HomeMy WebLinkAbout20072544.tiff RESOLUTION RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL ACTION AGAINST JOHN AND NORMA HOGARTH FOR VIOLATION OF THE WELD COUNTY CODE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, John and Norma Hogarth, VI #0700043, are allegedly in violation of the Weld County Code, and WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has not been corrected, and WHEREAS, on the 14th day of August, 2007, a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violation, and WHEREAS, John and Norma Hogarth, property owners,were present at said hearing,and WHEREAS, the Board of County Commissioners deems it advisable to refer said violation to the Weld County Attorney's Office for legal action, with an instruction for delay of action upon such referral until September 11, 2007, to allow adequate time for the property owners to move the remaining camper trailer behind the screened in area, and to submit a Medical Hardship application, with the fees being waived, to bring the subject property into compliance and for an inspection of the property by the Department of Planning Services staff. I explained that I happened to notice that Mr. Hogarth's fencing was becoming very delapidated on 01/29/07. I sent my initial letter on 02/20/07. He then called on 02/28/07 and requested some time. I explained that I would grant him 60 days. I sent a 60 day letter on 03/01/07. Mr. Anderson indicated that the mobile home is no longer occupied (it is full of trash). He said they are now living in 2 (two) RV's. He said they have also added cars along the South side (outside the screened area). 01/29/2007 Property Inspected Upon a visual inspection of the property, the following items were noted: Fencing has fallen down. Torn down along the Eastern side. Derelict vehicles parked oustide of the where the Screened area is situated. No pictures taken during this inspection. 06/28/2007 Property Inspected Upon a visual inspection of the property, the following items were noted: still have derelict vehicles situated outside of the screened area. Fencing is still down along the Eastern property line. There are 2 (two) camper/trailers situated on the property which are apparently occupied. No pictures were taken during this inspection. 06/29/2007 Phone Call I received another phone call from the complainant asking the status of this violation. He said he just wants this site taken care of.
