HomeMy WebLinkAbout20071675.tiff RESOLUTION RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL ACTION AGAINST DIANA AND RONALD MARTINDALE FOR VIOLATION OF THE WELD COUNTY CODE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Diana and Ronald Martindale, VI #0200521, are allegedly in violation of the Weld County Code, and WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has not been corrected, and WHEREAS, on the 19th day of June, 2007, a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violation, and WHEREAS, Diana and Ronald Martindale, property owners, were present at said hearing, and WHEREAS,the Board of County Commissioners deems it advisable to refer said violation to the Weld County Attorney's Office for legal action, with an instruction for delay of action upon such referral until June 19, 2008,to allow adequate time for the property owners to restore, remove or screen the noncommercial junkyard from all adjacent properties and public rights-of-way, and to remove the mobile home to bring the subject property into compliance and for an inspection of the property by the Department of Planning Services staff. Since the DERELICT MOBILE HOME was previously permitted as a "Temporary During Construction" and not as a "Storage Unit" prior to the Code change, no alternative, other than removal, can be provided. The only option available is a "Temporary" fix. In the Agricultural Zone District,a mobile home can be permitted to"Store"temporarily on a site, but can not be utilized as a Storage Unit at the same time. Meaning, that you can permit the mobile home to sit on the property for 6 months, but can not store anything inside of it.
