RESOLUTION
RE: APPROVE CANCELLATION AND RELEASE OF COLLATERAL FOR PLANNED UNIT
DEVELOPMENT FINAL PLAN, PF #1000, FOR NESTING CRANE RANCH -
STENERSON, OLSON AND LOWRY DEVELOPMENT, LLC
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, by Resolution dated May 11, 2005, the Board approved the application of
Stenerson, Olson and Lowry Development, LLC, 3040 South Newcombe Way, Lakewood,
Colorado 80227,fora Planned Unit Development Final Plan, PF#1000,on the following described
real estate, to wit:
W1/2 W1/2 NE1/4 of Section 30, Township 3 North,
Range 68 West of the 6th P.M., Weld County,
Colorado, and
WHEREAS, on June 15, 2005, the Board of County Commissioners of Weld County,
Colorado, approved an Improvements Agreement According to Policy Regarding Collateral for
Improvements(Public Road Maintenance)for Nesting Crane Ranch, between the County of Weld,
State of Colorado, by and through the Board of County Commissioners of Weld County, and
Stenerson, Olson and Lowry Development, LLC,with terms and conditions being as stated in said
agreement, and accepted collateral in the total amount of $445,139.00, and
WHEREAS, the Board subsequently, through Resolutions#2005-3396, dated November
21, 2005, and #2005-3681, dated December 21, 2005, released portions of the collateral to the
applicant as improvements were completed, and
WHEREAS, on February 8, 2006, the Board approved Resolution #2006-0421, partially
releasing collateral, in the amount of$6,255.00, retaining 15 percent($10,636.00)for a one-year
period as paving warranty, and
WHEREAS,the Board is currently holding cash collateral,in the amount of$10,636.00,and
WHEREAS, staff from the Weld County Department of Public Works has conducted a
visual inspection and recommends a release of said collateral, in the amount of$10,636.00, and
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that collateral being held, in the amount of $10,636.00 be, and hereby is,
cancelled and released.
BE IT FURTHER RESOLVED by the Board that the Clerk to the Board be, and hereby is,
directed to return said collateral to the appropriate issuing party.

Release of On-site Warranty Collateral for Case PF-1000, Nesting Crane PUD in the
amount of$10,636.
According to the Improvements Agreement dated May 9,2005, this alignment will be
turned over to Weld County Public Works for future maintenance. See the attached
memorandum from Tracy Dyer, Lead Construction Inspector.
The appropriate documentation is attached.

RE: Nesting Crane Ranch PUD, PF-1000
Dave,
At the written request of the owner (Jeff Olsen) / partnership, I have completed a final inspection of the
above-mentioned minor subdivision and have found the site to be acceptable for final approval. This
project was substantially completed in February 2006, at which time the project entered the warranty
period. An amount of $10,636.00 is being held in collateral for the on-site warranty collateral. It is my
recommendation that these monies be released, as there are no major defects in the pavement surface.
According to the improvements agreements made on May 9th, 2005, this alignment will be turned over to
Weld County Public Works for future maintenance.
