RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL
ACTION AGAINST DIANA AND RONALD MARTINDALE FOR VIOLATION OF THE
WELD COUNTY CODE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Diana and Ronald Martindale, VI #0200521, are allegedly in violation of the
Weld County Code, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 19th day of June, 2007, a public hearing was held before the Board of
County Commissioners for the purpose of hearing testimony relating to said violation, and
WHEREAS, Diana and Ronald Martindale, property owners, were present at said hearing,
and
WHEREAS,the Board of County Commissioners deems it advisable to refer said violation
to the Weld County Attorney's Office for legal action, with an instruction for delay of action upon
such referral until June 19, 2008,to allow adequate time for the property owners to restore, remove
or screen the noncommercial junkyard from all adjacent properties and public rights-of-way, and
to remove the mobile home to bring the subject property into compliance and for an inspection of
the property by the Department of Planning Services staff.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that VI #0200521 be, and hereby is, referred to the Weld County Attorney's
Office for legal action against Diana and Ronald Martindale to remedy the violation of the Weld
County Code, and any other persons occupying the properties, any persons claiming an interest
in the properties, and any persons acting in active concert with the identified parties, with an
instruction for delay of action upon such referral until June 19, 2008, to allow adequate time for the
property owners to restore, remove or screen the noncommercial junkyard from all adjacent
properties and public rights-of-way, and to remove the mobile home to bring the subject property
into compliance.

partially or totally dismantled; has all or portions of its body work missing or is substantially
damaged; does not have valid registration with the State, as required by Section 42-3-103,
42-3-138 or 42-12-102, C.R.S., and/or the number plate assigned to it is not permanently
attached to the vehicle, as required by Section 42-3-123, C.R.S.; or is lacking proper
equipment to the extent that it would be unsafe or illegal to USE on public road rights-of-way
or otherwise not equipped with lamps and other equipment, as required in Sections 42-4-20;

vehicles customarily operated in a FARMING operation.

NONCOMMERCIAL JUNKYARD: An area where any waste,junk or used or secondhand
materials are stored or handled, including but not limited to scrap iron and other metals,
paper, rags, rubber tires, building materials and bottles. A NONCOMMERCIAL JUNKYARD
may also include the storage or keeping of DERELICT VEHICLES registered last or currentl:
registered under the property owner and/or tenants name.
This definition does not include COMMERCIAL VEHICLES. If the Zone district allows, the
NONCOMMERCIAL JUNKYARD shall be totally ENCLOSED within a BUILDING or
STRUCTURE or visually SCREENED from all ADJACENT properties and public rights-of-w2
SCREENED: Construction and maintenance of fences, earth berms or the USE of
LANDSCAPING materials or other materials USED with the approval of the Department of
Planning Services to lessen the noise, light, heat or visual impacts of a USE on surrounding
uses. A SCREENING PLAN shall be submitted and approved by the Department of Planninc
Services.
REMEDY
The NONCOMMERCIAL JUNKYARD consisting of a DERELICT VEHICLE (a camper/trailer), we
iron/metal and miscellaneous debris shall be removed, restored or completely SCREENED from
adjacent properties and public rights-of-way.
The single wide mobile home which I have still been unable to locate any building or zoning
permits for shall be removed from the property.
RECOMMENDATION
The Department of Planning Services recommends that this case be referred to the County Attorney's
Office for immediate legal action.

properties the business day before or as soon as possible to the above mentioned Violation
Hearing date.
The Department of Planning Services' staff will be recommending that the Board of County
Commissioners authorize the County Attorney to proceed with legal action to remedy the
violation. Our records indicate that you were made aware of the nature of the violation including
the action necessary to correct the violation, and that you were given sufficient time to remedy

The uses on the above described property are being considered as a zoning code violation of Sections of the
Weld County Code. Currently your property is in violation of the following Section(s)of the Weld County Code:

In an effort to close out some older violations, I ran across your open violation. There are 2
(two) outstanding issues.
► Regarding the single-wide mobile home, I have searched through my case files and
computer and have been unable to locate a building permit or zoning permit for the
mobile home; therefore, unless you have some other evidence substantiating the
presence of the mobile home, it shall be removed from the property.
D. Also, it appears as though you still have a NONCOMMERCIAL JUNKYARD consisting
of DERELICT VEHICLES, a camper/trailer, iron/metal and miscellaneous debris.

It is the intention of this office to assist and cooperate with you without imposing undue hardships; however,
we have no discretion in this matter if you fail to correct this violation. You have 30 (thirty) days from
March 29, 2007, to correct this zoning violation. Failure to do so will result in this office scheduling the
violation before the Board of County Commissioners to consider whether to refer the violation to the County
Attorney's Office for legal action.

The uses on the above described property are being considered as a zoning code violation of Sections of
the Weld County Code. Currently your property is in violation of the following Section(s)of the Weld County
Code:

To bring your property into compliance with the Weld County Code:
The"Noncommercial Junkyard"consisting of derelict vehicles,a bus,scrap iron/metal,
trash and miscellaneous debris shall be removed,restored or screened from all adjacent
properties and public rights-of-way. The camper/trailers-Recreational Vehicles shall be
abated as dwelling units and a letter submitted stating such has occurred. Lastly, the
DERELICT MOBILE HOME shall be removed from the site. Since the DERELICT MOBILE
HOME was previously permitted as a "Temporary During Construction" and not as a
"Storage Unit" prior to the Code change, no alternative, other than removal, can be
provided. The only option available is a "Temporary" fix. In the Agricultural Zone
District,a mobile home can be permitted to"Store"temporarily on a site, but can not be
utilized as a Storage Unit at the same time. Meaning, that you can permit the mobile
home to sit on the property for 6 months, but can not store anything inside of it.

Building Permit(BC-9801120). This permit is ready for expiration and would require a new fee and an investigation fee;

1. The applicant shall apply for a building permit for the mobile home prior to locating the Fifth
Wheel Trailer on the property.
2. The Fifth Wheel Trailer shall be served by the proposed septic system(Permit No. SP-9800484)
temporarily during construction.
3. Prior to the occupancy of the Fifth Wheel Trailer, the Fifth Wheel Trailer shall be connected to
a cistern (Permit No. 98-015) until community water is available.
4. The Fifth Wheel Trailer shall not be occupied until such time that the applicant has complied
with Conditions 1, 2 and 3 stated above.
5. At such time community water becomes available to the property, the Fifth Wheel Trailer or
principal dwelling shall be connected and use of the cistern discontinued.
6. The Fifth Wheel Trailer shall be disconnected from the septic and the water supply within 30
days of receipt of the Certificate of Occupancy for the principal dwelling.
7. To remain on the property after 30 days from receipt of the Certificate of Occupancy for the
principal dwelling, the Fifth Wheel Trailer must be in operable condition with current license
plates, or be screened from all adjacent properties and public rights-of-way and shall not be
used on any basis as a dwelling or as overnight or temporary housing for any person..
8. The access shall be a graded and drained road to provide all weather access. If a drainage
culvert is required, a 15-inch CMP is the County minimum size. if the applicant chooses to
place a larger culvert, please contact the Public Works Department to adequately size your

Per our phone conversation this date, I would really appreciate it if the above permits can
be processed as quickly as possible. We were not aware that it normally takes 45 days to
get permits and had planned to start moving by Nov. 1 in order to be out of here by the
time rent is due again on Nov. 13th. Our housing is costing us double, what with
payments on the land as well as space rent where we are now. With all the expenses
(some of them unexpected) of permits, septic system, cistern, electrical power, etc.,
money is getting very tight.
I have made every effort to see to it that all our paperwork is in order. If I have
overlooked something or further information is needed, please let me know and I will get
it to you as quickly as possible. Thanks so much for all your help.
