RE: ACTION OF THE BOARD OF COMMISSIONERS REGARDING VIOLATION VI#0700088
AGAINST MARIO CALDERON FOR VIOLATION OF THE WELD COUNTY CODE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Mario Calderon, VI #0700088, is allegedly in violation of the Weld County
Code, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 9th day of October, 2007, a public hearing was held before the Board
of County Commissioners for the purpose of hearing testimony relating to said violation, at which
time, the matter was continued to November 13, 2007, to allow adequate time for the property
owner to submit a Use by Special Review application.
WHEREAS, on the 13th day of November, 2007, a public hearing was held before the
Board of County Commissioners for the purpose of hearing testimony relating to said violation,and
WHEREAS, Mario Calderon was not present or represented at said hearing, although all
parties were notified of said hearing by Department of Planning Services staff, and
WHEREAS, the Board deems it advisable to refer the case back to the Department of
Planning Services due to the property owner submitting a Use by Special Review application.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that case VI#0700088 against Mario Calderon be, and hereby is, referred back
to the Department of Planning Services.

REMEDY
The Commercial Operations shall be permitted or completely removed from the property. Additionally,
the mobile home shall be permitted or removed from the property. Should you choose to go through our
Use by Special Review process you can
choose to include both the commercial business and mobile home under the 1 (one) application. A
Building Permit will also be required for both the mobile home and the cargo container. I recommend
you speak to one of our On-Call Planners.

OTHER CASE HISTORY
03/30/2007 Office Visit Mario Calderon came to the Greeley Office. He asked
what the letter was about. I explained that the mobile
home did not have any building/zoning permits. He
indicated that it was on the property when he bought it I
explained that it still need building/zoning permits. I also
explained that he wasn't being taxed for it. He said he
just uses it for storage. I explained that the Weld County
Code no longer offers mobile homes as storage units. It
would simply need to be removed. He then asked about
the vacant lot to the South of this lot. He indicated that
he owns both lots. He said he is interested in putting an
RV Storage Yard there. I went and got Roger Caruso.
Roger and I sat down with him and walked him through
the USR application. We explained that as long as he
was going to do a USR application for the property he
currently lives on (due to the operation of a construction
company), he might as well include both lots. It would
save him money and time. We told him to really take
some time to think about what exactly he wants to do and
then he should call in and schedule an appointment with
Roger and I so that we could point him in the right
direction. He said he would contact one of us my next
Friday (04/06/07).
06/28/2007 Property Inspected Upon a visual inspection of the property, the following
items were noted: Mobile home still present. 1 Cargo
Container is present and multiple commercial vehicles and
storage. Proceed. No pictures were taken during this
inspection.
07/16/2007 Phone Call I called Mario Calderon (303-591-3249) and left him a
voice mail backing up what Roger Caruso told him
regarding if the USR application is completed and
submitted, the Violation Hearing will be cancelled and the
violation will be placed on hold pending the USR process.
I told him to call me if he had any questions.
07/24/2007 Phone Call Roger C. left a voice mail asking him to call and schedule
an office visit to go over his USR application.
07/30/2007 Office Visit Larry Carrol & Mario Calderon came to the SW Office and
met with Roger Caruso and I. We discussed the USR
application and the RE application. We reminded them of
the Violation Hearing and their time constraints.

Larry,
Since Michelle is out of the office I will respond to your question; she can provide
clarification when she returns.
First off the USR and RE processes are two very separate and distinct applications . One
does not have to be done in conjunction with the other i .e. Mr. Calderon can proceed with
the USR application and not the RE application (the USR is necessary in order to correct
the violation however) .
To answer your other question, yes, the application can be amended through the process and
lower standards applied. It will more than likely require reworking after Staff comments
have been drafted (note:
staff may determine the changes are substantial and have you start from the beginning -
this is usually the case if the intensity increases) .
However, I am under the belief that we can strike any comments that would not pertain to
the RV storage if your applicant chooses to proceed with the construction business .
I hope that clarifies your question. Planning Staff would prefer a complete accurate
application but during the USR process some things do change and we understand that.

I will attempt to clarify Mr. Calderon's options so he can make an informed decision. I
also understand the timeliness of our response and finalization of the application as the

hearing has already been extended.
The only item that I did not get an answer on was if part of the USR/RE application was
denied or was challenged by the neighbors could the applicant continue on with a revised
application and complete the process with only a portion of the project? This is key in
the decision to separate the issue of the violation and the new use.
Please let me know ASAP - I did try to call, but was not able to reach you by phone.

Larry,
It is my understanding after talking to planning staff two
meetings were held on 3/30/07 and 4/02/07 with the applicant to discuss
his violation (VI-0700088) . In the meeting planning staff informed the
applicant in order to correct his current violation a USR application
needed to be submitted for the construction business. The applicant
indicated in the meeting that he would also like to conduct an Rv
storage yard on the property. Planning staff indicated that the
applicant could apply for both uses under one USE application. The
applicant can apply for two separate USR's for the two different uses if
he so chooses. If he elects to apply for two separate USR' s two fees
would be required.
If the applicant would also like to subdivide his property that
is a separate process (Recorded Exemption) which is not related to the
violation.
The Department of Planning Services is more then willing to hold
a pre-application meeting with the applicant but please be aware of the
time constraint regarding the violation on the property. A complete
application needs to be submitted to the Department of Planning Services
before Nov. 13, 2007 for the violation to be placed on hold and the
violation hearing to be cancelled.

I sent this question yesterday and did not hear from either of
you, so I ' ll ask again. Should we continue the application/process as
we have currently submitted OR because of the unresolved violation
should we separate the issues and only address the contracting business
on the owner's property??
I had a meeting with Mario again today and he was understanding
that the USR for his business use was only a formality - that by his
applying for the USR, he would be granted the conditional use on his
primary property and that the public hearing was only for the new
proposed RV storage and lot separation.
Since I was not at the previous meetings I am not aware of what
was discussed with Roger nor am I sure there was complete understanding
as to the process and required criteria. Mario's first concern, though,
is the ability to keep his business equipment on his personal property.
So, if there is less confusion with only addressing one issue, he is
willing to remove the RV storage yard and lot separation from the
application and concentrate on the resolution of the current violation.
Please advise. . .

Bethany/Michelle, since we could not get the information
"in-time" for the pre-app meeting is there significant issues that would
prohibit this proceeding as shown in the application?
My concern, from the beginning, is being able to
separate the issues when questions/concerns arise - ie; the use the
owner is requesting for his personal residence/contracting company and
the use and lot separation he wants for the RV storage and smaller home
site? I understand the logistics and money saving by combining the
applications - but if there is concerns for the RV storage yard, but
none for his contracting business - or visa-versa would either be able
to be separated from this application and completed without completely
re-filing the application/request?
Please advise. . .

The reason Roger & I had indicated a 3 copies
was because we expected the copies much sooner than we received them.
We intended on having a "pre-application" meeting at least a couple of
weeks before the Violation Hearing date (10/09/07) . However since the 3
copies were submitted on 10/05/07, we did not have time to conduct a
"pre-app" . Subsequently, at the Violation Hearing on 10/09/07, I
requested that the Board continue the Violation Hearing to the November
13th Violation Hearing date, since the application was deemed
incomplete. In order to avoid that hearing a complete USR and RE
application will need to be submitted prior.

Hi Michelle - I just got back into town and
received this email regarding Mario Calderon. I understand that a
complete application was not submitted as was discussed in a meeting
that Mario, Bethany Salzman, Roger Caruso and myself had, regarding the
violation and USR process. At that time, Bethany and Roger stated that
we should submit a minimum 3-copy application for preliminary review. I
assumed this was to see if the violation, RE and USR could be dealt with
simultaneously. Has this been accomplished?
If so we will proceed in complying with standard
application procedures and submit the remaining copies, with any
subsequent information that was not complete. If this is inaccurate
please notify me ASAP so we can continue this discussion.

To Whom It May Concern:
The City of Dacono is in receipt of the subject Notice of Inquiry concerning property on WCR 15
between SH 52 and Grand View Blvd. Mr. Calderon is proposing commercial uses on this site
including Mario's Concrete and an RV Storage lot.
The area between SH 52 and Grand View Blvd. is envisioned as Residential Medium Density on
the City of Dacono's Comprehensive Plan that was adopted in 2005. The uses that Mr. Calderon
desires on this property are not in compliance with the City's Comprehensive Plan and, therefore,
we object to this proposal.

To bring your property into compliance with the Weld County Code:
The Commercial Operations shall be permitted or completely removed from the property.
Additionally, the mobile home shall be permitted or removed from the property. Should you

the commercial business and mobile home under the 1 (one) application. A Building Permit
will also be required for both the mobile home and the cargo container. I recommend you

This hearing will take place in our Hearing Room, located at 918 10th Street, Greeley, Colorado. It

OTHER CASE HISTORY
03/30/2007 Office Visit Mario Calderon came to the Greeley Office. He asked
what the letter was about. I explained that the mobile
home did not have any building/zoning permits. He
indicated that it was on the property when he bought it. I
explained that it still need building/zoning permits. I also
explained that he wasn't being taxed for it. He said he
just uses it for storage. I explained that the Weld County
Code no longer offers mobile homes as storage units. It
would simply need to be removed. He then asked about
the vacant lot to the South of this lot. He indicated that
he owns both lots. He said he is interested in putting an
RV Storage Yard there. I went and got Roger Caruso.
Roger and I sat down with him and walked him through
the USR application. We explained that as long as he
was going to do a USR application for the property he
currently lives on (due to the operation of a construction
company), he might as well include both lots. It would
save him money and time. We told him to really take
some time to think about what exactly he wants to do and
then he should call in and schedule an appointment with
Roger and I so that we could point him in the right
direction. He said he would contact one of us my next
Friday (04/06/07).
06/28/2007 Property Inspected Upon a visual inspection of the property, the following
items were noted: Mobile home still present. 1 Cargo
Container is present and multiple commercial vehicles and
storage. Proceed. No pictures were taken during this
inspection.
07/16/2007 Phone Call I called Mario Calderon (303-591-3249) and left him a
voice mail backing up what Roger Caruso told him
regarding if the USR application is completed and
submitted, the Violation Hearing will be cancelled and the
violation will be placed on hold pending the USR process.
I told him to call me if he had any questions.
07/24/2007 Phone Call Roger C. left a voice mail asking him to call and schedule
an office visit to go over his USR application.

Hi Bethany- I just was contacted by Mario Calderon on his site issues and was curious of the status of this
violation.
His understanding is that if there is an application or submittal for review prior to the Commissioner Hearing he
would not have to be in attendance. He also stated that in talking to the Assessor in Greeley, it was mentioned
that he was being charged for commercial property...I don't see evidence that either property is zoned
commercial.
I mentioned that there were a couple of ways to move forward with his project, but I wanted to get more
information from the file before proceeding - could you please advise as to where he is in the process?

The uses on the above described property are being considered as a zoning code violation of Sections of the
Weld County Code. Currently your property is in violation of the following Section(s)of the Weld County Code:

To bring your property into compliance with the Weld County Code:
As we have discussed, a Use by Special Review application shall be completed and
submitted or all commercial activities and vehicles shall be removed from the property. It is
my understanding that you are waiting on Dacono to return the "Notice of Inquiry" form in
order to determine whether you will proceeding through the County or City of Dacono. This
letter pushes the violation out for approximately 30 days. Within this time period,we need to
know if you will be proceeding through the County or City based upon the"Notice of Inquiry"
results.
It is the intention of this office to assist and cooperate with you without imposing undue hardships; however,
we have no discretion in this matter if you fail to correct this violation. You have 30 (thirty) days from
April 16, 2007, to correct this zoning violation. Failure to do so will result in this office scheduling the violation
before the Board of County Commissioners to consider whether to refer the violation to the County Attorney's
Office for legal action.

It has come to the attention of the Department of Planning Services'staff that the uses on your property may
not be in compliance with the Weld County Code, Chapter 23. The potential noncompliance(s)with the Weld
County Code are as follow:
A brown single-wide mobile home is situated on the property; however,upon a search of my case
files and records, I have been unable to locate either a zoning permit or a building permit for any
mobile homes for this piece of property.
I noted at least 2 (two) Cargo Containers. The Weld County Code does allow 1 (one) Cargo
Container on a piece of property provided a building permit for the container has been approved
and completed. If you wish to retain more than 1 (one)Cargo Container a Use by Special Review
application can be submitted to the Department of Planning Services. For questions, I suggest
you speak to one of our"On-Call"Planners. To better serve the public,we have 2 locations open.

uses in the A (Agricultural) Zone District. A COMMERCIAL VEHICLE shall include, but is not
limited to,semi-trailers, dump trucks, construction equipment,railroad cars and cargo containers.
A COMMERCIAL VEHICLE shall not be allowed to deteriorate to the condition of a DERELICT
