RE: VIOLATIONS OF THE WELD COUNTY CODE -ZONING AND BUILDING INSPECTION
A public hearing was conducted on March 13, 2007, at 10:00 a.m., with the following present:
Commissioner David E. Long, Chair

The following business was transacted:
I hereby certify that a public hearing was conducted to consider whether to authorize the County
Attorney to proceed with legal action against the individuals named for violations of the Weld
County Zoning Ordinance. Cases were heard as follows:
VI #0600423 - BERMUDEZ: Bethany Salzman, Department of Planning Services, presented the
case report for the record and pursuant to the case file, this property is in violation of Sections
23-3-20, 23-3-30 and 23-3-30.1 of the Weld County Code. To bring the property into compliance,
the noncommercial junkyard must be restored, removed or screened from all adjacent properties
and public rights-of-way. Ms. Salzman stated she met with Jose Bermudez on March 12, 2007,
and he will need thirty days to complete the cleanup to bring the property into compliance. Neither
the property owner nor a representative was present, and there was no public testimony given.
Commissioner Masden moved to refer VI#0600423 against Jose Bermudez to the County Attorney
for legal action, with the instruction to delay action upon such referral until April 13, 2007, to allow
adequate time for the noncommercial junkyard to be restored, removed or screened from all
adjacent properties and public rights-of-way. The motion was seconded by Commissioner
Rademacher, and it carried unanimously.
VI#0600500-HERNANDEZ: Ms. Salzman presented the case report for the record and pursuant
to the case file, this property is in violation of Sections 23-3-20, 23-3-30 and 23-3-30.1 of the Weld
County Code. To bring the property into compliance, the noncommercial junkyard must be
restored, removed or screened from all adjacent properties and public rights-of-way. Ms. Salzman
stated the property owners have made substantial progress; however,Jose Hernandez requested

thirty days to complete this project to bring the property into compliance. Neither the property
owners nor a representative was present, and there was no public testimony given.
Commissioner Garcia moved to refer VI #0600500 against Jose and Hilda Hernandez to the
County Attorney for legal action, with the instruction to delay action upon such referral until
April 13, 2007, to allow adequate time for the noncommercial junkyard to be restored, removed or
screened from all adjacent properties and public rights-of-way. The motion was seconded by
Commissioner Rademacher, and it carried unanimously.
VI#0600204-JACKSON/SPRINGER HAULING: Ms. Salzman, presented the case report for the
record and pursuant to the case file, this property is in violation of Sections 23-3-20, 23-3-30,
23-3-30.D, 23-3-30.1, 23-3-30.M, 23-3-40 and 23-3-40.R of the Weld County Code. To bring the
property into compliance, current license plates must be affixed to the vehicles or they must be
removed, a Home Occupation permit must be submitted, and the trailer must only be utilized to
haul hay or feed. Ms. Salzman stated the Zoning Permit was denied by the Board of County
Commissioners on February 12, 2007, so that portion of the violation has been addressed, and
prior to this hearing, Fred Jackson stated that the camper trailer is being cleaned and repaired to
be sold this spring, and sixty days will be enough time to complete this project. Responding to
Commissioner Garcia, Ms. Salzman stated they are not occupying the trailer during the night;
however, during the day they need to have the propane and electricity hooked up and the
extensions open. Once the work is completed, the skirting will be removed, all utilities will be
disconnected, and the extensions will be closed,which will bring the campertrailer into compliance.
Neither the property owner nor a representative was present, and there was no public testimony
given.
Commissioner Masden moved to refer VI #0600204 against Fred Jackson, dba Springer Hauling,
to the County Attorney for legal action, with the instruction to delay action upon such referral until
May 13, 2007, to allow adequate time for the camper trailer to be cleaned, repaired and sold. The
motion was seconded by Commissioner Rademacher, and it carried unanimously.
VI #0600527 -ANTUNA/COMPOZ:Ann Siron, Department of Planning Services, presented the
case report for the record and pursuant to the case file, this property is in violation of Sections
23-3-20, 23-3-30 and 23-3-30.1 of the Weld County Code. To bring the property into compliance,
the derelict vehicles must be restored, removed or screened from all adjacent properties and public
rights-of-way. Ms. Siron stated there has been substantial progress, and the property owners
contacted staff this morning and stated a tow truck will be removing the truck bed this afternoon,
and they will need thirty days to complete the cleanup to bring the property into compliance.
Neither the property owners nor a representative was present, and there was no public testimony
given.
Commissioner Rademacher moved to refer VI #0600527 against Gabino Antuna, c/o Rose
Compoz, to the County Attorney for legal action, with the instruction to delay action upon such
referral until April 13, 2007, to allow adequate time for property owners to restore, remove or
screen the derelict vehicles from all adjacent properties and public rights-of-way. The motion was
seconded by Commissioner Garcia, and it carried unanimously.

VI#0700001 -SHELDON: Ms. Siron presented the case report for the record and pursuant to the
case file, this property is in violation of Sections 23-3-20, 23-3-30 and 23-3-30.1 of the Weld County
Code. To bring the property into compliance, the remaining derelict trailer must be restored. Ms.
Siron stated Steward Sheldon contacted staff, and stated there has been a problem with the title
on the trailer/toy hauler; however, he is continuing to work on getting this restored. Responding
to Commissioner Rademacher, Ms.Siron stated the trailer is used to haul four wheeler motorcycles
ATV's, etcetera. Neither the property owners nor a representative was present, and there was no
public testimony given.
Commissioner Garcia moved to refer VI #0700001 against Stewart and Diana Sheldon to the
County Attorney for legal action, with the instruction to delay action upon such referral until
May 13, 2007, to allow adequate time for the property owners to restore the trailer/toy hauler to
bring the property into compliance. The motion was seconded by Commissioner Rademacher,and
it carried unanimously.
This Certification was approved on the 19th day of March, 2007.
