HomeMy WebLinkAbout820381.tiff MINUTES OF THE WELD COUNTY BOARD OF ADJUSTMENT March 24, 1983 A regular meeting of the Weld County Board of Adjustment was held on March 24, 1983, at 2:45 p.m. in the Weld County Centennial Building, 915 10th Street, Greeley, Colorado in the Commissioners' Hearing Room. The meeting was called to order by the Chairman, Gordon Lacy. CASE NUMBER: BOA-852:83:3 APPLICANT: Raymond 0. Ferrell REQUEST: A variance of five (5) feet, six (6) inches from the twenty (20) foot setback requirement in the "R-5" (Residential) Zone District as set forth in Section 32.7.4 of the Weld County Zoning Ordinance LEGAL DESCRIPTION: Lot 19, Block 5, Hill-N-Park Mobile Home Subdivision LOCATION: 3821 Yosemite Drive, Greeley, Colorado PROPOSAL: Greg Oxenfeld stated the applicant proposes to build a garage on the southeast portion of his lot and needs approval of a five (5) foot six (6) inch variance from the required twenty (20) foot setback requirement in the Residential "5" Zone District APPEARANCE: Raymond 0. Ferrell, property owner, appeared and stated his reasons for applying for this requested variance. The Chairman called for discussion from the audience. There was none. Motion seconded by Shirley Rein. The Chairman called for discussion from the members of the Board of Adjustment. Discussion followed. The Chairman asked the Secretary to poll the members of the Board of Adjustment for their decision. Ruth McElrath - yes; Rhonda Giles - yes; Marion Richter - yes; Willis Piper - yes; Frank Stewart - yes; Shirley Rein - yes; Gordon Lacy - yes. Motion carried unanimously. CASE NUMBER: BOA-851:83:2 REQUEST: A sign variance of seven hundred nine (709) additional square feet and an additional thirty-eight (38) feet in height; and an additional two (2) directional signs, plus two (2) signs attached to the wall, but extending three (3) feet above the roof line; and a fifteen (15) foot setback variance for the identification sign along Colorado State Highway 119; and a ten (10) foot variance for an air and water island LEGAL DESCRIPTION: Part of the SE4, Section 3, Township 2 North, Range 68 West of the 6th P.M. , Weld County, Colorado LOCATION: Approximately 3.5 miles northwest of Firestone at Del Camino Greg Oxenfeld stated the applicant proposes to locate signs for a self-service fuel center with a convenience store and delicatessin. Each variance is requested because of the distance (approximately 1/8 mile) of the business from Interstate 25. APPEARANCE: Jeff Beddingfield, Attorney, representing the Musket Corporation, and Marty Ruff and Larry Thompson, employees of the Musket Corporation Tape 27 - Side 1 Mr. Beddingfield explained the reasons for the requested variances and dis- tributed pictures of the standard "Love's Stop" signage. He explained the company's request for the additional signs and the setback variance request for the identification sign along Highway 119. He stated the request for the ten foot variance for the air and water island was primarily for safety. He also MINUTES OF THE WELD COUNTY BOARD OF ADJUSTMENT Page 3 March 24, 1983 -explained the routes for vehicular and truck traffic entering and exiting from the property so that smaller vehicles did not mix with the heavier truck traffic. The Chairman called for discussion from the audience. There was none.. The Chairman asked Greg Oxenfeld to read the recommendations of the Department of Planning Services staff, which was for denial. MOTION: Frank Stewart moved BOA-851:83:2 be approved because he did feel that: (1) special conditions and circumstances do exist which are peculiar to the lot and building; (2) the signage is compatible with the existing signs in the area; (3) safety is the primary reason for the request for the smaller directional signs and the location of the air and water island; and (4) the Colorado State Highway Department had no objections to this request. Motion seconded by Ruth McElrath. The Chairman called for discussion from the Board of Adjustment. Discussion followed. The Chairman asked the Secretary to poll the members of the Board of Adjustment for their decision. Motion carried with six voting for and one against the motion. Ferrell Address 3821 Yosemite Drive, Greeley, Colorado 80634 Moved by Rhonda Giles that the following resol- ution be introduced for passage by the Weld County Board of Adjust- ment : Be it resolved by the Weld County Board of Adjustment that the appeal of Raymond 0. Ferrell for a variance or appeal described as: Five feet (5') six inches (6") from the setback requirement of twenty feet (20') from the existing right-of-way in an "R-5" (Residential) Zone District. on the following described property : Lot 19, Block 5, Hill-n-Park Subdivision. be granted ( R1 for the following reasons : 1. The variance requested is the minimum variance possible for making reasonable use of the lot for placement of the garage; 2. The granting of the variance will be in harmony with the purpose and intent of this ordinance, and will not be injurious to the public health, safety or welfare of the surrounding land uses; 3. The Board of Adjustment has not received any objections to this request; A. It is the Board of Adjustment's opinion that this requested relief is not detrimental to the public good or contrary to the purpose and intent of the Weld County Zoning Ordinance and the Residential "5" Zone District. 5. A fifteen (15) foot setback variance for one of the directional signs and a ten (10) foot setback variance for an air and water island, both from the twenty-five (25) foot required setback. Hello
