COLORADO SUBJECT: AmUSR-1259, Riverbend, c/o Eric Reckentine with
LaFarge West, Inc.
The Weld County Public Works has reviewed this proposal; this project falls primarily under the purview of Use by Special
Review Standards, Weld county Code, Chapter 23, Article II, Division 4, Section 23. Our comments and requirements are
as follows:
COMMENTS:
The proposed amended mining operation boundaries have increased from 237 acres to 1,190 acres. The
location borders WCR 6 on the south, north of State Highway 52 and west of U. S. Highway 85.
WCR 8 and State Highway 52 shall be used as service access only. The main access is on to WCR 6.
Materials will be transferred on conveyors and bridged across the South Platte River to the main plant area.
WCR 6 is designated on the Weld County Road Classification Plan (FHU) (June 2002) as a collector status
road which requires an 80-foot right-of-way at full build out. There is presently a 60-foot right-of-way. The
applicant plans to dedicate the additional 20-foot right-of-way adjacent to the property. The average daily
traffic count (ADT) indicates 1,277 vehicles taken in a 24-hour period utilizing WCR 6 at this location.
The three major gravel haulers at this location, the County, and the State have worked together to install a
signal at WCR 6 and U. S. Highway 85 interchange. A right turn lane and extended acceleration and
deceleration lanes have been installed to accommodate heavy hauling in the area.
A traffic study was prepared by Jean Coppola, a professional engineer, in corporation with the heavy haulers in
the area. Through this traffic study in cooperation with CDOT and the County on improvements to the
intersection including the lights. The traffic study also indicated that the proposed ADT count for this amended
USR gravel operation would be approximately 2,140 trips utilizing the site.
REQUIREMENTS:
Entrance/Exit: The applicant needs to provide a detailed drawing of the access points showing entrance and
exit lanes with adequate turning radiuses, paving to the scale house area, small paved parking lot to
accommodate customers, circulation pattern of the immediate area including employee parking, truck parking
area, etc.

Road Maintenance and Improvements Agreement: The Weld County Public Works Department has a
Long-Term Road Maintenance and Improvements Agreement with Mobile Premix, which is owned by the
LaFarge company, which is associated with the designated haul route. If this document is adequate, it will
remain in place. If the County Attorney deems the name change to the LaFarge company, a new Road
Maintenance Improvements Agreement shall be drafted identifying the same designated haul route for the
facility.
Setbacks: Pursuant to the definition of SETBACK in the Weld County Zoning Ordinance (Ordinance 89, as
amended), the required setback is measured from the future right-of-way line. Also a designed setback for any
mining operation is 20 feet in an agricultural zone beyond the future right-of-way line. No structures will be
allowed in the future right-of-way. A slurry wall or retaining wall is considered a structure. Be aware of all
County rights-of-way on section lines throughout the mining facility. The County has retained some rights-of-
way from the 1889 Resolution.
The access from WCR 8 and State Highway 52 will be used for service vehicles only. Utilize the main access
from WCR 6 for all truck hauling traffic.
Conveyors: Conveyors will be used to move material from the site across WCR 8 to the main processing
facility. There will be no direct hauling across WCR 8. The Weld County Public Works Department is
requesting a detailed drawing to be submitted for review and approval of the conveyor crossing of WCR 8.
This structure shall span the County right-of-way. The applicant shall be totally responsible for keeping this
crossing area free of gravel, spillage, vandalism, etc.
Please contact Ted Eyl, Weld County Public Works Department, to acquire a utility right-of-way crossing permit
prior to installation at 356-4000, extension 3750; physical address: 1111 H Street, Greeley, Colorado.
Storm Water Drainage: The historical flow patterns and run-off amounts will be maintained on site in such a
manner that it will reasonably preserve the natural character of the area and prevent property damage of the
type generally attributed to run-off rate and velocity increases, diversions, concentration and/or unplanned
ponding of storm run-off.
The applicant must take into consideration storm water capture/quantity and provide accordingly for best
management practices.
Signs: A stop sign shall be placed at the exit of the pit approach on to WCR 6. Also required will be
additional speed limit signs and appropriate signs designated the haul route from the facility.

I have received and reviewed the entrance/exit drawings approach to WCR 6 provided Pickett Engineering,
Inc. for the proposed Riverbend facility. The drawings submitted are acceptable for construction.
Three additional items that the applicant should be aware of are:
• WCR 6 is designated as a collector status road with an 80-foot right-of-way at full build out. There is
presently a 60-foot right-of-way.
• In the requirements, all new and amended pit applicants will require additional paving to the scale
house area and a small parking area to accommodate customers and vendor.
• The existing improvements agreement for the designated haul route reflects all traffic entering and
existing to US Highway 85 with no approved additional hauling to the west on WCR 6. With the wide
turn lane on the main exit approach, it appears that you are encouraging traffic to go west, which is not
a part of your designated haul route. The Weld County Public Works Department will not support
additional hauling to the west on WCR 6 or the 1-25 Corridor. The signal light was installed at US
Highway 85 and WCR 6 to accommodate heavy hauling in the area.

Environmental Health Services has reviewed this proposal for Mineral Resource
Development facility including a concrete and asphalt batch plant, concrete casting
facility, recycling plant, materials blending, import of materials and gravel mining. We
have no objections to the proposal, however, we do recommend that the following
conditions be part of any approval:
We recommend that the following requirements be met prior to allowing the plat to be
recorded:
es-
1. The applicant shall amend the existing Emission Permit for the modification in the
operation if the Colorado Department of Public Health and Environment
determines that such a modification represents a significant change in emissions
or production. Alternately, the applicant can provide evidence from the APCD
that they are not subject to these requirements.
2. Any existing septic system which is not currently permitted through the Weld
County Department of Public Health & Environment (WCDPH&E) will require an
I.S.D.S. Evaluation prior to the issuance of the required septic permit. In the
event the system is found to be inadequate, the system must be brought into
compliance with current I.S.D.S. regulations. If, in the future, the septic system is
removed for mining the applicant shall provide written evidence to WCDPH&E of
the removal.
3. The existing Colorado Discharge Permit System (CDPS) must be amended for
the increased operation if the Water Quality Control Division (WQCD) of the
Colorado Department of Public Health & Environment determines that such a
modification represents a significant change in the discharge. Alternately, the
applicant can provide evidence from the WQCD that they are not subject to these
requirements.
4. The applicant shall provide current evidence that the facility has an adequate
water supply (i.e., well or community water system).
5. In the event the facility's water system is a well and serves more 25 persons on a
daily basis the water system shall comply with the Colorado Primary Drinking
Water Regulations (5 CCR 1003-1). Evidence shall be provided to the Weld
County Department of Public Health and Environment that the system complies
with the Regulations.
We recommend that the following requirements be incorporated into the permit as
conditions that must be met prior to the issuance of the Certificate of Occupancy:
1. An individual sewage disposal system is required for the proposed office and
batch plant area and shall be installed according to the Weld County Individual
Sewage Disposal Regulations.
2. The septic system is required to be designed by a Colorado Registered
Professional Engineer according to the Weld County Individual Sewage Disposal
Regulations.
3. A stormwater discharge permit may be required for a
development/redevelopment/construction site where a contiguous or non-
contiguous land disturbance is greater than or equal to one acre in area. The
applicant shall inquire with the Water Quality Control Division (WQCD) of the
Colorado Department of Public Health and Environment at
www.cdphe.state.co.us/wq/PermitsUnit if they are required to obtain a
stormwater discharge permit. Alternately, the applicant can provide evidence
from WQCD that they are not subject to these requirements.
We recommend that the following requirements be incorporated into the permit as
development standards:
1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for
final disposal in a manner that protects against surface and groundwater
contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is not
meant to include those wastes specifically excluded from the definition of a solid
waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.,

as amended.
3. Waste materials shall be handled, stored, and disposed in a manner that controls
fugitive dust, fugitive particulate emissions, blowing debris, and other potential
nuisance conditions.
4. The applicant shall operate in accordance with the "waste handling plan".
5. Fugitive dust and fugitive particulate emissions shall be controlled on this site.
The facility shall be operated in accordance with the dust abatement plan at all
times.
6. This facility shall adhere to the maximum permissible noise levels allowed in the
Industrial Zone as delineated in 25-12-103 C.R.S., as amended.
7. Adequate handwashing and toilet facilities shall be provided for employees and
patrons of the facility.
8. Portable toilets may be utilized on sites that are temporary locations of the
working face and portable processing equipment, etc. for up to six months at
each location.
9. Bottled water shall be provided to employees at the temporary locations of the
working face at all times.
10.Any septic system located on the property must comply with all provisions of the
Weld County Code, pertaining to Individual Sewage Disposal Systems.
11.A permanent, adequate water supply shall be provided for drinking and sanitary
purposes.
12.If the water system is a well, the system shall comply with the requirements for a
community water system as defined in the Colorado Primary Drinking Water
Regulations (5 CCR 1003-1).
13.The applicant shall remove, handle, and stockpile overburden, soil, sand and
gravel from the facility area in a manner that will prevent nuisance conditions.
14.AII potentially hazardous chemicals must be stored and handled in a safe manner
in accordance with product labeling and in a manner that minimizes the release
of hazardous air pollutants (HAP's) and volatile organic compounds (VOC's).
15.If applicable, the applicant shall obtain a stormwater discharge permit from the
Colorado Department of Public Health & Environment, Water Quality Control
Division.

16.If applicable, the applicant shall comply with all provisions of the Underground
and Above Ground Storage Tank Regulations (7 CCR 1101-14).
17.If applicable, any vehicle washing area(s) shall capture all effluent and prevent
discharges from drum washing and the washing of vehicles in accordance with
the Rules and Regulations of the Water Quality Control Commission, and the
Environmental Protection Agency.
18.The operation shall comply with all applicable rules and regulations of the State
and Federal agencies and the Weld County Code.

An amended Site Specific Development Plan and a Special Review Permit for a Mineral Resource
Development Facility including a Concrete and Asphalt Batch Plant, Concrete Casting Facility, Import of
Materials and Gravel Mining in the A (Agricultural) Zone District..
1. A building permit shall be obtained prior to the construction or placement of any structure such as a
scale , concrete and asphalt plant, office, concrete casting facility , recycling plant, office trailer and any
other structures placed on the parcels. An electrical permit will be required for any electrical service to
equipment. A plot plan shall be submitted when applying for building permits showing all structures with
accurate distances between structures, and from structures to all property lines.
2. A plan review is required for each building for which a building permit is required. Plans shall bear the
wet stamp of a Colorado registered architect or engineer. Two complete sets of plans are required when
applying for each permit.
3. Buildings shall conform to the requirements of the various codes adopted at the time of permit
application. Currently the following has been adopted by Weld County: 2003 International Building Code;
2003 International Mechanical Code; 2003 International Plumbing Code; 2002 National Electrical Code;
2003 International Fuel Gas Code and Chapter 29 of the Weld County Code.
4. Each structure set on a foundation will require an engineered foundation based on a site-specific
geotechnical report or an open hole inspection performed bya Colorado registered engineer. Engineered
foundations shall be designed bya Colorado registered engineer.
5. Building wall and opening protection and limitations and the separation of buildings of mixed occupancy
classifications shall be in accordance with the Building Code. Setback and offset distances shall be
determined by the Zoning Ordinance.

6. Building height shall be measured in accordance with the Building Code for the purpose of determining
the maximum building size and height for various uses and types of construction and to determine
compliance with the Bulk Requirements from Chapter 27 of the Weld County Code. Building height shall
be measured in accordance with Chapter 23 of the Weld County Code in order to determine compliance
with offset and setback requirements. Offset and setback requirements are measured to the farthest
projection from the building.
7.A Flood Hazarad Development Permit shall be submitted for buildings constructed in the 100-yearflood
plain.

Dear Ms. Hatch:
Thank you for referring Weld County Case Number AmUSR-1259 to the City of Fort Lupton.
On August 23, 2005 the Fort Lupton Planning Commission reviewed the case and listened to a
presentation from Lafarge representatives.
The Fort Lupton Planning Commission recommends approval of the proposed amended site
development plan and a special review permit for a mineral resource development facility, which
includes: a concrete and asphalt batch plant; concrete casting facility; recycling plant; material
blending; import of material; and, gravel mining in the A (Agricultural) zone district with the
following conditions.
• The City of Fort Lupton requests that Weld County continually inform and provide
updates on the progress of the application by Lafarge North America. More specifically,
the City would like to have the opportunity to review the final draft of the special use
permit.
• The City encourages the County to request from Lafarge adequate screening of the
asphalt batch plant and concrete casting facilities. Lafarge has demonstrated and provided
examples from other facilities that screening materials can "blend in" with surrounding
architectural features. While most of the project will be screened by existing cottonwoods
along the Platte River, coupled with Lafarge's commitment to berm, the batch plants will
still be visible from the highway.
• The City requests that the County look into the traffic impacts to WCR 6 and SH 85. The
applicant submitted a traffic study required by the special use permit. Lafarge indicated
that they might be the operator of the Lupton Lakes facility but cannot confirm at this
time. If Lafarge mines Lupton Lakes they indicated that they would hold off on the
Riverbend site. However, if Lafarge cannot work out an agreement with the owners of
Lupton Lakes, Lafarge will commence mining operations at Riverbend as soon as they

receive approval. This emphasizes the importance of the traffic study and to focus on a
worse case scenario. A worse case scenario would be if both Lupton Lakes and
Riverbend operate at the same time. A heavy truck burden will be placed on WCR 6 and
SH 85 because both operations will have gravel trucks exiting on WCR 6.

We appreciate this opportunity to support the proposed Lafarge project known as "Riverbend"
which we understand has been submitted to Weld County for a Use by Special Review to allow
for gravel extraction and associated activities.
Over the past year, Lafarge has met with the City Planner, Tom Parko, our City Administrator,
Jim Sidebottom, our entire City Council, and myself to review the project, answer questions and
receive input from us.
Lafarge has been very responsive to our comments and has included the same in its proposal.
This project meets the needs of our community. On behalf of the City of Fort Lupton, we
encourage Weld County to approve this project, which will provide resources to maintain our
quality of life. The Lafarge representatives have also discussed annexation into the City at the
appropriate time, and provided a proposed pre-annexation agreement that is under review. In our
dealings with Lafarge representatives we have found them to be responsible facility operators,
and the proposed Riverbend project would be an asset to the City's growth. We intend to stay

Dear Ms. Hatch:
In behalf of the Fort Lupton Fire Protection District, in response to your referral relative to the
above referenced project,the Fire Protection District believes that this particular project will have a
significant and continuing impact on the Fire Protection District.In particular,the full build out of this
project will affect emergency services routing and potentially response times.
In the short term, if the applicant would consider allowing installation of a fill station for use by
the Fire Protection District,that would not only alleviate any possible delay in response time, but might
also enhance the Fire District's capability by providing an additional source of fire protection water,
thereby enhancing the District's ability to serve particularly those District taxpayers on the west side of
this project.
Consequently,the Fire District would request that as a condition of approval,the Planning
Commission require the applicant to allow and fund the installation of a fill station accessible to the Fire
Protection District. We are aware that there may be issues relative to allowing access to Fire District
personnel because of applicable safety regulations related to gravel pits and mining, but believe that there
may be the possibility of resolving those safety and training issues.
Additionally,given the extensive amount of land involved in this project,the Fire Protection
District believes that it would be appropriate that the applicant be required to dedicate and donate a
modest amount of land to the Fire District for a future fire station site in the vicinity of Weld County
Road 8 and 23,which would allow the Fire Protection District in the future to more adequately serve the
western portions of the Fire Protection District.
The Planning Commission's consideration of these requests will be greatly appreciated. The Fire
District remains available to discuss these requests with the Planning Commission, Planning Department
staff or with the applicant.

previously reviewed and offered recommendations on the referenced Riverbend Sand and Gravel
Resource Development Facility application package submitted to the Colorado Division of
Minerals and Geology on January 20,2005. Our recommendations addressed soils, erosion
control, site reclamation including re-vegetation seed mix, wildlife issues, surface and subsurface
water resources. A copy of our response letter is attached. We offer the same recommendations
to the Weld County Department of Planning Services for this Amended Use by Special Review
permit application.
The West Adams and Platte Valley Conservation Districts,along with NRCS,appreciate the

101(10)(a), C.R.S. Therefore, pursuant to the State Engineer's March 4, 2005 memorandum to
county planning directors, this office will only perform a cursory review of the referral information and
provide comments.
We have reviewed the above referenced proposal for an amended Site Specific Development
Plan and Special Review Permit.
According to the submitted information, the Gravel Mining operation will cause depletions to
the South Platte River due to evaporative losses from exposed ground water and operational losses.
A Substitute Water Supply Plan (SWSP) or court approved augmentation plan must be
obtained to replace the depletions caused by the operation. The Riverbend pit is currently
included in a SWSP along with other mining sites owned by LaFarge West, Inc. The approved
SWSP does not allow any evaporation or consumptive use at the Riverbend pit,therefore,a
new SWSP must be obtained prior to exposing water in the pit or consuming ground water at
the site.
Gravel pit operators typically must first obtain approval from the Colorado Division of Minerals
and Geology(DMG) prior to mining. As part of that process the applicant will need to address the
potential concerns of State Engineer's Office as they relate to water rights.

The West Adams Soil Conservation District has requested assistance from our agency in
reviewing the subject proposed Mining and Reclamation Permit amendment to mine sand and
gravel near Brighton, Colorado. Reclamation of the site will be completed to reclaim the
affected land to municipal water storage reservoirs. We have the following comments and
recommendations on this amended application.
Reclamation Plan
Water Storage Reservoir
It is recommended that the final reservoir slopes be no steeper than 3:1, and preferably less steep
such as 4:1 or 5:1, to permit eventual use of the reclaimed water storage reservoirs by wildlife.
Steep slopes such as 3:1 can discourage wildlife from approaching and using the water reservoir.
Topsoil
The NRCS recommends that topsoil stockpiled for reclamation be segregated from other spoil.
The topsoil and overburden stockpiles should be graded with final slopes no steeper than 411:IV.
Slopes that are less steep allow easier maintenance, are less susceptible to water erosion and
more readily establish grass protective cover.
It is highly recommended that topsoil and overburden stockpiled over 30 days be seeded
immediately as weather permits to protect it. The immediate seeding of these stockpiles should
be done to avoid soil erosion from wind and water, as well as from a weed standpoint. Weeds
are very invasive and move onto disturbed areas very quickly. Some of these can be noxious
weeds and require control based on the state noxious weed list. Through immediate seeding to
promote temporary cover, the opportunity for weed invasion will be less, as will the potential for
erosion. For seeding the stockpiles, Luna pubescent wheatgrass and/or Amur intermediate

wheatgrass are recommended,both of which will establish readily and quickly. This temporary
seeding should be done at a rate of 15 total pounds PLS per acre.
It is highly recommended that the applicant coordinate weed treatment plan development and
implementation with Kelly Uhing, Adams County Cooperative Extension (303-637-8100),to
ensure compliance with the Colorado Noxious Weed Act.
Reclamation Re-Vegetation
For those areas to be reclaimed, it is recommended that 12 inches of topsoil be spread in lifts not
to exceed 4 inches and worked into the slopes to ensure good adhesion and to minimize soil
creep. In order to re-establish normal levels of microbial activity in the soil, compost at the rate
of one to two cubic yard per 1000 ft2 should be mixed with the soil. If compost is not applied,
after topsoil replacement and before grass seeding, the soil should be tested to determine the
need for additional fertilizer. Recommended grass seeding dates are from November 1 st through
April 30`b; seeding should be done in unfrozen soil. A good quality grass seed drill with an
agitator, depth bands and press wheels is recommended.
The following native grass seed mix and application rate is recommended for re-vegetation in the
soil types found in the mine area for upland and disturbed areas. It is based on NRCS "critical
area" seeding rates that are double our normal rates.

Note: If seed is broadcast,recommended rate should be
doubled.
If re-vegetation is planned in wet meadow areas, field experience has shown that individual
plants provide a much higher success rate. It is recommended that plants be used in these areas
to accomplish re-vegetation.
We recommend mulching re-vegetated areas with clean weed-free straw or native hay. It should
be applied at a rate of 4,000 pounds per acre and crimped into the soil to anchor it. Crimping
should be cross slope or on the contour, if possible. The State of Colorado has a list of certified

weed-free straw available on the internet or it can be obtained through local county extension
service offices. All surface water should be diverted away from the re-vegetated slopes to a
point where it can safely flow down slopes without the potential of serious soil erosion.
Weeds in the re-vegetated areas will need to be controlled by mowing until grasses are
established, usually the first four years after planting for native species. Again, the applicant
should coordinate weed control with Kelly Uhing with the Adams County Cooperative
Extension.
Surface and Subsurface Water
The West Adams Conservation District, along with others in the area, is concerned about the
overall loss of water resources, both surface and subsurface, due to mining operations such as
this. There are concerns relative to the effect this mining operation may have on underground
aquifers in the region. If a slurry wall or lining is planned to seal the reservoirs, what will be the
impacts of any water"shadowing effects" downstream of the reservoir? There are numerous
wetlands downstream of the proposed mining operation on the adjacent South Platte River and
on tributaries to the river. What will be the short and long-term impacts to these existing
wetlands? The surface area for the proposed reservoirs will be large. What will be the long-
term, annual evaporative water loss from the reservoirs?
The NRCS and West Adams Conservation District welcome the opportunity to review and
comment on this proposed mining and reclamation permit amendment. Should you have
