Behlen, Public Works Director Subject: Spallone Property Kim, Per our recent conversation the Town is in the process of annexing additional Spallone property. The Town is trying to determine if certain uses/activities are currently permitted by the County. Can you let me know whether or not the following uses/activities are permitted by the Special Use Permit (SUP- 249? or any amendments thereto), granted to Asphalt Specialties, and if not permitted, what type of additional review would be required by Weld County to permit such uses/activities? 1. That sand and gravel mining, processing and production, and transportation of products are a use by right on the property. 2. That importation of aggregate, hardened asphalt and concrete for recycling and processing are a use by right on the property. 3. That unlimited trucking amounts with entrance an exit from both State Hwy. 52 and Weld County Rod. 1 /East County Line Rd. and unhindered direction of travel are a use by right on the property. 4. Hours of Operation shall be from 6:00 AM to 10:00 PM daily. Hours of actual hauling shall be from 7:00 AM to 8:00 PM daily. Maintenance operations are allowed at any time. These operational hours are a use by right on the property. Please provide responses at your earliest convenience and do not hesitate to contact me if you have any questions. Many thanks R. Weld County will be getting an annexation impact report here shortly. When do I have to file the recorded exemption applications to create the three new tax parcels? The applications may come in at any time. By virtue of the annexation, the lands associated with the annexations have created legal yet non-boilable parcels in the eyes of the County County will not approve any building permits or allow any action on the properties until the resolution of the illegal land division. Is this something that can be done in the future when we want to develop the property, or does it have to be done soon?
