RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL
ACTION AGAINST CIRILO AND GUILLERMINA LEON FOR VIOLATION OF THE WELD
COUNTY CODE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Cirilo and Guillermina Leon, ZCV#0701060, are allegedly in violation of the
Weld County Code, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 11th day of September, 2007, a public hearing was held before the
Board of County Commissioners for the purpose of hearing testimony relating to said violation, and
WHEREAS, Cirilo and Guillermina Leon were not present or represented at said hearing,
although all parties were notified of said hearing by Department of Planning Services staff, and
WHEREAS, the Board of County Commissioners deems it advisable to refer said violation
to the Weld County Attorney's Office for legal action, with an instruction for delay of action upon
such referral until October 11, 2007, to allow adequate time for the property owners to submit an
Use by Special Review application to bring the subject property into compliance and for a
inspection of the property by the Department of Planning Services staff.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that ZCV#0701060 be, and hereby is, referred to the Weld County Attorney's
Office for legal action against Cirilo and Guillermina Leon to remedy the violation of the Weld
County Code, and any other persons occupying the properties, any persons claiming an interest
in the properties, and any persons acting in active concert with the identified parties, with an
instruction for delay of action upon such referral until October 11, 2007, to allow adequate time for
the property owners to submit a Use by Special Review application to bring the subject property
into compliance.

Violation Summary Report
06/28/2007 Property Inspected Upon a visual inspection of the property, the following
items were noted: yellow single wide mobile home and a
white double wide mobile home. Both appear to be
occupied. No pictures were taken during this inspection.
07/19/2007 Phone Call Orlando Leon (720-495-9620) called for his father. He saic
that he and his father were buying the property together.
He said his dad and mom live in the single wide and he
and his wife and 2 children live in the modular home. He
asked if there were any permits he could apply for in order
to maybe keep both homes. I explained the he could
apply for a Use by Special Review. I explained that water
was probably going to be an issue. He said they have an
old tank buried under ground. I said a cystern. He said
yes. I told him that he would need to apply for that as
well -through the Health Department.
08/27/2007 Property Inspected Upon a visual inspection of the property, the following
items were noted: 1 double wide mobile home and 1
single wide mobile home are both still situated on the
property. No additional pictures were taken.
08/28/2007 Phone Call Ben Pineda (303-655-9070 X 14) called and left a voice
mail indicating that he had questions regarding the USR
application. Hannah Hippely & I called him back. He
indicated that Cirilio brought him the USR application
yesterday and he was just trying to figure out if he could
process it or if he needed to forward it to another
department. He asked if it was too late to submit the
USR application. We told him it was not too late.
Hannah explained that he might have an up-hill battle.
That he should first check with the Health Department
(regarding septic issues &water issues). She then
explained that staff might not be in support of this
application due to it being situated within a subdivision,
but to start off with the Health Department. I advised him
that a Violation Hearing has been scheduled for October 9
@ 1000. I advised him that if he submitted a complete
application prior to 10/08/07, the hearing would be
cancelled. We then hung up. We then called Ben back
and gave him the option of Medical Hardship -we
explained that we were not aware of the health condition
of Cirilio or Guillermina, but this might be another option
and if so, then a much more viable option. He said he
would check into it and let me (Beth) know either way.
08/29/2007 Phone Call Cirilio's daughter in-law called and spoke to me. I
re-explained the USR vs. ZPMH. She was going to pass
the information along to Cirilio. She was initially asking
for more time. I advised her that they actually have until
10/08/07 to turn in a complete application -one way or
another.

My records indicate that when you installed the white double wide mobile home, the single
wide mobile home was supposed to be removed from the property; however, upon a visual
inspection of the property, I noted both mobile homes still present. The single wide mobile
home shall be removed from the property.

Dear Bethany,
Ilcre is a list of those persons that we are investigating in regards to having more than
one residence on a property.
I. Lydia Cervantes. 7976 Harold. She has been very cooperative with ARWP and w•
gave her until June 13 to come into compliance.
2. Lynn and Jack Van Matre. 7898 Richard. They have a large house and a little bowie
on the property. Jack has been very sick and has had two major surgeries in the last thicc
months. He will disconnect the water from the little house when he is well. We gave
him until June 13 to disconnect the water line.
3. Alicia Manrique-z. 15426 Caroline. They have a little trailer in back of their house. I
talked to the son and he said the trailer wasn't being lived in and to conic and inspect [t{e)
4. Joe Bucno. 7486 Harold. There are two trailers connected together in an "L" shap
Joe told me that the water isn't hooked up to the one trailer.
5. Cirilo Leon. [5336 Coleman. There are two separate homes on one acre and they alre
both connected to our water system.
