The Weld County Public Works Department has reviewed this proposal. This project falls
primarily under the purview of the Use by Special Review Standards, Weld County Code,
Chapter 23, Article II, Division 4; Section 23. Our comments and requirements are as follows:
COMMENTS:
Weld County Road Classification Plan (FHU): WCR 23 is a collector road and requires an
80-foot right-of-way at full build out. There is presently a 60-foot right-of-way. This road is
maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Zoning
Ordinance (23-1-90), the required setback is measured from the future right-of-way line. WCR
23 at this location is an off-set road not on the section line.
Our most recent average daily traffic count (ADT) reflects 545 vehicles taken in a 24-hour period
on 9/15/2006. The location was on WCR 23 between WCR 66 and State Highway 392.
REQUIREMENTS:
Future Right-of-Way: The applicant has identified an additional 30-foot of right-of-way being
reserved on the plat drawing. The future right-of-way protrudes through the existing house and
barn section. These structures fall under the non-conforming use definition. The purpose of
reserving the future right-of-way is that no new structures be built within that area plus the
setback in the agricultural zone. Contact your planner for clarification on definitions.
Access: Utilize the existing access to the proposed USR facility from WCR 23.
Parking and Circulation: Utilize the existing parking location shown on the plat drawing.
Off-Street Parking Spaces: Off-street parking spaces including the access drive shall be
surfaced with gravel, asphalt, concrete or the equivalent and shall be graded to prevent
drainage problems.
Utilize the existing agricultural, oil and gas, and ditch roads that are necessary for your
agricultural operation.

Storm Water Drainage: I am referring a portion of the storm water drainage to the Department
of Health and Environment, as it deals with animal units.
The historical flow patterns and run-off amounts will be maintained on site in such a manner that
it will reasonably preserve the natural character of the area and prevent property damage of the
type generally attributed to run-off rate and velocity increases, diversions, concentration and/or
unplanned ponding of storm run-off.
The applicant must take into consideration storm water capture/quantity and provide accordingly
for best management practices.

Hannah:
The canal for The New Cache La Poudre Irrigating Company, commonly known as
Greeley #2 Canal, passes along the north boundary for entire length of the property.
The map furnished correctly displays the canal right-of-way (75 feet from center, 150 feet
total width). A couple small house keeping items. The canal is commonly known as the
Greeley#2 Canal, not Greeley#1. The right-of-way of the canal is clearly labeled but
should be labeled as an exclusive right-of-way for The New Cache La Poudre Irrigating
Company. A note should be placed on the map stating that any activity within the right-
of-way must have written approval from The New Cache La Poudre Irrigating Company.
It should be noted that there are a number of facilities encroaching on the canal right-of-
way. Additional encroachments need to be avoided and the existing one removed as they
reach the end of their useful life.
Other than the minor house keeping items, The New Cache La Poudre Irrigating
Company has no additional comments.

To Whom It May Concern:
North Weld County Water District provides domestic water service to the property located at 32614 WCR 23,
Windsor, CO. The current owner of the property is Scott and Kristin Fisher. The current service provides a 3/4" meter,
which should provide the proposed Dog Kennel adequate service. The current Water Allocation Class is 1 (228,000
gallons) and the Current Plant Investment Class is 1 (228,000 gallons).
Water tap/service is placed on the physical property, defined by a legal description. In case of a Recorded
Exemption, the water tap shall only serve the parcel that the water tap is located on. Service shall NOT cross the legal
description of one parcel to serve the other parcel, unless an easement has been recorded for the water service and has
been approved by the District.
The District guarantees treatment and delivery of water purchased. All water that is delivered with surcharge
'''—subject to water availability. Water purchased through the District shall be 70% delivery of an Acre-Foot of water
_8,000 gallons), if the allotment for Colorado-Big Thompson (CBT) project water, which is determined by the Northern
Colorado Water Conservancy District, is 50% or greater. North Weld County Water District will restrict the delivery as
necessary when the CBT allotment is less than 50%. A portion of the Raw Water Fee is utilized by the District to
construct storage reservoirs.
The Plant Investment Fee pays for the infrastructure required to deliver 1 AFU (228,000 gallons). If usage
exceeds the number of Plant Investments that were purchased, an additional Plant Investment Surcharge will be applied
to your account. Plant Investments may be purchased to increase the amount of water to be delivered and avoid the
Plant Investment Surcharge. Refer to table below for current Plant Investment Surcharge schedule.
Water Surcharge
Surcharge will be assessed when an account's year to date usage exceeds their annual allotment. Currently surcharge is
$0.10 per 1,000 gallons. This fee is to recover the District's cost to obtain additional water rights for delivery. All water
that is delivered with surcharge is subject to water availability.
Plant Investment Surcharge
When an account's year to date usage exceeds their Plant Investment Allotment(#of Equivalent Taps x 228,000 gallons),
a surcharge will be assessed. The transfer of additional water will not remove this charge. Additional Plant Investments
must be purchased to increase the allotment and reduce the Plant Investment Surcharges.

Site Specific Development Plan and Special Review Permit for a Kennel (16 dog maximum) in the A
(agricultural zone district).
1. A building permit shall be obtained for change of use to a commercial kennel.
2. A plan review is required for each building for which a building permit is required. Plans shall include a
floor plan. Two complete sets of plans are required when applying for each permit.
3. Buildings shall conform to the requirements of the various codes adopted at the time of permit
application. Currently the following has been adopted by Weld County: 2003 Intemational Building Code;
2003 Intemational Mechanical Code; 2003 International Plumbing Code; 2003 International Fuel Gas
Code; and the 2005 National Electrical Code and Chapter 29 of the Weld County Code.
4. Fire resistance of walls and openings, construction requirements, maximum building height and
allowable areas will be reviewed at the plan review. Setback and offset distances shall be determined by
the Zoning Ordinance.
5. Building height shall be measured in accordance with the 2003 International Building Code for the
purpose of determining the maximum building size and height for various uses and types of construction
and to determine compliance with the Bulk Requirements from Chapter 27 of the Weld County Code.
Building height shall be measured in accordance with Chapter 23 of the Weld County Code in order to
determine compliance with offset and setback requirements. Offset and setback requirements are
measured to the farthest projection from the building.
7. Provide letter of approval from Windsor/Severence Fire protection District prior final approval of building permits.
8. There is one active building permit on record.

their boarding to five (5) dogs, however Weld County's approval would allow up to sixteen
(I6) dogs to be boarded at one lime. There is an existing home on the property Ihat will

lot is within the Town's Growth Management Area (GM and is depicted as Light Industrial

allowed on a conditional basis, therefore the proposed use appears to he consistent with the
Powers Land t.;St Plan map.

Environmental Health Services has reviewed this proposal for a kennel — 16 dog
maximum. We have no objections to the proposal, however, we do recommend that the
following conditions be part of any approval:
We recommend that the following requirements be met prior to allowing the plat to be
recorded:
1. The applicant shall submit a dust abatement plan for review and approval, to the
Environmental Health Services, Weld County Department of Public Health &
Environment.
2. The applicant shall provide written evidence to the Weld County Department of
Public Health and Environment that the applicant has contacted the Colorado
Department of Agriculture (CDA), Division of Animal Industry. This contact shall
determine if a license under the Pet Animal Care Facilities Act (PACFA), as
defined under C.R.S. 35-80-101 through 117. C.R.S. is required, or provide
evidence that the applicant is not subject to the PACFA requirements.
1. The applicant shall submit a waste handling plan, for approval, to the
Environmental Health Services Division of the Weld County Department of Public
Health & Environment. The plan shall include at a minimum, the following:
1) A list of wastes which are expected to be generated on site (this should
include expected volumes and types of waste generated).
2) A list of the type and volume of chemicals expected to be stored on site.
3) The waste handler and facility where the waste will be disposed (including
the facility name, address, and phone number).
We recommend that the following requirements be incorporated into the permit as
conditions that must be met prior to the issuance of the Certificate of Occupancy:
1. An individual sewage disposal system is required for the proposed residence and
shall be installed according to the Weld County Individual Sewage Disposal
Regulations. (Septic Permit # 0600275 has been applied for.)
2. The septic system is required to be designed by a Colorado Registered
Professional Engineer according to the Weld County Individual Sewage Disposal
Regulations.
We recommend that the following requirements be incorporated into the permit as
development standards:
1. Animal and feed wastes, bedding, debris and other organic wastes shall be
disposed of so that vermin infestation, odors, disease hazards, and nuisances
are minimized. Such wastes shall be removed at least weekly from the facility
and disposed by a commercial hauler.
2. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for
final disposal in a manner that protects against surface and groundwater
contamination.
3. No permanent disposal of wastes shall be permitted at this site. This is not
meant to include those wastes specifically excluded from the definition of a solid
waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.,
as amended.
4. Waste materials shall be handled, stored, and disposed in a manner that controls
fugitive dust, fugitive particulate emissions, blowing debris, and other potential
nuisance conditions.
5. The applicant shall operate in accordance with the approved "waste handling
plan".
6. The applicant shall comply with the Colorado Department of Agriculture (CDA),
Division of Animal Industry, if applicable.
7. Fugitive dust and fugitive particulate emissions shall be controlled on this site.
The facility shall be operated in accordance with the approved dust abatement
plan at all times.

8. This facility shall adhere to the maximum permissible noise levels allowed in the
Commercial Zone as delineated in 25-12-103 C.R.S., as amended.
9. Adequate handwashing and toilet facilities shall be provided for employees and
patrons of the facility.
10.Sewage disposal for the facility shall be by septic system. Any septic system
located on the property must comply with all provisions of the Weld County Code,
pertaining to Individual Sewage Disposal Systems. A septic permit# SP-
0600275 has been applied for.
11.The facility shall utilize the existing public water supply. (North Weld County
Water District)
12.The applicant shall comply with the General Rules for Child Care Facilities issued
by the Colorado Department of Human Resources, Division of Child Care.
13.The operation shall comply with all applicable rules and regulations of the State
and Federal agencies and the Weld County Code.

determine if a license under the Pet Animal Care Facilities Act (PACFA), as
defined under C.R.S. 35-80-101 through 117. C.R.S. is required, or provide
evidence that the applicant is not subject to the PACFA requirements.

Planning staff has reviewed the application from Scott&Kristie Fisher, and wish to forward the
following comments and recommendations;
I. The property is located outside of Greeley's Long Range Expected Growth Area. It
would be unlikely that the subject property would ever be incorporated within the City
of Greeley.
2. The reservation of right-of-way shown along WCR 23 will provide adequate access for
future development.
3. All future access to WCR 23 should be limited to existing access.
4. Nearby residential uses may prove to be incompatible with the kennel use, measures to
reduce noise are recommended.
With the above conditions met, the City of Greeley can recommend approval of this USR.

The Department of Planning Services reviewed the above referenced Use by Special Review
documentation and drawings and offers the following comments:
The Use by Special Review Plat shall be prepared in accordance with Section 23-2-260.D of
the Weld County Code. An exception to this requirement is the scale of the proposal. The
detailed site drawing shall be drawn to a scale of one inch equals twenty feet (1" = 20').
This application shall be in compliance with Section 23-3-250 A. and B and is address in the
following comments.
Section 23-3-250.A.1
Stormwater Management. All users of land shall provide and maintain stormwater retention
facilities designed to retain the stormwater runoff in excess of historic flow from the
undeveloped site. The stormwater retention facility on a developed site shall be designed for a
one-hundred-year storm. The stormwater retention facility shall be designed and operated to
release the retained water at a quantity and rate not to exceed the quantity and rate of a five-
year storm falling on the undeveloped site. The application materials state that the storm water
detention is not proposed as the existing drainage patterns will not be affected. The applicant
shall contact the Weld County Department of Public Works to durther discuss this issue.
Section 23-3-250.A.2
Parking. Sufficient screened, off-street, paved parking areas shall be provided to meet the
requirements of employees, company vehicles, visitors and customers of the Uses Allowed by
Right and Accessory Uses. Appendix 23-A describes the design requirements for parking
spaces and Appendix 23-B delineates the number of parking spaces required by use for this
property.
The proposed facility has Office and Kennel uses. The application states the facility is a home
style boarding facility accommodating five dogs for boarding in addition to the applicant's own
animals. Total animals to be kenneled is set at 16 per the application materials. The existing
improvements on site include a single family residence, a barn and several outbuildings. There
are also several fenced areas delineated on the plat, however, none are labeled as to be part of
the kennel operation. Future structures include a single family residence and 30x55 foot
unidentified structure. The parking requirement for Office uses are one space for every two
employees plus one space per 500 SF. Given this determination of uses, at a minimum five
parking spaces are required, one of which should meet the intent of the American's with
Disabilities Act. There is not a specific parking area delineated on the drawings submitted.

Street Access. Lots shall have safe access to an approved public or private street. The design
designation of any street or highway as to type shall be in conformance with that shown on the
county thoroughfare plan and/or the master plan of the affected municipality. The application
materials delineate one point of ingress and egress. The applicant shall contact the
Department of Public Works to verify any access requirements off of County Road 23. Written
evidence of an approved access shall be provided to the Department of Planning Services.

Required Yards - Setback
No use or accessory use may be located closer than twenty-five (25) feet to the existing or
proposed (whichever represents the greater right-of-way width) highway or street right-of-way.
Off-street parking areas may be permitted in the required setback area when the area is
screened from direct view of persons on the public rights-of-way. Fences over six (6) feet in
height are not required to comply with the minimum setback and may be located on the
property line. Fences located on corner lots abutting public right-of-way shall not obstruct the
view of vehicular traffic at an intersection. There was not a scaled elevational drawing of the
structure(s) included in the application materials, therefore, prior to the release of building
permits, the set back shall be verified given the existing proposed site conditions, specifically
addressing the elevated display areas. Written evidence of compliance shall be submitted to
the Department of Planning Services.

Required Yards - Offset
No use or accessory use may be located closer than ten (10) feet to its lot line. Off-street
parking areas may be permitted in the required offset area when the area is screened from
adjacent lots zoned R-1, R-2, R-3, R-4 or R-5. Fences over six (6) feet in height are not
required to comply with the minimum offset and may be located on the property line. The plans
submitted with the application materials have not delineated the offset for the existing
structures. There was not an elevational drawing of the structure included in the application
materials, therefore, prior to the release of building permits, the offset shall be verified.
Section 23-3-250.A.5.A
Required Landscaped Areas
No more than eighty-five percent (85%) of the total area of a lot shall be covered. Land shall
not be deemed covered if it is used for growing grass, shrubs, trees, plants or flowers or if
covered by decorative gravel or wood chips, or if it is otherwise suitably Landscaped. Given the
lack of water for irrigation on this property, staff requests that a ground cover be established to
limit erosionary processes, i.e., wind, water and snow pack melt.
Section 23-3-250.A.5.B
That portion of a lot which abuts a public or private street right-of-way shall be landscaped for a
distance of ten (10) feet, measured at a right angle from the lot line towards the interior of the
lot. Sidewalks and driveways may pass through the required landscaped areas.
Section 23-3-250.A.6
Areas used for trash collection shall be screened from public rights-of-way and all adjacent
properties. These areas shall be designed and used in a manner that will prevent wind- or
animal-scattered trash. The application materials do not identify the location of the dumpster
on the plat. Future submittals shall delineate the screened enclosure as outlined in this Section
of the Code.

Water Supply. Uses shall have an adequate source of potable water. The application
materials state that water is provided by North Weld County Water District and an irrigation
well. No information was submitted on the well. If the well is to be utilized additional
information should be submitted for staff review prior to utilizing this water source. The
applicant shall meet the requirements of the Weld County Department of Public Health and
Environment for water associated with this proposed facility.

Sewage Disposal. Uses shall have adequate sewage disposal facilities. The application
materials state that an existing ISDS system on site that will handle the effluent flow. Further,
the applicant shall meet the requirements of the Weld County Department of Public Health and
Environment.
Section 23-3-250.A.9
Outside Storage. Uses involving outdoor storage of vehicles, equipment or materials when
permitted shall be screened from public rights-of-way and all adjacent properties. The
application materials and supporting drawings indicate that a fence is located adjacent to the
dog "turn-outs". The application materials further state there will be no outside storage once
the facility is operational. The applicant shall submit documentation as to how the outside
storage will be screened during the construction period.
Section 23-3-350.B.
Operation Standards. Uses shall demonstrate conformance with the following operation
standards to the extent that they are affected by location, layout and design prior to
construction and operation. Once operational, the operation of the Uses permitted shall
conform to these standards.
Section 23-3-350.8.1
Noise. Uses and structures shall be located, designed and operated in accordance with the
noise standards as established in Section 25-12-101 C.R.S. The applicant shall meet the
established standards set by the Weld County Department of Public Health and Environment.

Air Quality. Uses shall be located, designed and operated in accordance with the air quality
standards established by the Colorado Air Pollution Control Commission. The applicant shall
meet the established standards set by the Weld County Department of Public Health and
Environment.

Water Quality. Uses shall be located, designed and operated in accordance with the water
quality control standards established by the Colorado Water Quality Control Commission. If
applicable, the applicant shall provide additional information regarding the well if required
through the Weld County Department of Public Health and Environment referral.

Radiation and Radioactive Materials. The handling, use, storage and processing of radioactive
materials shall be in accordance with the applicable regulations of the State and the United
States government. The application materials do not indicate this is applicable, should this not
be the case, the applicant shall provide additional information to the Weld County Department
of Public Health and Environment.
Section 23-2-250.8.5
Heat. Uses shall not emit heat in such an amount sufficient to raise the temperature of the air
or of materials at or beyond the Lot line more than five (5) degrees Fahrenheit. The application
materials do not indicate this is applicable, should this not be the case, the applicant shall
provide additional information to the Weld County Department of Public Health and
Environment and the Department of Building Inspection. Further, the applicant shall obtain a
written approval from the Windsor-Severance Fire Protection District stating that the facility is in
compliance with the Fire Code.
Section 23-2-250.B.6
Light. Any lighting, including light from high temperature processes such as welding or
combustion, shall be designed, located and operated in such as manner as to meet the
following standards: sources of light shall be shielded so that beams or rays of light will not
shine directly onto adjacent properties; neither the direct nor reflected light from any light
source may create a traffic hazard to operators of motor vehicles on public or private streets;
and no colored lights may be used which may be confused with or construed as traffic control
devices. The application materials did not include a Lighting Plan. Should exterior lighting be a
part of this facility, all light standards shall be delineated on the Site Plan Review Plat.
Section 23-2-250.B.7
Property Maintenance. Property shall be maintained in such a manner that grasses and weeds
are not permitted to grow taller than twelve (12) inches. In no event shall the property owners
allow the growth of noxious weeds. The application materials do not address property
maintenance. Future correspondence shall identify how the property will be in compliance with
this Section of the County Code.
Section 23-4-50.
Off Street Loading. The applicant shall delineate on the Site Plan Review plat the location of
the loading zone that is in compliance with Section of the Code. There shall be parking or
staging of trucks within the public rights-of way. Further, the applicant shall meet all
requirements of the Department of Public Works concerning access and circulation of vehicles
for this proposed facility.
Section 23-4-90
Signs. The application materials do not address the issue of on-site signs, however, the
Landscape, Sign and Lighting Plan identifies sign locations on site Section 23-4-90 addresses
signs located in the Agricultural Zone District. The applicant shall provide written evidence that
all proposed signs are in compliance with this section of the Code.
The applicant shall enter into an Improvements Agreement according to policy regarding
collateral for improvements and post adequate collateral for all transportation (access drive,
parking areas, etcetera) and non-transportation (plant materials, fencing, screening, etcetera).
The agreement and form of collateral shall be reviewed by County Staff and accepted by the
Board of County Commissioners prior to recording the Site Plan Review plat, as required by
staff planner.
General Comment:
The application materials state that the barn and attached structures will be utilized in the
operation of this proposed facility for the daily operations. The applicant shall provide additional
information to the Department of Building Inspection stating how this conversion is to be
accomplished and what if any, additional requirements shall be met prior to operation. Written
evidence of compliance with these requirement shall be submitted to the Department of
Planning Services.
The application material state that the facility will be for up to sixteen (16) dogs of an
unspecified breed and or size. The applicant shall provide evidence from the appropriate
authority stating that the size of the circular dog "turn-outs" is of an appropriate dimension to
accommodate the spatial requirements for the dogs.
