RE: APPROVAL OF USE BY SPECIAL REVIEW FOR AN ARABIAN HORSE
FACILITY - RONALD W. AND MARGARET DuBOIS
WHEREAS , the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS , the Board of County Commissioners held a public
hearing on the 17th day of August, 1983 , at the hour of 10 : 00
o'clock a.m. in the Chambers of the Board for the purpose of
hearing the application of Ronald W. and Margaret DuBois , 5557
Aspen, Erie, Colorado 80516 , for a Use by Special Review for an
Arabian horse facility, on the following described real estate,
to-wit:
Lot 2 , Block 2 , Carmacar Ranchettes Sub-
division, Weld County, Colorado
WHEREAS, Section 24 . 4 . 2 of the Weld County Zoning Ordinance
provides standards for review of said Use by Special Review, and
WHEREAS , the Board of County Commissioners heard all of the
testimony and statements of those present, has studied the re-
quest of the applicants and the recommendations of the Weld County
Planning Commission and all of the exhibits and evidence presented
in this matter, and having been fully informed, finds that:
1 . The submitted materials are in compliance with the appli-
cation requirements of Section 24 . 7 of the Weld County
Zoning Ordinance.
2 . It is the opinion of the Board of County Commissioners
that the applicants have shown compliance with Section
24. 4 . 2 of the Weld County Zoning Ordinance as follows :
a) The proposal is consistent with the Comprehensive
Plan policies in that the use does not infringe on
continued agricultural use in the vicinity or County.
The proposal does not encourage urban use to expand
in a rural area.
b) The proposal is consistent with the intent of the
Agricultural Zone District; and is provided for as
a Use by Special Review.
c) The activities proposed will be compatible with exist-
ing agricultural and rural residential uses in the
neighborhood, as well as the projected development
in the future. The future uses will be of rural
residential and an agricultural nature. The intended
proposal will not have significant traffic or noise

d) No Overlay Districts affect the site.
e) Use by Special Review Operations and Design Stand-
ards provide adequate protection of the health,
safety and welfare of the neighborhood and County.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the application for a
Use by Special Review for an Arabian horse facility on the here-
inabove described parcel of land be, and hereby is, granted sub-
ject to the following conditions:
1 . The attached Standards for Use by Special Review be
adopted as amended.
2 . The plat for the use permit be placed of record by
the Department of Planning Services staff prior to
any building permits being issued on the site.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 17th day of
August, A.D. , 1983.

RONALD AND MARGARET DUBOIS
STANDARDS FOR USE BY SPECIAL REVIEW
1. The use permitted on this site shall be an Arabian Horse operation as
described in the application materials on file in the Weld County
Department of Planning Services. The horse breeding operation shall
not exceed ten (10) horses.
2. The permitted use shall comply with all applicable Weld County
Health Department regulations.
3. A bin shall be installed for storage of manure and used straw. The
manure and used straw shall be removed from the property every two
(2) weeks.
4. The northwest corner of the lot behind the storage shed and barn
shall be landscaped to conform with the landscaping on the southern
or southwestern property lines, i.e. , Russian Olives, evergreens or
hedging. The landscaping shall be in place in one (1) year to allow
for a fall or spring planting.
5. Design standards for Uses by Special Review, Section 24.5 et seq. of
the Weld County Zoning Ordinance shall be complied with.
6. Operations Standards for Uses by Special Review, Section 24.6 et seq.
of the Weld County Zoning Ordinance shall be complied with.
7. The Use by Special Review shall be limited to the plans shown hereon
and governed by the Standards stated above and all applicable Weld
County Regulations. Any material deviations from the plans and/or
Standards, as shown or stated above, shall require the approval of an
amendment of the Permit by the Weld County Planning Commission and
the Board of County Commissioners before such changes from the plans
and/or Standards are permitted. Any other changes shall be filed in
the office of the Department of Planning Services.
8. The property owner and/or operator of this operation shall be responsible
for complying with all of the above stated Standards. Noncompliance
with any of the above stated standards may be reason for revocation
of the Permit by the Board of County Commissioners.

** These Operation Standards were amended to include Operation Standard No. 9
which shall read as follows:
9. If the ownership of the property which contains the Use by Special Review
proposal changes, the Use by Special Review Permit, excluding the barn,
shall terminate.
ZPMH #768 - BONERS: This request is for one mobile home to be used as a
principal dwelling on Lot 2, Block 8, Aristocrat Ranchettes. The Department
of Planning Services staff recommendation for approval was conditional
upon the following:
1. The applicant shall apply for a building permit for the existing
mobile home;
2. A septic permit shall be obtained and the site shall meet perk
test requirements prior to the issuance of a building permit;
3. Prior to the final building permit inspection, the property owner
shall submit evidence that the proposed well is supplying water
in such a manner as to be adequate in quantity, quality and depend-
ability for the principal dwelling; and
4. The existing mobile have shall not be occupied until such time that
the applicant has complied with conditions 1 through 3.
Elena Bowers, applicant, stated that she does have a domestic water well,
however, she has applied for a water tap.

Mrs. Bowers stated that the septic system has been installed on this
site. Commissioner N. Carlson moved to approve this request and include
the conditions as recommended by the Planning staff. Commissioner Martin
seconded the motion and it carried unanimously.
ZPMH #769 - BONERS: This is a request for one mobile have to be used as
a principal dwelling on Lot 3, Block 8, Aristocrat Ranchettes. The lot in
question is currently vacant. The applicants have decided to apply for a
Zoning Permit for a Mobile Hone which may be located at sane future date
on Lot 3, Block 8. The application was filed simultaneously with ZPMH
#768. At such time when a mobile hest is to be placed on Lot 3, the
applicant shall comply with the following conditions:
1. The applicant shall apply for a building permit for a mobile hone;
2. A spectic permit shall be obtained and the site shall meet perk test
requirements prior to the issuance of a building permit; and
3. Prior to the final building permit inspection, the property owner
shall submit evidence that the proposed well or water tap is supplying
water in such a manner as to be adequate in quantity, quality and dependability
for the principal dwelling.
Mrs. Bowers was present and commented on her plans for the site. After
discussion, Commissioner Johnson moved to approve the request and include
the conditions as recommended by the Planning staff. Commissioner Brantner
seconded the motion and it carried unanimously.
At 9:50 A. M. the Chairman recessed the meeting and announced that the
netting would reconvene at 10:00 A. M. so the Board could consider
Docket 83-40, Use by Special Review, Arabian horse facility for Ronald
and Margaret DuBois.
At 10:00 A. M. the Chairman reconvened the meeting. The Assistant County
Attorney, R. Russell Anson, reminded the Board that this hearing was continued
from July 27, 1983, because the property was not posted ten days in advance
of said hearing. The Weld County Planning Commission recommended that this
request be approved with conditions. Mrs. Margaret DuBois stated that she
believes that her neighbors have misunderstood her request. For the last
three years the DuBoiscs have had three mares and stud on the site and
currently they have five horses on the site. Mrs. DuBois stated that during
the past six years they have service' six outside mares. The horse trailer
traffic to the site equals approximately two trailers per month. Mrs.
DuBois passed around pictures of the facility as it now exists for the
Board inspection. The applicant stressed that if her request is granted
it would not set a precedent for the Carmacar Ranchettes Subdivision.

Shelton McKim, a resident of Carmacar Ranchettes Subdivision,
opposed the request because if approved all the requests from
the subdivision will be approved. He asked the Board to oil
the road adjacent to the subdivision if they approve this request.
He contended that the request is improper because it was not posted
ten days in advance of the hearing. Mrs. DuBois stated that the
sign was posted and because of the rains it became deteriorated and
was taken down. Mr. Allison stated the DuBoises have met the posting
requirements as far as the Planning staff is concerned. Mr. Schoning,
a resident of Carmacar Ranchettes Subdivison, stated that the DuBoises
are running a neat operation and they are only trying to make it legal.
Mr. David Gehricke, a resident of Carmacar Ranchettes Subdivision,
asked what the Counts procedure really is and questioned who will
enforce the Operation Standards. Mr. Allison and Mr. Anson concurred
by saying that the Board of County Commissioners will enforce the
standards if complaints are filed. Mrs. Beverly Bainer, a resident
of Carmacar Ranchettes Subdivision, was in favor of the request and
added that during the six years that she has lived in the subdivision
she has only seen two horse trailers enter the subdivision. She also
commented on the great care the DuBdses take in caring for the horses.
Martha Lozinski reminded the Board that a petition in opposition of
this request has been signed by 53 residents of the subdivision. She
pleaded with the Board to recognize the petition. The Chairman stated
that he went to the DuBoises property and viewed the operation. He
added that the horses have been there for a long time. Mrs. DuBois
asked to see the petition and presented a letter from a lady that had
signed the petition who now would like her name removed because the
petition was circulated improperly. Mrs. DuBois presented several
letters hum her neighbors which requested that the Use by Special
Review be approved. Mr. McKim read item #7 fran the covenants of
Carmarar Ranchettes Subdivision. He agreed that the DuBois' operation
is in fine shape, he only objects to the approval of any Use by Special Review
Permit being approved in this subdivision. Mr. Schoning stated that
since the cable TV deal moved out of Carmacar Ranchettes Snhlivision
the property has gone down hill. He expressed his appreciation to
the Chairman for coning down and viewing the property. Mr. Victor Kear,
a resident of Carmacar Ranchettes Subdivision, commented on the good,
clean operation that the DuBoises run.

Mr. Allison said that there has been one other operation where the
applicant agreed that if they ever sell the property the Use by Special
Review became null and void. Mrs. Bruxvoort, a resident of Carmarar
Ranchettes Subdivision, stated that the DuBoises have a wonderful
operation. After further discussion, Commissioner Brantner roved to
approve the Use by Special Review, include the Operation Standards,
and amend the Operation Standards to include the following:
"If the ownership of the property which contains the Use by Special Review
proposal changes, the Use by Special Review Permit, excluding the barn,
shall terminate." Commissioner Johnson seconded the motion andiit carried
unanimously.
RESOLUTIONS AND ORDINANCES: The Resolutions were presented and signed as listed on the
consent agenda. There were no Ordinances.
Let the minutes reflect that the above and foregoing actions were
attested to and respectfully submitted by the Acting Clerk to the Board.
There being no further business, this meeting was adjourned at 11:00 A. M.

Dear Commissioners:
As a homeowner -living within Soo feet of the Dubois
property, I have no opposition to the Dubois ' receiving
their permit to raise horses.
Their property has been beautifully kept up for
several years, a real asset to the neighborhood. T'h-e
operation is quiet. One would not know by sight, sound,
or smell that more than four horses were in residcncea
Many residents are justifiably concerned -about
commercial' operations being allowed in the neighborhood.
I f-eel the -Dubois horses are appropriate to the agricultural
nature of the community.. I trust that distinction will
be made in considering this and any future requests for
permits.

Due to other commitments we were unable to attend this
h-earing regarding the Special Use Permit under consideration
for Ron and Peggy DuBois and Aspin Arabia Ranch. However,
we request that this letter be considered, in lieu or our
attendance as support for the approval of the special use
permit.

_reproach. It is always well kept with no evidence of any
unsanitary conditions. Manure is disposed of on a regular
basis, there are no odors and having lived most of our -lives
in city residential areas there is less noise, i .e. no noise,
than we have experienced in many residential areas, not to
mention the general appearance of the property as a whole .
We have heard that one of the major Points of contention
against the issuance of this permit is that and Krs. DuBois
intend to conduct a "production lined horse breeding oper.atior
with some unbelievable number of horses or, their property if
this permit is issued. We have seen absolutely no evidence
this will occur. We really cannot see how this could occur
as they have not done it in the past, have neither the stall
space nor the acerage required to conduct an operation of
that size, and they have assured us that this is not their
intention. We believe them. They are conscientious Arabian
breeders, seeking to better the breed. The quality of their
stock, in our opinion, supports this statement. Conscientious
breeders of any animal do not over breed their stock.
In conclusion, we urge you to approve the request for this
special use permit ais submitted by Fr. and Mrs. DuBois.

Moved by Ed Reichert that the following resolution be introduced
for passage by the Weld County Planning Commission:
Be it Resolved by the Weld County Planning Commission that the application for
an arabian horse facility located on the following described
property in Weld County, Colorado, to-wit:

be recommended (favorably) ( td OUQUI0 to the Board of County
Commissioners for the following reasons:

Possible Issues Summarized from Application Materials:
The proposal exists on the property and came to the Department of -Planning
-Services staff attention as a violation. The staff has received one phone
tail and one letter opposing this request. The compalints were about the
applicant's disregard for disposing of waste. The operation is being
scaled down from approximately ten to twelve (10-12) horses to five (5)
horses. tarmacar Subdivision is zoned Agricultural. By right the appli-
sant could have up to four (4) horses and a one-thousand-five-hundred
(1,500) square foot pole barn. The applicants are requesting five (5)
horses and a two-thousand-three-hundred (2,300) square foot pole barn.
The town of Erie was not able to schedule a hearing on this matter until
July 7, 1983. It is the staff's opinion that development standards
could be used to make this operation compatible with the neighborhood.
_Other residents do have livestock on their property.
