We have the following feedback: 1) we can not act as your consultants regarding the truck wash design, 2) there are no guarantees that currently proposed design will meet the state groundwater standards at the end of the pipe. Now for the good stuff: 1) based on some research that Rick did it appears there may be some modular treatment units that could help the truck wash effluent meet the state groundwater standards, if they are not met with only the oil water separator, 2) this can be best evaluated by an environmental professional/water treatment engineer if needed. They are very useful as professional consultants in this area, 3) please do not release any water to the pond prior to determining if the constituent concentrations are less than the state groundwater standards. We won't really know the answer to this question until you wash some vehicles, capture the water and have it analyzed. 4) collect water samples for volatile organic constituents, poly aromatic hydrocarbons, and dissolved metals. You may contact an environmental laboratory for procedures regarding the samples containers, protocols, requirements. Please contact us prior to collecting and analyzing the sample to verify that the corrects tests are being run. In addition, the lab may also recommend an environmental professional firm for the collection and handling of the samples, 5) Please provide a closure plan for the oil/water separator in accordance with the solid waste regulations section 2.5 (see below) . This should be very simple such as cleaning the until, disposal of any residuals, and verifying that the unit is clean. 6) Please provide procedures for handling the potentially contaminated soils including their treatment, testing, and final disposal ( I believe you were already discussing some of this information with Waste Management) . 7) if there is a chance that the pond will ever overflow into the creek, then the facility must get a stormwater discharge permit. You may contact the Water Quality Control Division at 303-692-3500 and ask for the public assistance person for the Permits Unit. We will work with you and the facility folks to help resolve any outstanding issues related to this site. If the water from the oil/water separator does not meet the state groundwater standards, we recommend retaining a water quality professional and we will meet with them and you to create and evaluate options to upgrade the design to ensure compliance with the regulations. In particular please see their anticipated schedule which I will request that they revise and will have included as Exhibit B for both the onsite and offsite improvements agreements. This project is no different than many others that we process. Progressing to building construction should not occur until we have agreements and surety in place to protect the County and public in the event of their failure to complete the approved offsite and onsite improvements. As we discussed, we should not release this project any further than for a grading permit until they have signed both improvements agreements and posted the bonding. Not having seen a pavement design or final plans for WCR 13 at this point leaves very little time to finalize those agreements and for them to obtain the bonding by the July 9 they proposed for foundation construction. Therefore, their proposed construction schedule will likely fall apart. They propose paving WCR 13 in late October; that may be too late if we have an early winter, I am going to request that they move the completion of paving up to September 30. It is important that there is consistency in the County's response to Gerrard that we will need those signed agreements and bonding and a revised construction schedule. Comments made herein may not be all-inclusive, as other concerns or issues may arise resulting from the applicants'responses to this memorandum. These comments apply to the Weld County Road 13 plans prepared by Nolte Engineering, dated May 21, 2007. The construction plans have not been stamped, sealed, or signed by a professional engineer licensed to practice in the State of Colorado. The site is located approximately '/z-mile south of US Hwy 34 near the border of Weld and Larimer Counties in Weld County, Colorado. The proposed Gerrard yard site(USR-1584)accesses onto WCR 13. Comments: t. Public Works has reviewed and redlined a set of the WCR 13 construction plans. To be accepted, the construction plans must be stamped, sealed, or signed by a professional engineer licensed to practice in the State of Colorado. Nolte will stamp the drawings. 2. Sheet RD01 of the WCR 13 road plans has notes on the typical road cross-section stating that the asphalt pavement depth will be "as per the geotechnical engineers report". No geotechnical report was submitted to Public Works. The applicant is requested to submit the geotech report and show on the plans a proposed pavement design including road base type and thickness and asphalt thickness suitable for their proposed heavy truck traffic. The designers are working on this item. Expected to be complete by 6-27-07. 3. The proposed road profile plans prepared by Nolte Engineering depict acceptable re-grading to address the railroad crossings. No action required. 4. The WCR 13 road plans show only"typical"roadside swale cross-sections. Sufficient topographic information is available to provide the proposed grading on the plan views. The applicant is requested to show the grading of the swales, their needed culverts and other details so that the plans can be used for construction and verified in the field. Flexibility for unforeseen variations is acceptable,but having no swale grading plans at all is not. Nolte will address this item. Will be submitted with the geo report on or abour 6-27-07 5. Please provide an erosion and sediment control plan for the proposed WCR 13 work. All activities (grading, utility installation, excavation, demolition, and others) shall comply with the surface water quality regulations and requirements of the Clean Water Act enforced by the CDPHE, Water Quality Control Division. The construction area is less than 1 mile from the Big Thompson River, and vigilance in stormwater management is the responsibility of the applicant. Nolte will address this item. Please describe what will be done with any surplus materials resulting from the regrading of the road. The current estimate indicates there will be approximately 677 CY net cut. This excess material is intended to provide shoulders where possible without interfering with existing ditches, etc. Any additional material will be stockpiled on the Gerrard site or used to fill in an anticipated borrow area when the site is graded. 7. Please submit a set of construction drawings that has been stamped, signed, and dated by a professional engineer licensed to practice in the State of Colorado. Nolte will stamp the drawings. Will be submitted with the geo report on or abour 6-27-07. Construction in the ROW of WCR 13 will require road closure, traffic control, and a detour plan. Please provide the information needed to determine the dates, locations, and extent of these. We respectfully request that the design gets approved without this requirement at this time. The costs and initial discussions about need have taken place with Carnes Services. Carnes noted that the plan will have to be coordinated with other road considerations in the area. A plan at this time is premature. Note that WCR 13 was scheduled for construction after the maintenance facility so that the roadway could be kept clean during site construction activities. If all goes well and we can get started with the shop by July 1,then the road construction could start on or about mid October or the 1st of November. Given the anticipated time line traffic considerations would reasonably change from a plan prepared at this time. Note: The anticipated schedule is as follows: a. Site grading 6-21-07 to 7-6-07 b. I thought it would be easier to provide you with an update in writing. While I haven't gotten all of the agency review comments yet, included are those from our(Planning) review of the submittal. I think that you have received comments from Char. As you know from her letter, all of the Health Department's conditions have been met, with the exception of the washing area. It sounds like the State will complete their review in a couple weeks, so we should just continue towards producing a mylar, anticipating that that will be resolved before the actual recording. I anticipate hearing from Public Works in the next couple days. Overall, the submittal was very thorough and complete. There are a couple of items related to the USR exhibit that should be addressed prior to creating a mylar: • Is there any way to add a title block to the upper center of each of the 3 pages? This is only a request, not a requirement at this point. (At a minimum, add the Section/Township/Range info to the side title.) The D title block would read: Use by Special Review USR-1584 SW4 Section 18, Township 5 North, Range 67 West of the 6th P.M. Weld County • Please show and provide wheel stops for each of the (non-covered) parking spots, per Condition 1.1.8. ✓, 4*�; 1,4,7 6.act* • Please add a Note to Page 2, indicating that there is an irrigation system proposed that will support maintenance of the landscaping, per Condition 1.1.4 (Landscaping review letter comment). • Please call out a minimum plant size for each of the proposed plants. (These should be large enough to / be viable and provide some screening upon planting.) • Please re-locate the proposed monument sign, to be setback from the future ROW 1 foot for every 3 feet of sign height, or a minimum of 3 feet. (Setbacks are measured from the future ROW.) The draft plan shows V it directly on the ROW line. See Section 23-4-120-D. • Change the Sign Note to refer to Section 23-4-60 (not 23-4360). • The lighting note generally addresses the issue of off-site light trespass. However, the description in the legend of a"proposed light pack"suggests a light fixture that is not a true cut-off, downward-facing light, which would shine directly onto adjacent properties. Please confirm that all light fixtures are a type that will / / ( not allow trespass. Also, please clarify where the"flood lights" indicated at the southeast corner of the yard `T"w are actually located. (Are they the circular symbol? Or is that part of the symbol for the fence?) E'4. • Please clarify the type of"proposed fence" (3-rail? 6'wooden? etc.)and revise the note for the fence. / • Please clarify or fix the discrepancy between Page 1 and 2 of the office building's distance from the ROW. (Is it 178.5, or 176.5?) Also, please call out the distance of the line on Page 2 from the ROW(15'?). ✓ 06/08/2007 Page 2 of 2 • Please remove the Signature Certificates from Pages 2 and 3. The Boards and owners will only need to sign Page 1. Please note that Planning staff did not receive a copy of any of the proposed Improvements Agreements (on-site o and off-site). With these minor items addressed on the USR exhibit, you are ready to submit a signed (owner only) mylar for us to record (assuming no revisions required by Public Works). (Don't forget to also provide the $31 recording fee.) If you would like me to take a quick look at the copy with these revisions, however, I am happy to do so. You can either provide a revised hard copy or an electronic copy; I would let you know within a day if there were concerns with how the items above were addressed. Once we have signed copies of the I.A.'s, and have them approved by the Board, then we can record the mylar and release building permits. I understand from Frank in the Building Division that you are interested in getting an early grading permit before then; once we have Public Works comments,we can look at the possibility of authorizing an early grading permit. The closure notice can be sent via e-mail, by mail, or by fax. Many local fire departments also require advance notice of tank closure. It is advisable to contact your local fire department prior to closure to ensure you comply with its requirements. Permanent closure of a UST can be accomplished by either removing the tank or by filling it with an inert substance. Permanent closure of an AST can be accomplished by removing the tank or by safeguarding it pursuant to the regulations. Change-in-service for a UST or AST means continued use of the tank to store a non-regulated substance. Notification is not required if the change is from one regulated product to another, such as from gasoline to diesel. Permanent closure or change-in-service of a UST or an AST requires that the tank be emptied and cleaned and that a site assessment be conducted. If a release or suspected release (contaminated soil, contaminated groundwater, free product, or vapors) is discovered, it must be reported to the Division of Oil and Public Safety within 24 hours. The release or suspected release must be investigated and confirmed within 7 days. If necessary, further assessment and remediation activities must be conducted. Operation Gerrard is an excavating contractor and as such, the only waste related issue is with accumulated mud and dirt and the wash water. The wash bay is used for de-mudding equipment before it enters the shop for maintenance or for general cleaning maintenance. Heavy equipment and trucks are pulled into the wash bay. Depending on type of accumulated particulates,the equipment will be washed with: 1. Cold water pressure wash—accumulated particulates (mud) 2. Hot water pressure wash—accumulated road grime, (mud and oils) Sediment - The wash water and mud travels to the low point of the wash pad into a three chamber separation pit partitioned off by two removable weir walls. The sediment, (mud) settles to the bottom. Clean dirt — from accumulated mud from normal dirt work operations. 2. Contaminated dirt — from chronic oil leaks that cause build-up over time usually on the underside of equipment. The clean dirt will be stockpiled and for used for fill . The contaminated dirt shall be stored separately and shall be disposed of pursuant to state regulations and guidelines. Wash Bay Calculations, Exhibit"B", and"Grading Plan", Exhibit "C", show that because of the size of the detention pond the impact of the wash water is minor. In other words, it is reasonable to conclude that most if not all discharged wash water will likely evaporate before it reaches the outlet of the detention pond. The other factor to be engineered for the detention pond is infiltration. Pursuant to a conversation with Rick Koplitz, from the State of Colorado Water Quality Dept., infiltration must meet a standard of no more than Y4 inch per day. Note that this calculation is the same as the anticipated evaporation calculation. Preliminary information from the Soils Engineer indicates that the soils on this site,when compacted, can meet this requirement. When evaporation and infiltration are considered together, the wash bay impact on the detention pond and the downstream discharge considerations is very small. Detergents - The anticipated product for the wash bay operation is called "Blast Away" manufactured by ZEP. The "Product Specification Report" and the MSDS sheets are included as Exhibits D & E. The label and the product spec sheet state "The detergents used in the manufacture of this product are biodegradable". An alternative product is manufactured by Hotsy. The spec sheets are also included for this product, Exhibit F. The detergents are biodegradable and are USDA and agriculture approved. GERRARD shall provide a pavement design and road construction plans for the entire truck route within the Weld County Road maintenance area for review and approval by the Public Works Department. Pavement shall be required from the Union Pacific Railroad crossing north to U.S. Highway 34, approx. 2800' feet as shown on the plot plan, Sheet 01, dated 7/14/2006. B. GERRARD shall complete the Off-site Improvements Agreement associated with the proposed operation facility and as outlined in this agreement prior to commencement of truck traffic. 1. GERRARD shall start working on truck route improvements within six (6) months of signed agreement and be completed in approximately six (6) months from the start of the road construction. C. GERRARD will provide testing services and inspection for the construction of the improvements. The COUNTY will only provide oversight. A registered professional engineer, registered in the State of Colorado, shall provide the COUNTY with a letter that certifies the proper installation of the improvements. D. GERRARD shall pay 100% of the improvements on WCR 13 from Union Pacific Railroad crossing north to U. S. Highway 34. See attached Exhibit. E. The safety improvements shall include: construction of adequate turning radii at the main entrance on to WCR 13; and paving 24 feet in wide with four foot gravel shoulders where possible from the Union Pacific Railroad crossing to U.S. Highway 34. F. The engineering design and construction plans shall be the responsibility of GERRARD. The applicant shall provide the COUNTY with construction drawings that detail the required improvements. The plans shall consist of, at a minimum; main entrance intersection layout and grading, cross section, approach road, adequate turning radiuses, Great Western Railroad Crossing, and a geometric recommendation on depth of additional asphalt overlay to accommodate heavy truck traffic. These plans will require approval by the Public Works County Engineer or his representative. A registered professional engineer, registered in the State of Colorado, must prepare the construction plans. The plans, when reviewed and approved, will constitute a section of this agreement. They will be attached hereto and referenced as Exhibit "A". Before the installation of asphalt, the subgrade shall be inspected by review of compaction tests and an acceptable proof roll. If the tests and proof roll meets typical Weld County road construction criteria, the subgrade shall be approved by the COUNTY. Upon completion of all the improvements, the registered professional engineer referenced in Paragraph D above shall issue a letter certifying proper installation and completion. Receipt of this letter by the COUNTY shall constitute completion of the improvements. G. GERRARD shall warrant and guarantee WCR 13 improvements for a period of one year after completion and acceptance of said improvements as being completed in accordance with the engineering design and construction plans by the Weld County Public Works County Engineer or his representative. Securi H. Prior to commencement of construction of the WCR 13 improvements, GERRARD shall provide the COUNTY security in the form of a performance bond, letter of credit or other financial mechanism conforming with COUNTY policy on collateral for improvements to roads or highways. The amount of such security shall be 100% of the estimated cost. The COUNTY shall release the letter of credit upon final completion of the improvements, referenced in Paragraph G. Maintenance Upon completion of the one-year warranty period described in Paragraph H above, the COUNTY shall assume full responsibility of the maintenance on WCR 13. Nothing herein shall be construed to relieve GERRARD or any third-party from normal liability to the COUNTY for the cost of damages to the aforementioned roadways that may be caused by the negligence or unlawful acts of GERRARD or a third-party. CDOT Improvements J. GERRARD shall address all the Colorado Department of Transportation (CDOT) access issues at the intersection of U.S. Highway 34 and WCR 13. The COUNTY shall provide any information required by CDOT for this purpose in a timely manner. 1. Prior to the start of the operation facility, the COUNTY AND GERRARD will document the existing condition of the roadways. This effort will ensure that GERRARD will not be held responsible for existing roadway damage, if any. 2. Failure of either party to perform any of its respective obligations hereunder by reason of acts of God, strike, or acts of any governmental agency or authority having jurisdiction over matters set forth herein shall excuse timely performance of such obligations, but shall not excuse the performance of such obligations as soon as reasonably practical. The parties may, however, mutually consent to excuse a party from performing any obligation, in whole or in part, upon a showing that performance has been rendered impracticable by reason of FORCE MAJEURE. 3. This Agreement may not be assigned in whole or in part by either party hereto without the written consent of the other party. Such consent will not be reasonably withheld,conditioned,or delayed. 4. If any clause or provision of this Agreement is illegal, invalid, or unenforceable, then it is the intention of the parties that the remainder of this Agreement shall not be affected. S. Should GERRARD sell its operation, cease operating, file bankruptcy, or in any way release ownership and responsibility of the permitted property, this Agreement as set forth herein, shall continue in full force with the property's successor. If the aforementioned release should occur before the expiration of the warranty period, GERRARD shall give a minimum notice of ninety (90) days to the COUNTY before the date of transfer. 6. All construction and material controls for a project will be in accordance with the current Standards Specifications for Road and Bridge Construction, as supplemented or revised, provided by the Colorado Department of Transportation. During construction, signage shall be posted in accordance with the most current Manual on Uniform Traffic Control Devices. 7. It is expressly understood and agreed that enforcement of the terms and conditions of this Agreement, and all rights of action relating to such enforcement, shall be strictly reserved to the undersigned parties, and nothing contained in this Agreement shall give or allow any claim or right of action whatsoever by any other person not included in this Agreement except for GERRARD's successor(s). It is the express intention of the undersigned parties that any entity other than the undersigned parties receiving services or benefits under this Agreement shall be deemed an incidental beneficiary only. 8. Indemnification: To the extent authorized by law, GERRARD agrees to indemnify, save,and hold the COUNTY harmless from and against any and all claims, damages, losses,and judgments,which may be suffered or incurred by the COUNTY as a consequence of any breach by GERRARD of its obligations and duties set forth in this Agreement on those portions of the haul route described in this Agreement. In the event that any dispute shall arise under this Agreement,the prevailing party in such dispute shall be entitled,in addition to any other relief to which such party may be granted,to recover its reasonable attorney's fees and court costs incurred in connection with the resolution of such dispute. 9. By entering into this Agreement,the parties do not intend,either expressly or implicitly,to create a joint venture or partnership. Except as provided herein, neither party shall have the right or authority to act for,or on behalf of, or to enter into,any obligations which are binding on the other party of this Agreement. 10. The meeting was held April 10, 2007. We discussed the typical cross section of WCR 13 as being two 12-foot driving lanes with four-foot gravel shoulders as being the County's minimum cross section. We also discussed adjusting the grade approach to the existing railroad crossing and the speed limits. I suggested that the applicant provide a soil investigation to determine the typical cross section for WCR 13 calculating the depth of base and asphalt section. In working with our traffic engineer, Scot Lewis, on evaluating the speed limit through the new section of WCR 13 dealing with the railroad crossing and the stop condition at U. S. Highway 85. A meeting shall be set up with Tracy Dyer or his representative on site to evaluate the typical road cross section, as there are locations that the bank is steep adjacent to the railroad tracks where the typical cross section would not fit within the existing County rights-of-way. The intent is to retain the 24-foot pavement with four-foot gravel shoulders where available. Once these items have been worked out, Nolte Associates shall provide construction drawing to our field staff for review and approval. The applicant needs to sign and complete the Off-Site Road Improvements Agreement with the Public Works Department for the upgrade and paving of WCR 13.
