RE: GRANT REQUEST TO PRE-ADVERTISE SITE SPECIFIC DEVELOPMENT PLAN AND
SECOND AMENDED USE BY SPECIAL REVIEW PERMIT #1280 - KERR-MCGEE
GATHERING, LLC
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has received a request from Kerr-McGee Gathering, LLC, 1999
Broadway, Suite 3700, Denver, Colorado 80202,for pre-advertisement of an application for a Site
Specific Development Plan and Second Amended Use by Special Review Permit #1280 for a
Mineral Resource Development Facility, including Oil and Gas Support and Services and one (1)
Radio Tower over seventy feet in height(120-foot radio tower), in the A(Agricultural)Zone District,
and
WHEREAS, said property is described as W1/2NE1/4SE1/4, E1/2NW1/4SE1/4 of
Section 13, Township 3 North, Range 66 West of the 6th P.M., Weld County, Colorado, and
WHEREAS,after study and review the Board deems it advisable to grant said request,with
the hearing date to be set as September 12, 2007, at 10:00 a.m.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the request from Kerr-McGee Gathering, LLC,for pre-advertisement of an
application for a Site Specific Development Plan and Second Amended Use by Special Review
Permit #1280 for a Mineral Resource Development Facility, including Oil and Gas Support and
Services and one (1) Radio Tower over seventy feet in height (120-foot radio tower), in the
A (Agricultural) Zone District, be, and hereby is, granted.
BE IT FURTHER RESOLVED by the Board that the hearing date to consider said request
be, and hereby is, set as September 12, 2007, at 10:00 a.m.

Kerr-McGee Gathering, LLC, has submitted a request that the application for Second Amended
Use by Special Review Permit#1280,which will be heard by the Planning Commission on August
21, 2007, be pre-advertised. If you wish to approve this request, a hearing before the Board on
September 12, 2007, will allow adequate time for advertising.

SUBJECT: Kerr McGee — Pre-Advertisement
Kerr McGee is requesting a pre-advertisement for 2nd AMUSR-1280. The applicant has
indicated in the attached letter dated July 31, 2007 that the reason for this request is to allow for
the construction of a communications network. The network will allow workers in the field to
communicate safety issues or concerns more expeditiously and reliably. The Planning
Commission hearing is scheduled for August 21, 2007. The Clerk to the Board has calculated
that the earliest the Board of County Commissioners could review this case would be
September 12, 2007.
The Department of Planning Services is recommending approval of the pre-advertisement for
2nd AMUSR-1280.

Dear Jacqueline:
The Applicant,Kerr-McGee Gathering,LLC,hereby requests consent to pre-advertise this
application for the Board of County Commissioners hearing. Kerr-McGee is in the process of
permitting a number of its properties to allow for the construction of a communications network.
One of the purposes of the network will be to allow workers in the field to communicate safety issues
or concerns more expeditiously and reliably. Kerr-McGee would like to obtain the necessary
consents in order to install the networks as quickly as possible to address these communications
concerns.
