1N, R66W of the 6th P.M. , Weld County, Colorado. This property is
located 11 miles north of Brighton.
The property under consideration contains approximately 40 acres of class
II and III irrigated soils. The request is to obtain a variance from
the minimum lot size requirement, Section 9-4. A. (6) of the Weld County
Subdivision Regulations, so that they may make application for a recorded
exemption.
Mr. and Mrs. Sandlin are requesting this lot size variance in order to
move their mother's home onto the property.
Based upon the information submitted and the adopted policies in the
County, the Department of Planning Services Staff recommends the request
be approved for the following reasons:
1. The proposed request conforms with the intent clause of the
recorded exemption procedure (Section 9-2 of the Weld County
Subdivision Regulations) , the intent clause of the Agricultural
Zone District (Section 3.3.A. of the Weld County Zoning Resolu-
tion) , and the Weld County Comprehensive Plan in that the uses
will be compatible with the surrounding agricultural uses. The
request will allow agriculture and related uses to be the pre-
dominant land uses.
2. The City of Brighton has reviewed this request and has no objec-
tions to it.
3. The request complies with the provisions of Section 9-4 A. of
the Weld County Subdivision Regulations with the exception of the
lot width requirement.

The required minimum road frontage in the Agricultural Zone District is
180 feet. The Sandlin's request as presented does not have the required
public road frontage. Therefore, if this lot size variance request is
approved by the Board, Mr. and Mrs. Sandlin should provide the minimum
road frontage or apply for a variance from that requirement prior to ap-
proval of a recorded exemption on this property.
