Please note that we have made this conveyance on the understanding that the highway shall be improved when laid out and completed within two years , otherwise the conveyance should be deemed to have been abandoned. We are glad to cooperate with our neighbors in this improvement on the understanding voiced in your letter of June 9th, 1936. However, it is our understanding that this fence is on the right of way line and will not need to be moved. The plans for fhe toad provide for cattle-guards rather than fencing the right of way. Under present conditions, we will be unable to improve the road if a fencing program or other heavy expense becomes necessary to provide right of way.
