RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL
ACTION AGAINST DOYLE JACKSON FOR VIOLATION OF THE WELD COUNTY CODE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS,Doyle Jackson,VI#0600178,is allegedly in violation of the Weld County Code,
and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 11th day of September, 2007, a public hearing was held before the
Board of County Commissioners for the purpose of hearing testimony relating to said violation, and
WHEREAS, Doyle Jackson, property owner, was present at said hearing, and
WHEREAS, the Board of County Commissioners deems it advisable to refer said violation
to the Weld County Attorney's Office for legal action, with an instruction for delay of action upon
such referral until November 11, 2007, to allow adequate time for the property owner to remove all
the household trash and debris,and to restore, remove or screen the noncommercial junkyard from
all adjacent properties and public rights-of-way to bring the subject property into compliance and
for an inspection of the property by the Department of Planning Services staff.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that VI #0600178 be, and hereby is, referred to the Weld County Attorney's
Office for legal action against Doyle Jackson to remedy the violation of the Weld County Code, and
any other persons occupying the properties,any persons claiming an interest in the properties,and
any persons acting in active concert with the identified parties,with an instruction for delay of action
upon such referral until November 11, 2007, to allow adequate time for the property owner to
remove all household trash and debris and to restore, remove or screen the noncommercial
junkyard from all adjacent properties and public rights-of-way to bring the subject property into
compliance.

STRUCTURE or visually SCREENED from all ADJACENT properties and public
rights-of-way.
SCREENED: Construction and maintenance of fences, earth berms or the USE of
LANDSCAPING materials or other materials USED with the approval of the Department of
Planning Services to lessen the noise, light, heat or visual impacts of a USE on surrounding
uses. A SCREENING PLAN shall be submitted and approved by the Department of Planninc
Services.
REMEDY
At no time shall the number of cats (indoor or outdoor) exceed 4 (four)without first obtaining a Use by
Special Review(USR) permit. It is my understanding that you are attempting to reduce to under 4 cats.

The Department of Planning Services recommends that this case be referred to the County Attorney's

04/19/2006 Property Inspected Structural fire last night. Hudson Fire Department
responded. Will forward report when complete.
04/20/2006 Phone Call Larry Richardson (Fort Lupton Fire Department) called and
notified me of the fire. Played phone tag with him.
04/26/2006 Property Inspected During an on-site inspection with Gary Schwartz, Joshua
Noonan and myself, the following items were noted: Mr.
Jackson was not home. I left a note asking him to call
me as soon as possible regarding cats and trash. During
the inspection I noted 6 cats in a cage, 1 walking outside,
at least 1 in a camper/trailer-covered with a tarp- hooked
up to electricity- light on outside the RV and inside. A lot
of household trash was scattered all over the property.
Derelict vehicles. No pictures taken. While pounding on
the door again - Lee Ann (Mrs. Jackson) came to the
door. Gary and I spoke to her for several minutes.
Joshua also spoke to her regarding the electrical wire.
She was uncooperative. She stated "the cats you see are
the only cats we got" Gary specifically asked if just the
ones in the cage were it, she said yes. I then saw a cat
in the window inside of the RV. She got very quiet. I
asked her to just have Doyle give me a call. Dep Joshua
Noonan took pictures.
09/22/2006 Office Visit Doyle came to the office. He said that he had run into
some problems and had to go to the VA Hospital for about
6 weeks so he hasn't gotten done what he needed to get
done. We came up with the following time line: within 30
days(I'll send a new 30 day letter) he will have the
following done: 1.) License the RV or apply for title 2.)
Remove 3 vehicles from the property. 3.) Relocate the
remaining 3 vehicles up close to the house and RV. 4.)
Be down to no more than 4 (four) cats. I told him that I
would schedule an on-site inspection after the 30 days.
He asked me to call him to schedule the inspection. I
told him I would.
03/08/2007 Phone Call I called Doyle(720-933-4584) and asked him for a
progress report. He said now that the snow is finaly
melting maybe he can get something done. I said so you
haven't had a chance to do a whole lot. He said no. I
asked how much time he thought he needed. He said
can you give me a couple of weeks. I told him that I
would call him back at the end of the month to schedule
an inspection. He said that would be great.
07/20/2007 Phone Call I called Doyle Jackson (720-933-4584). I told him that I
needed to schedule an inspection, maybe for the Monday

working on a job right now.

Hearing date.
The Department of Planning Services' staff will be recommending that the Board of County
Commissioners authorize the County Attorney to proceed with legal action to remedy the
violation. Our records indicate that you were made aware of the nature of the violation including
the action necessary to correct the violation, and that you were given sufficient time to remedy

The uses on the above described property are being considered as a zoning code violation of Sections of the
Weld County Code. Currently your property is in violation of the following Section(s)of the Weld County Code:

Services. We have discussed this very issue in the past. It is my understanding that
you are in the process of reducing the number of cats so that there will be no more
than 4 (four) cats on the property at any given time.
KENNEL:Any place other than a PET SHOP or veterinary clinic or HOSPITAL,where five(5)
or more HOUSEHOLD PETS of one (1) species, or a total of eight (8) or more household
pets of two (2) or more species, are kept or maintained. Property that is zoned (A)
Agricultural and not part of a platted subdivision or unincorporated town and which is larger
than ten (10) acres shall be permitted to keep or maintain eight(8) HOUSEHOLD PETS of
one(1)species or sixteen (16)HOUSEHOLD PETS of two(2)or more species without being
considered a KENNEL.

► During our discussion on September 22, 2006, you indicated that you were going to
remove 3 Derelict Vehicles and relocate 3 other derelict vehicles so they weren't as
visible. Furthermore, you are working on getting a current license plate for the RV-
Camper/Trailer. If you discover that you do not have the title, then within this 30 day
time period I expect you to have started the "lost title" process. Lastly is the
miscellaneous debris and house hold trash. This type of debris must be completely
removed from the property. If the property is not in compliance before the end of this
60 day extension, you will probably have a Violation Hearing in middle November.
It is the intention of this office to assist and cooperate with you without imposing undue hardships; however,
we have no discretion in this matter if you fail to correct this violation. You have 30 (thirty) days from
September 25, 2006, to correct this zoning violation. Failure to do so will result in this office scheduling the
violation before the Board of County Commissioners to consider whether to refer the violation to the County
Attorney's Office for legal action.

► I noted a large amount of household trash which shall be completely removed from the
property. Additionally, derelict vehicles and miscellaneous debris was also noted.
These types of items are eligible to be screened from all adjacent properties and public
rights-of-ways. I understand that you are will be trying to remove the items listed above
in a timely fashion. I have tried to work with you as much as possible;however,please
understand that any additional time needed will need to be approved by the Board of
County Commissioners at a Violation Hearing. If the property is not in compliance
before the end of this 60 day extension, you will probably have a Violation Hearing in
middle October.

To bring your property into compliance with the Weld County Code:
► At no time shall the number of cats exceed 4 (four); otherwise, a Use by Special
Review application shall be completed and submitted to the Department of Planning
Services. We have discussed this very issue in the past. While I understand that you
do not agree with this requirement, it never the less, remains a legal section of the
Weld County Code and thus requires a Use by Special Review permit.
KENNEL: Any place other than a PET SHOP or veterinary clinic or HOSPITAL,where five(5)
or more HOUSEHOLD PETS of one (1) species, or a total of eight (8) or more household
pets of two (2) or more species, are kept or maintained. Property that is zoned (A)
Agricultural and not part of a platted subdivision or unincorporated town and which is larger
than ten (10) acres shall be permitted to keep or maintain eight(8) HOUSEHOLD PETS of
one(1)species or sixteen (16)HOUSEHOLD PETS of two(2)or more species without being
considered a KENNEL.

property. Additionally, derelict vehicles and miscellaneous debris was also noted.
These types of items are eligible to be screened from all adjacent properties and public
rights-of-ways. I understand that you are will be trying to remove the items listed above
in a timely fashion. I will work with you as much as possible; however, please
understand that it is your responsibility to contact me prior to this 60 day extension
deadline in order to avoid being scheduled before the Board of County Commissioners
for a Violation Hearing. If I do not hear from you prior to July 12, 2006, a Violation
Hearing will be scheduled.
It is the intention of this office to assist and cooperate with you without imposing undue hardships; however,
we have no discretion in this matter if you fail to correct this violation. You have 60 (sixty) days from
May 10,2006,to correct this zoning violation. Failure to do so will result in this office scheduling the violation
before the Board of County Commissioners to consider whether to refer the violation to the County Attorney's
Office for legal action.

Dispatched to a trash fire at WCR 37&10 upon arrival found a trash barrel burning
fire had moved from barrel to trash around barrel. No one was on scene upon arrival
checked residence got no answer. Location of fire had large amount of trash alot of
household trash old tires alot vehicle parts everywhere. Had one car one small shed
on fire.Advised weld dispatch was In FLlupton fire district and tD advise Ft.lupton.
Pulled 2- 1.5 crosSlays off unit 2804 used approx 1500 gallons of water. Had neighbers
advise on scene owner bums at night burning insulation off electrical wire. While on
scene noticed several rolls of electrical wire.There was approx 5-7 semi loads of
household trash. Because of the amount of trash fire was difficult to access. Neighbers
on scene advised that the residence had been condemed by the county 2-3 years ago.
Made second attemptto contact someone at the residence with no luck. Upon
investigation appears fire was started in barrel and moved from barrel to other trash
around barrel then moving to a car and a small shed. Before leaving the scene Hudson
Chief 2 attempted to make contact again with no luck.

Dear Hearing Board,
The reason for this letter is help inform the board of some of the conditions of this property.
All along the outer border of the property there is sawdust/wood shavings that is believed to be used for
cat Litter,scattered all along the north side of the property.If you look close at one of the picture's marked
#A you can see how deep the litter is. .There are always tubs;5 gallon pail's of this litter at or by the
propane tank. I would think this is a Health and Fire hazard.At the front and rear of the house there are
some type of cages,I know that until the weeds got tall,there were cats in the cages at the rear of the house.
There are always cats at the back door,and at night on our property I counted 6 at my back door and we
don't have cats. There are also six abandoned cars,one pickup,and one old horse trailer full of trash,a
camp trailer all at the back of the house.There is two air conditioners in the camp trailer windows,not real
sure what the trailer is used for. There are numerous electrical extension cords running across the top of
the ground and running to the old barn area plugged into freezers and refrigerators.These extension cords
are being driven over daily.The cars look to be used for storage of trash and junk.Not to mention an oiyer
abundance of junk throughout the whole property.In sheds,buildings scattered all over the yard.In late
June the Jackson's brought in a 30 yard Dumpster.But all that has been put in this Dumpster has been
household trash bags.As you can tell by the pictures,the weeds are out of control,which is a fire hazard,
and with our buildings so close to the surrounding neighbors property our property would be destroyed in
case of a fire.From what i understand this has not been the first compliant about the conditions of the'
property.I would believe that the conditions of the property would bring the surrounding value of property
down. Several years ago a fire did take place on the property and the premises were condemned. I believe
that most of the buildings on the property are not livable for humans or animals.I do not know the coemy
ordinance for the number of cats,but I am sure there are numerous cats on that property and this exceeds
any ordinance..My guess would be over twenty. Because of the conditions of this property we have
noticed rats,mice,skunks,a large supply of flies.
I have enclosed several pictures of the property,as it is to date,nothing has changed or even attempted
to be cleaned up.When I called the country they said they have sited these individuals and they are suppose
to be cleaning it up.As far as I can tell that has not happened.As a property owner i do not appreciate the
junk,litter,trash,fire hazard in our neighborhood. Something needs to be done to get this cleaned up. This
has been an ongoing battle with these neighbors.This simply is not healthy living conditions for anyone.
As a taxpayer and an abiding citizen 1 will appreciate your help in getting this matter resolved.No one
should have to call the county as much as I have to get this problem resolved.
