RESOLUTION RE: GRANT CHANGE OF ZONE FROM "A" (AGRICULTURAL ZONE DISTRICT) TO P.U.D. (PLANNED UNIT DEVELOPMENT) - WILLIAM RAY ADAMS, SR. WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, a public hearing was held on the 21st day of Dec- ember, 1983 , at 2 : 00 o 'clock p.m. for the purpose of hearing the application of William Ray Adams, Sr. , 1500 West 92nd Avenue, #219 , Thornton, Colorado 80229 , requesting a Change of Zone from "A" (Agricultural Zone District) to P.U.D. (Planned Unit Develop- ment) for the following described parcel of land, to-wit: Part of the Wz, Section 14 , Township 1 North, Range 66 West of the 6th P.M. , Weld County, Colorado WHEREAS, Section 21 . 6. 2 of the Weld County Zoning Ordinance provides standards for review of such Change of Zone, and WHEREAS, the Board of County Commissioners heard all the testimony and statements of those present, has studied the re- quest of the applicant and the recommendation of the Weld County Planning Commission, and having been fully informed finds that the request shall be granted for the following reasons: 1 . Because this has not been productive agricultural land, the Board finds that the land will be best utilized by granting this Change of Zone: 2) The Board further finds that the proposed type of develop- ment, governed by the attached Protective Covenants, as amended by the Board, will preserve the agricultural nature of the land while allowing residential use of the land. NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado that the application of William Ray Adams , Sr. , for a Change of Zone from "A" (Agricul- tural Zone District) to P.U.D. (Planned Unit Development) on the above referenced parcel of land be, and hereby is, granted sub- ject to the attached Protective Covenants , as amended by the Board, being recorded in the office of the Weld County Clerk and Recorder. M. , with the following present: Chuck Carlson Chairman John Martin Pro Ten Gene Brantner Commissioner Norman Carlson Commissioner Jacqueline Johnson Commissioner, Excused Also present: Acting Clerk to the Board, Mary Reiff Assistant County Attorney, R. Russell Anson Planning Department Representative, Rod Allison The following business was transacted: I hereby certify that pursuant to a notice dated November 7, 1983, and duly published in the LaSalle Leader on November 17, 1983, and December 8, 1983, a public hearing was conducted for the purpose of considering the request of William Ray Adams, Sr. for a Change of Zone from A to P.U.D.. Russ Anson, Assistant County Attorney, read this request into the record along with the criteria the Board is to use when granting a Change of Zone. Rod Allison, representing the Planning Departmment, read the Planning Commission's recommendation for denial of this request, along with referral comments from the Platte Valley Soil Conservation District. The applicant was present and explained this • request. Chairman C. Carlson commented that, originally, an application for a Use by Special Review had been submitted on this property, with the Board requesting it be re-submitted as a Change of Zone. Mr. Adams stated he wishes to create seVen land parcels, approximately 35 acres each. Commissioner Martin commented on the fragile soil of the area and the fact that much discipline would be required to maintain the soil to avoid blowing sand. Mr. Allison stated that if the Board grants this Change of Zone, the next step would be a review of the P.U.D plan. Chairman C. Carlson questioned the availability of water and was told each lot would have its own deep wells. The Board was assured that many wells have been drilled in the area. Mr. Adams stated he has had covenants drawn up by a Denver attorney. Commissioner Brantner stated he also has concerns about the water availability. Commissioner Martin expressed the opinion that this is about the only profitable usage of this ground--farming has been tried, resulting in bad erosion. The present owner uses this land to hoard horses, which makes about enough to cover taxes. Mr. Anson asked about the alternatives for use of this property as it is currently zoned. Mr. Allison stated it could be used as grazing rangeland. In response to questioning, Mr. Allison also stated that the Planning Department recommendation was the same as the Planning Commission's. Mr. Anson asked if information was presented to the Planning Commission indicating that farming is not economically feasible on this land. (Tape change #83-152) Discussion was held about the proposed covenants for this P.U.D. Mr. Allison stated the final P.U.D. plan would allow further review Of the covenants. A vote to approve ' the P.U.D. could include amendments to the covenants if that is the Board's wish. Mr. Anson stated that the owner could add covenants to those approved by the Board but would not be able to delete any covenants without approval of the Board. Discussion was held concerning covenants to be changed or deleted. Commissioner N. Carlson moved to approve the Change of Zone, from A to P.U.D. , with the following changes to the covenants: A(2) 2nd paragraph, words 'per acre' be deleted, and 4th paragraph be deleted, as already marked; A(4) be :amended .shoving that no outside junk storage of any kind bepermmitted; A(5) be deleted; existing A(3)be amended to state refuse moist be removed in an orderly manner; a section be added under Part A stating that plant growth shall be maintained to control erosion; C (2)be eliminated. Where a section has been eliminated the following numbers will be changed accordingly. Commissioner Brantner seconded the motion. Chuck Cunliffe, Planning Department Director, asked the Anard to state for the record the reasons for approval of this request. Commissioner N. Carlson stated he feels this to be the highest and best use of the land, it is not good agricultural land. Chairman C. Carlson stated that the changes they have made in the covenants take care of questions which have been brought up during this hearing. He felt that perhaps no alternatives were presented to the Planning Commission at their hearing. Commissioner Martin stated that this LHR 587 Page 2 RE: COZ HEARING - ADAMS will still remain a largely agricultural area even though it is being approved for residential development, he cannot foresee this area being annexed to a municipality. Commissioner Martin also stated that this seems to be a good use for this ground which has not been usable previously. Commissioner Brantner said there is a need existing for people who want to live away from town and this type of land is only good for this usage. Commissioner Martin also stated that the Board had attempted to address each concern which the Planning Commission gave when recommending denial. Commissioner N. Carlson further recommended that the covenant labeled "access" should be amended to show the access is to be approved by the County Engineer. The motion carried unanimously. There shall be one access to each lot by the use of either Weld County Roads No. 8 or No. 10 . Electricity and natural gas furnished by Union R.E.A. or Public Service may be utilized by the owners of any lot. As sandy as it is, there can be all kinds of erosion problems with wind storms, plus the fact that a subdivision of any kind, whether it be one acre lots or forty acre lots, away from any close proximity to a town still requires all the services of the city. The County has added expenses when it comes to grading the roads and supplying other necessary services. BOB EHRLICH Is voting yes for denial of this request. He wishes to state that he concurs with the comments Jack had, but he is also concerned with the dilemma of Linda McKenna. It seems that it is difficult for a young mother to have a place to raise animals and to be able to give her children some kind of exposure to an agricultural type of life. It is tough to go out and buy a hundred and sixty acres, or even eighty acres, and he would like to see the staff look for some means by which something could be worked out to accomodate such requests in the future , On this particular piece of land the erosion situation, twenty-one horses per lot potential, could be fairly severe and while he does sympathize with the situation Mrs. McKenna is in, based on the presentation of the application, he feels he can only vote for denial on this change of zone. Comprehensive Plan: (1) In order to promote the agricultural economy and to enhance and maintain the quality of life and invironment in Weld County, Developments that utilize non—productive rural land, and water surpluses will be encouraged, particularly where irrigated farm land can be preserved as agricultural greenbelts, and open space. Answer: (1) In proposing use of the described land, we hope to be able to, (1) Raise livestock of various speices so as to improve the breeding, and help in their growth. In order to do this properly, It is necessary to be available at all times. This proposal would improve upon the land, for it would become much more productive then it is at the present time, or then it has been in the past years, as it has ONLY been utilized • as a pasture area during the winter mounths of the year, as well as. some people trying to use it as , (1) A motorcycle race course, (2) Skidoo racing, and (3) Fersons with have NO bussiness with guns, using the livestock as TARGETS. This is very destructive of the property, and the livestock, and can be greatly reduced by the addition of the seven homes, and residences of the One Half of the above mentioned Section ofUeld County, Colorado, for there would be much less chance of persons trying to Kill livestock, and tear up what Vegetation that there is. (1) ( Cont. ) P.U.D. A-1 Answer: The comprehensive plan covers a large area of all that is required to know and be known. The preceding paragraphs state quite a lot about what is asked for by the Commissioners of Weld County. I hope that as you all read further that you will understand and agree that this proposal shell be agreeable and that it does comply with what you have asked for and that you will find it to be consistent with your comprehensive plan. P.U.D. A-2 That the uses wich would be allowed in the proposed F.U.D. District shall be consistent with the performance standards of the P.U.D. District in section 35.3 of the zoning ordinances. A-2 Answer: The proposed land shall be consistent with the performance standards contained in section 35.3 of the zoning ordenances wich apply as can be checked by the maps and comprehensive plan statements. A-3 That the uses wich would be permitted shall be compatible with the existing or future development of the surrounding area as permitted by the existing zoning and with the future development as projected by the comprehensive plans of affected municipalities. F.U.D. A_4 That adequate water and sewer will be available to the site to serve the uses permitted within the proposed F.U.D. District. Comprehensive Plan: 12 (3) a. In all land use decisions, The broad effect of transfer of water usage wich may result from the proposals at hand shall be taken into account. Comprehensive Plan: 12 (3) a. The location of the project and the seven subdivided lots is shown in Figure-1. It is our understanding that the proposed development entails subdividing approximately 280 acres with seven separate lots ranging in size from 35 acres to ( 42 acres. The proposed water supply plan will be from individual exempt wells supplying water for in-house purposes only. The proposed wastewater treatment is through the use of septic systems. Based on an average occupancy of 3.5 persons per residential unit (per lot) , a water supply of 100 gallons per person per day, we estimate the water supply requirements per unit to be 0.382 acre-feet per year (127 ,750 gallons per year or 0.25 gallons per minute) . The property lies within the partially saturated outcrop area of the Arapahoe aquifer and is covered with a 2-feet to 15-feet layer of eolium (wind blown sand, silt, and clay) . There are no prominent alluvial systems (river or stream gravels) from which to obtain water. The Arapahoe aquifer can maintain yields of greater than 100 gallons per minute (gpm) within the Denver Basin proper, but because this area is near the aquifer outcrop (3 miles to 4 miles), a more reasonable estimate is 10 gpm to 30 gpm. For your purposes, a well which maintains a sustained yield of 2 gpm to 5 gpm is sufficient if the proper storage facilities are incorporated. Wells drilled to depths ranging from 250-feet to 400-feet should produce enough water to meet the proposed water requirements. If the drilling is done with air and water rather than mud, the depth to the first water encountered should be noted along with the yield, and if possible, the static water level. If the yield appears to be sufficient, continue drilling another 100-feet (for purposes of well-bore storage) and again test for yield. If the yield is not sufficient, continue drilling to 400-feet and test the well every 100-feet. I MR. ROY MATHEWS January 4, 1983 - 1468/1 - Page Two The quality of water in this area are extremely variable and dependent on local environments, but due to the nearness to the aquifer outcrop, we suspect dissolved-solids concentrations which may be high in sulfate, sodium, and iron. We recommend, at such time when the wells are drilled, water samples be tested to insure the suitability of the water for domestic purposes. In conclusion, we believe that adequate water supply, provided from individual wells drilled on each site, can be maintained to meet the in-house water requirements for the proposed development. Prior to commencing any drilling, well permits must be secured from the Colorado Division of Water Resources (State Engineer's Office) . All applicable requirements of the Colorado Division of Water Resources must be complied with prior to putting the water to the proposed uses.
