Upon review of my case files and computer, an active Zoning Violation (VI-0500216) was noted. This
violation was initiated due to the operation of a commercial auto repair facility and storage of multiple
derelict vehicles. This case was presented to the Board of County Commissioners through the Violation
Hearing process on February 14, 2006. The Board of County Commissioners referred this case to the
County Attorney's Office, but delayed legal action for 30 days to allow Mr. Ridnour additional time to
complete and submit this Use by Special Review application.
This application if approved by the Board of County Commissioners, will correct the violation. If this
application is denied, the business and all storage shall be removed within 30 (thirty) days of denial;
otherwise, the County Attorney's Office will proceed accordingly.

Site Specific Development Plan and Special Review Permit for Mechanic Shop in a Agricultural
Zone District.

There are three historical building permit on record for this parcel or address: BP19247 was
issued for a 30'X 36' garage , BP32214 roof over existing deck, BP246572 bedroom addition, and
a violation VI-0500216
1. All existing out buildings to be used in the business are required to obtain building permits for
any change of use.
All buildings will require:
a. Plot plan showing exact location of buildings on property
b. Floor plan of each building , with dimensions of each portions of building
c. Description of specific uses of all area ,existing and proposed
.d Type of construction for each building
e. Type of heating equipment
f .Size of electrical service
2 .A plan review is required for any additional building. Plans shall bear the wet stamp of a
Colorado registered architect or engineer. Two complete sets of plans are required when
applying for each permit.
3. Buildings shall conform to the requirements of the various codes adopted at the time of permit
application. Currently the following has been adopted by Weld County: 2003 International
Building Code, 2003 International Mechanical Code, 2003 International Plumbing Code, 2002
National Electrical Code and Chapter 29 of the Weld County Code.
4. Each building will require an engineered foundation based on a site-specific geotechnical
report or an open hole inspection performed by a Colorado registered engineer. Engineered
foundations shall be designed by a Colorado registered engineer.
5 Building height, setbacks and offset distance shall be determined by the Zoning Ordinance.
Separation of buildings of mixed occupancy classifications shall be in accordance with Sec.
R309.2 of the International Residential Code.

6. Building height shall be measured in accordance with the Building Code for the purpose of
determining the maximum building size and height for various uses and types of construction and
to determine compliance with the Bulk Requirements from Chapter 27 of the Weld County Code.
Building height shall be measured in accordance with Chapter 23 of the Weld County Code in
order to determine compliance with offset and setback requirements. Offset and setback
requirements are measured to the farthest projection from the building.
7. A Flood Hazard Development Plan shall be submitted for buildings constructed within the 100-
year flood plain

Environmental Health Services has reviewed this proposal for a Mechanic Shop. We
have no objections to the proposal, however, we do recommend that the following
conditions be part of any approval:
We recommend that the following requirements be met prior to allowing the plat to be
recorded:
1. The applicant shall submit a dust abatement plan for review and approval, to the
Environmental Health Services, Weld County Department of Public Health &
Environment.
2. The applicant shall submit a waste handling plan, for approval, to the
Environmental Health Services Division of the Weld County Department of Public
Health & Environment. The plan shall include at a minimum, the following:
1) A list of wastes which are expected to be generated on site (this should
include expected volumes and types of waste generated).
2) A list of the type and volume of chemicals expected to be stored on site.
3) The waste handler and facility where the waste will be disposed (including
the facility name, address, and phone number).
We recommend that the following requirements be incorporated into the permit as
development standards:
1 . All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for
final disposal in a manner that protects against surface and groundwater
contamination.

2. No permanent disposal of wastes shall be permitted at this site. This is not
meant to include those wastes specifically excluded from the definition of a solid
waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.,
as amended.
3. Waste materials shall be handled, stored, and disposed in a manner that controls
fugitive dust, fugitive particulate emissions, blowing debris, and other potential
nuisance conditions.
4. The applicant shall operate in accordance with the approved "waste handling
plan".
5. Fugitive dust and fugitive particulate emissions shall be controlled on this site.
The facility shall be operated in accordance with the approved dust abatement
plan at all times.
6. This facility shall adhere to the maximum permissible noise levels allowed in the
Residential Zone as delineated in 25-12-103 C.R.S., as amended.
7. Adequate handwashing and toilet facilities shall be provided.
8. The facility shall utilize the existing municipal sewage treatment system. (Saint
Vrain Sanitation District)
9. The facility shall utilize the existing public water supply. (Central Weld County
Water District)
10.A permanent, adequate water supply shall be provided for drinking and sanitary
purposes.
11.The operation shall comply with all applicable rules and regulations of the State
and Federal agencies and the Weld County Code.

Dear Ms. Martin:
I have reviewed the submitted material pertaining to the Site Specific Development
Permit and Special Review Permit for a Mechanic Shop in.the Agricultural Zone District
at 4961 Weld County Road 24.75 (Case Number: USR-1556, Case Name: Ridnour).
The Fire District does not object to the use of the existing buildings as a shop provided
that the District can conduct an inspection of the buildings and order any corrections
needed to be made; however, any new construction on the property will have to meet the
current requirements of the District. Additionally, the tanks used for the gasoline, waste
oil, antifreeze, etc. must be approved by the Fire District.
• All new buildings, shall be designed and constructed in accordance with the
provisions of the Uniform Fire Code, as ratified by the Weld County
Commissioners. All plans for future construction must be submitted to the Fire
District for review and approval prior to the issuance of building permits.
• Water supply for fire protection must be provided for any new structures built on
the property. Currently, there does not appear to bee an adequate water supply for
fire protection (fire hydrants) in the area. If the existing shop were added onto,
the building would be approximately 1700 square feet of type V-N or V-B
construction. A minimum fife flow of 1,500 gallons per minute, measured at a
residual pressure of 20 pounds per square inch would be required. This water
supply would need to be provided by at least one fire hydrant located such that it
is within 450 feet of all portions of the building(s).
• Fire apparatus must be provided to the property and all buildings. All apparatus

access roads designed and maintained to support the imposed loads of fire W
apparatus (75,000 pounds), must have a surface that provides all-weather driving
capabilities, and be free from obstructions which includes locked gates, unless
otherwise approved. "100"

The Weld County Public Works Department has reviewed this proposal. This project falls primarily under the
purview of the Use by Special Review, Weld County Code, Chapter 23, Article II, Division 4, Section 23. Our
comments and requirements are as follows:
COMMENTS:
WCR 24.75 is a local gravel road and requires a 60-foot right-of-way at full build out. There is presently a 60-
foot right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld
County Zoning Ordinance (23-1-90), the required setback is measured from the future right-of-way line.

., the Weld County Zoning Ordinance (23-1-90), the required setback is measured from the future right-of-way
line.
REQUIREMENTS:
Access: The proposed USR has two existing gravel accesses to the property. Utilize the existing accesses.
Parking and Circulation: The applicant needs to identify on the plat parking spaces to determine how many
vehicles can be parked at numerous locations. The applicant is also identifying a proposed six-foot gate
between the new proposed shop area. If you are proposing to move vehicles through this area, the gate is not
wide enough.
The access width requirements for emergency equipment (fire department) are a minimum of 20 feet. The
applicant indicated that it has been cleared with the fire department and emergency services that the width and
weight capacity of the access lane shall be adequate for emergency purposes. The applicant shall provide
documentation to that effect.
Storm Water Drainage: The historical flow patterns and run-off amounts will be maintained on site in such a
manner that it will reasonably preserve the natural character of the area and prevent property damage of the
type generally attributed to run-off rate and velocity increases, diversions, concentration and/or unplanned
ponding of storm run-off.
The applicant must take into consideration storm water capture/quantity and provide accordingly for best
^anagement practices.
