HomeMy WebLinkAbout20073456.tiff RESOLUTION RE: ACTION OF THE BOARD OF COMMISSIONERS REGARDING VIOLATION VI#0700088 AGAINST MARIO CALDERON FOR VIOLATION OF THE WELD COUNTY CODE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Mario Calderon, VI #0700088, is allegedly in violation of the Weld County Code, and WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has not been corrected, and WHEREAS, on the 9th day of October, 2007, a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violation, at which time, the matter was continued to November 13, 2007, to allow adequate time for the property owner to submit a Use by Special Review application. WHEREAS, on the 13th day of November, 2007, a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violation,and WHEREAS, Mario Calderon was not present or represented at said hearing, although all parties were notified of said hearing by Department of Planning Services staff, and WHEREAS, the Board deems it advisable to refer the case back to the Department of Planning Services due to the property owner submitting a Use by Special Review application. He asked what the letter was about. I explained that the mobile home did not have any building/zoning permits. He indicated that it was on the property when he bought it I explained that it still need building/zoning permits. I also explained that he wasn't being taxed for it. He said he just uses it for storage. I explained that the Weld County Code no longer offers mobile homes as storage units. It would simply need to be removed. He then asked about the vacant lot to the South of this lot. He indicated that he owns both lots. He said he is interested in putting an RV Storage Yard there. I went and got Roger Caruso. Roger and I sat down with him and walked him through the USR application. We explained that as long as he was going to do a USR application for the property he currently lives on (due to the operation of a construction company), he might as well include both lots. It would save him money and time. We told him to really take some time to think about what exactly he wants to do and then he should call in and schedule an appointment with Roger and I so that we could point him in the right direction. He said he would contact one of us my next Friday (04/06/07). 06/28/2007 Property Inspected Upon a visual inspection of the property, the following items were noted: Mobile home still present. 1 Cargo Container is present and multiple commercial vehicles and storage. Proceed. No pictures were taken during this inspection. 07/16/2007 Phone Call I called Mario Calderon (303-591-3249) and left him a voice mail backing up what Roger Caruso told him regarding if the USR application is completed and submitted, the Violation Hearing will be cancelled and the violation will be placed on hold pending the USR process. I told him to call me if he had any questions. 07/24/2007 Phone Call Roger C. left a voice mail asking him to call and schedule an office visit to go over his USR application. 07/30/2007 Office Visit Larry Carrol & Mario Calderon came to the SW Office and met with Roger Caruso and I. First off the USR and RE processes are two very separate and distinct applications . One does not have to be done in conjunction with the other i .e. Mr. Calderon can proceed with the USR application and not the RE application (the USR is necessary in order to correct the violation however) . To answer your other question, yes, the application can be amended through the process and lower standards applied. It will more than likely require reworking after Staff comments have been drafted (note: staff may determine the changes are substantial and have you start from the beginning - this is usually the case if the intensity increases) . However, I am under the belief that we can strike any comments that would not pertain to the RV storage if your applicant chooses to proceed with the construction business . I hope that clarifies your question. Planning Staff would prefer a complete accurate application but during the USR process some things do change and we understand that. I will attempt to clarify Mr. Calderon's options so he can make an informed decision. I also understand the timeliness of our response and finalization of the application as the 1 hearing has already been extended. The only item that I did not get an answer on was if part of the USR/RE application was denied or was challenged by the neighbors could the applicant continue on with a revised application and complete the process with only a portion of the project? In the meeting planning staff informed the applicant in order to correct his current violation a USR application needed to be submitted for the construction business. The applicant indicated in the meeting that he would also like to conduct an Rv storage yard on the property. Planning staff indicated that the applicant could apply for both uses under one USE application. The applicant can apply for two separate USR's for the two different uses if he so chooses. If he elects to apply for two separate USR' s two fees would be required. If the applicant would also like to subdivide his property that is a separate process (Recorded Exemption) which is not related to the violation. The Department of Planning Services is more then willing to hold a pre-application meeting with the applicant but please be aware of the time constraint regarding the violation on the property. A complete application needs to be submitted to the Department of Planning Services before Nov. 13, 2007 for the violation to be placed on hold and the violation hearing to be cancelled. 2 Let me know if you have any other questions . I sent this question yesterday and did not hear from either of you, so I ' ll ask again. Should we continue the application/process as we have currently submitted OR because of the unresolved violation should we separate the issues and only address the contracting business on the owner's property?? I had a meeting with Mario again today and he was understanding that the USR for his business use was only a formality - that by his applying for the USR, he would be granted the conditional use on his primary property and that the public hearing was only for the new proposed RV storage and lot separation. Since I was not at the previous meetings I am not aware of what was discussed with Roger nor am I sure there was complete understanding as to the process and required criteria. Mario's first concern, though, is the ability to keep his business equipment on his personal property. So, if there is less confusion with only addressing one issue, he is willing to remove the RV storage yard and lot separation from the application and concentrate on the resolution of the current violation. We intended on having a "pre-application" meeting at least a couple of weeks before the Violation Hearing date (10/09/07) . Subsequently, at the Violation Hearing on 10/09/07, I requested that the Board continue the Violation Hearing to the November 13th Violation Hearing date, since the application was deemed incomplete. I explained that it still need building/zoning permits. I also explained that he wasn't being taxed for it. He said he just uses it for storage. I explained that the Weld County Code no longer offers mobile homes as storage units. It would simply need to be removed. He then asked about the vacant lot to the South of this lot. He indicated that he owns both lots. He said he is interested in putting an RV Storage Yard there. I went and got Roger Caruso. Roger and I sat down with him and walked him through the USR application. We explained that as long as he was going to do a USR application for the property he currently lives on (due to the operation of a construction company), he might as well include both lots. It would save him money and time. We told him to really take some time to think about what exactly he wants to do and then he should call in and schedule an appointment with Roger and I so that we could point him in the right direction.
