RE: APPROVAL OF RECORDED EXEMPTION NO. 557 - FREDERICH AND LINDA
FANGMEIER
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, it has been determined by the Board of County Com-
missioners at a public meeting held in the Chambers of the Board,
that the division into two parcels of land, as shown on the plat
known as Recorded Exemption No. 557, being the property of
Frederich and Linda Fangmeier, described as part of the NWa SWa,
Section 11, T5N, R65W of the 6th P.M. , Weld County, Colorado,
being more particularly described in the plat which shall be pro-
vided by the applicants and known as Exhibit "A" , does not come
within the purview of the definition of the terms, "subdivision"
and "subdivided land" , pursuant to its authority under Section
30-28-101 (10) (d) , CRS 1973, as amended, said plat to be recorded.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the hereinabove described
parcel of land owned by Frederich and Linda Fangmeier be, and
hereby is, exempt from the definitions of the terms , "subdivision"
and "subdivided land" .
BE IT FURTHER RESOLVED by the Board that this approval is
conditional upon the following: 1) A special reservation of the
sixty foot access to 18th Street should serve both Lot "A" and
Lot "B" of the recorded exemption, as requested by the Greeley
Planning Commission; and 2) No septic system should be installed
west of Drain Creek or the irrigation well, as identified in the
submitted application materials.

Re: Recorded Exemption 557
Dear Commissioners:
The attached application and related itens are in reference to a request from
Frederich and Linda Fangmeier for a recorded exemption. The parcel of
land on which this request is being made is described as part of the NWT
SW1, Section 11, T5N, R65W of the 6th P.M. , Weld County, Colorado.
The property is located two miles east of Greeley on East 18th Street and
Fern Avenue. The property contains approximately 24 acres of Class II and
VI irriaged soils. The request is to divide the property into parcels of
19 acres and 5 acres, more or less. The applicants propose to build a
new residence on Lot "B", the 19 acre parcel, in order to satisfy their
personal requirements for more room for the family.
Based upon the submitted information and policies of the County, the
Department of Planning Services staff recommends the request be approved
for the following reasons:
1. The request complies with Section 9-2 C. of the Weld County
Subdivision Regulations submission requirements.
2. The request complies with Section 9-2 E. of the Subdivision
Regulations as follows:
The twenty-four (24) acres, more or less, under consideration
has a low utility for agricultural use due to the type of
farming operation and the small acreage of the parcel. These
facts support the proposal as being consistent with the intent
clause of the Agricultural Zone Distrist.

- On June 10, 1982, the proposal was reviewed by the city
of Greeley's Planning Commissions and was found to comply
with their long-range Comprehensive Plan. It also is in
compliace with Section 1-3 of the Weld County Subdivision
Regulations and the proposed land division complies with
the Weld County Comprehensive Plan; therefore, the proposed
use is consistent with efficient and orderly developments.
- Access to the proposed parcels will be served by East 18th
Street.
- A letter dated May 20, 1982, from the Weld County Health
Department indicates an adequate means for disposal of
sewage exists.
- North Weld Water is available to provide service to the
larger Lot "B", and the city of Greeley will provide water
to Lot "A", the smaller parcel.
- The proposal does not exist in an overlay district area.
- The proposed lots are not part of a recorded exemption within
the last 5 years.
- The proposed lots meet the minimum size requirements for
land division.
- The Department of Planning Services staff recommendation for
approval is conditional and based upon the following:
1. A special reservation of the sixty (60) foot access
to 18th Street should serve both Lot "A" and Lot "B"
of the recorded exemption, as requested by the Greeley
Planning Commission.
2. No septic system should be installed west of Drain Creek
or the irrigation well, as identified in the submitted
application materials.

Dear Greg :
The City of Greeley Planning Commission reviewed the Weld County
Referral for a Recorded Exemption (Case No. RE-557) for part of the
NW* SW4 of Section 11 , T5N, R65W at its June 8, 1982, meeting. The
Planning Commission recommended no objection to this request with the
special reservation of the 60' access to 18th Street to serve both
Lot "A" and Lot "B" of the recorded exemption.
The Greeley Planning Commission also reviewed the Weld County Referral
for a Recorded Exemption (Case No. RE 558) for the NE* SE* Section 22,
T5N, R65W at the June 8 meeting. The Planning Commission recommended
no objection to this request.
