Dear Sirs:
Enclosed for your information and retention is a copy of the
recent Executive Order proclaiming a state of disaster emergency in
Weld County issued by Nancy Dick as acting Governor. This Executive
Order paves the way for State assistance to be provided as required.
At the present time the evaluation process is ongoing to de-
termine what specific State assistance should be provided and in
what form. It is anticipated that this evaluation will be completed
shortly. In the meantime if I can be of assistance, please let me
know.

EXECUTIVE ORDER
PROCLAMATION
DISASTER EMERGENCY
WHEREAS, on February 10 , 1980 , the Prospect Reservoir Dam in south-
central Weld County failed, resulting in widespread flooding
damage to farms , farm homes , irrigation systems , and county
roads ; and
WHEREAS, the Weld County Commissioners have declared the Prospect
Valley area of Weld County to be a disaster area and , that
the cost and magnitude of responding to and recovery from
the impact of the flooding to be far in excess of Weld
County' s available resources ; and
WHEREAS , immediate attention is required to protect the public health ,
reduce further damage , ensure public safety, and render emer-
gency relief; and
WHEREAS, I , Nancy Dick, Acting Governor, do find that the aforemention-
ed conditions constitute a threat to the safety and welfare
of the State , and create an emergency disaster situation with-
in the meaning of Section 28 -2-104 , C. R. S . 1973 ;
NOW, THEREFORE, under the powers vested in me under Section 28-2- 104 ,
C. R. S . 1973 , and other enabling Provisions , I , Nancy Dick, Acting
Governor of the State of Colorado , do hereby declare Township 1 and
Township 2 North, Range 63 West , and Township 1 and Township 2 North,
Range 64 West of the 6th P.M. , Weld County, Colorado , to be a disaster
area , entitled to aid, relief, and assistance .
This Executive Order shall expire thirty (30) days from the date here-
of unless further extended by Executive Order.

Dear Governor Lamm :
The Board of Weld County Commissioners requests State
Disaster Assistance funds for the repair of County roads
damaged by the floodwaters from the collapse of the Prospect
Valley Reservoir on February 10 , 1980 . Attached is a copy
of the resolution adopted by the Board on February 13 , 1980 ,
declaring a County disaster area as a result of the flooding .
Impact on County Roads : County roads were significantly
damaged in twelve locations . Damages include complete
washouts , partial washouts , culvert damage , and bituminous
surface loss . Some sections of the roads are still inacces-
sible to complete inspection and estimates . Attached is a
detailed estimate of labor, equipment and material costs
both for County repair of the damage and for private con-
tractor repair . It is estimated that repairs could begin
within two weeks if there is no additional snowfall and
would probably require 20 working days to complete . The
total estimate for County repair is $121 , 000 ; if repair is
supplemented by private trucking firms , the estimate is
$146 , 000 .
Weld County ' s Ability to Respond : Weld County ' s ability to
provide financial resources , labor and equipment is limited
by the following factors :
1) The Contingency Fund has a balance of approximately
$500 , 000, which is slightly over 1% of the County ' s
total operating funds . In terms of sound financial
practices , that fund is at a minimal level ; if we were
required to commit even $100 , 000 of that amount to the
current disaster situation , Weld County would be left
in a tenuous financial position for the remaining ten
months of 1980 .
2) The Road and Bridge Fund has been seriously impacted by
the inflationary trend in petroleum products ; the cost
of paving materials and fuel has approximately doubled

over that of one year ago. At the same time , HUTF
receipts have been projected to decrease by 3% - 10% .
Weld County made several significant changes in the
1980 budget in order to shift available dollars to meet
urgent road and bridge needs . The Board transferred
$350, 000 in long-range capital project funds and
committed virtually the total of Revenue Sharing funds
available in 1980 to supplement road and bridge projects .
As you know, record levels of snowfall this season have
added to Weld County ' s financial problems , and there
remains the real possibility of more snow emergencies
in the next two months .
3) The Board has determined that a combination of County
and private resources could minimize the cost of repairs ,
yet cause less disruption to other County road and
bridge efforts . The Board proposes to use County crews
and equipment, supplemented by private trucks and
drivers for hauling fill and gravel . County staff is
in the process of obtaining firm quotations from private
trucking firms in the County to allow development of
actual costs for implementing the combined County/
private contractor operation outlined above .
4) As a result of the County work schedule of 50 hours per
week during the 1979 construction season , our construction
crews are presently taking earned compensatory time.
Crews were scheduled to take their earned comp-time
during the winter months in order to be available for
the spring construction season . However , due to the
extent of the snow removal required, the crews were not
able to take their comp-time as scheduled . In order to
use County crews to make flood repairs during the next
month, yet still allow regular construction activities
this spring on seriously deteriorating roads , Weld
County is faced with paying the construction crews at
overtime rates for flood repairs .
5) Last year ' s heavy rains and snow levels are compounding
deterioration of roads in the County to the point that
it will take several more years of meeting graveling
and construction goals to even approach an adequate
level of maintenance . The 1980 work plan calls for
graveling of 500 miles of road with the resources
available ; some 2000 miles are seriously in need of
gravel , along with many more miles of paved road in
need of patching , overlay , or reconstruction . For these
reasons , we believe it is imperative that County trucks
and personnel be utilized on graveling operations
throughout Weld County, with private trucks and drivers
used on flood-related hauling. Any County funds ,
construction crews , or equipment committed to flood

repair efforts without reimbursement of expenses may
require cancellation of scheduled projects later in
1980 .
Assessment of Agricultural and Private Losses : The Board
has received estimates of private losses from two sources ,
which on the surface , appear quite disparate . A disaster
assessment committee comprised of representatives of the
ASCS , the SCS , FHA, and Weld County ' s Extension Agent , has
submitted a request for $350 , 000 in federal Emergency
Conservation Program funds to assist with agricultural
losses . The figures given to the Board include :
Damage to 3000 acres of agricultural land
-- irrigated land , 2000 acres
-- pastureland , 400 acres
-- dryland , 600 acres , 200 acres of which
was planted to wheat with estimated crop
loss of $20 , 000 .
Repair cost for the Henrylyn Canal was included in the
$350 , 000 figure .
Although the committee identified three houses in the
area which had basements flooded , Emergency Conservation
funds would not be available to compensate for these
damages . Neither did the committee specifically identify
equipment losses .
The second estimate of possible damages was submitted to the
Board on February 19th by District Manager Lawrence Gerkin
and other representatives of the Henrylyn Irrigation District .
Estimates included the following :
Farmland $1 ,000 , 000

Machinery 250 , 000
Ditch repair 20 , 000
Dam repair 250 , 000
$1 , 620 , 000
We forward both estimates for evaluation by you and your
staff in recognition of the expertise that both groups have
in identifying and assessing the damages .
Financial Commitment by Weld County/Funding Request : In
light of the limiting factors and the critical need for
available resources on other County roads , the Board believes
that Weld County cannot at this time commit additional
resources without jeopardizing long-range program needs . We

are assuming the cost of overtime pay for Sheriff ' s Office
personnel on duty during the flooding, as well as other
administrative costs , but we must ask your assistance in
locating and obtaining supplemental funding for all or as
great a portion of the estimated $121 , 000 - $146 , 000 for
which funding can be made available . We recognize that any
funding level set would be for reimbursement of actual
expenses incurred in repairing flood damages , and the pro-
cess of itemizing all flood-related expenditures is already
underway.
If you have any questions , or if you require further infor-
mation in this matter , please do not hesitate to contact us
immediately. Please accept the Board ' s thanks for your
concern and responsiveness to Weld County ' s needs during our
emergency situations .
