RE: GRANT REQUEST TO PREADVERTISE SITE SPECIFIC DEVELOPMENT PLAN AND
USE BY SPECIAL REVIEW PERMIT#1598 - ROCKIES EXPRESS PIPELINE, LLC
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has received a request from Rockies Express Pipeline, LLC, 370
Van Gordon Street, P.O. Box 281304, Lakewood, Colorado 80228-8304, for preadvertisement of
an application for a Site Specific Development Plan and Use by Special Review Permit#1598 for
a Mineral Resource Development Facility, including Natural Gas Processing Facility, in the
A (Agricultural) Zone District, and
WHEREAS, said property is described as part of the SE1/4 of Section 5, Township 11
North, Range 66 West of the 6th P.M., Weld County, Colorado, and
WHEREAS,after study and review the Board deems it advisable to grant said request,with
the hearing date to be set as March 21, 2007, at 10:00 a.m.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the request from Rockies Express Pipeline, LLC, for preadvertisement of
an application for a Site Specific Development Plan and Use by Special Review Permit#1598 for
a Mineral Resource Development Facility, including Natural Gas Processing Facility, in the
A (Agricultural) Zone District be, and hereby is, granted.
BE IT FURTHER RESOLVED by the Board that the hearing date to consider said request
be, and hereby is, set as March 21, 2007, at 10:00 a.m.

Request for Pre-Advertisement

The Department of Planning Services is in receipt of a letter from Rockies Express Pipeline,
LLC requesting consideration for a pre-Advertisement hearing date before this Board. The
applicant has outlined their request in the letter dated January 25, 2007. Two dates that are
important to note is the operational date and the in-service date of December 31, 2007.
Mr. Atwater, representing Kinder-Morgan submitted application documentation for processing
in a timely manner, however, due to the holidays the referral agencies were not able to provide
retum comment in the same manner.
Planning Services notes the urgency in completing the land use application, thus enabling the
applicant to meet their land use permitting obligations and given the tight construction and
operational time frames would be in support of this request.

Re: Early Release Pre Ad Hearing—Case Number USR-1598 —Natural Gas
Compression Facility—Tract in the SE/4 Section 5, Township 11 North, Range 66 West,
Weld County, CO
Gentlemen:
This letter represents Rockies Express Pipeline LLC's (REX) request for an expedited
public hearing date for Case No. USR-1598 by the Weld County Board of County
Commissioners.
REX submitted its Land Use Application for the subject project with the Weld County
Planning Department on December 4, 2006. The urgency to have this case heard by both
the Planning Commission and Board of County Commissioners expeditiously is due to
the following:
1. Kinder Morgan is either completing or will soon begin constructing a 42 inch
natural gas pipeline in Colorado, Wyoming, Nebraska Kansas and Missouri
that will transport natural gas from the Rocky Mountain region to energy
companies and users throughout the United States (Entrega/REX pipeline).
2. The "in-service date" for the Entrega/REX pipeline has been established by
contract to be December 31, 2007 (In-Service Date).
3. The proposed compressor station is an integral and necessary part of
transporting natural gas through the Entrega/REX pipeline and must be
operational before the December 31, 2007 In-Service Date.
4. Construction of the proposed Compressor Station is expected to take eight (8)
months after construction begins. In order to meet the In-Service Date and
finalize all materials contracts for the Compressor Station all local permits
must first be obtained and construction must commence by April 15, 2007.

5. Currently, Case No. USR-1598 is scheduled to be heard by the Weld County
Planning Commission on March 6, 2007. If the application is approved by the
Planning Commission on that date this would mean that under the normal
course the Board of County Commissioners would not hear the request until
the week of May 7, 2007 which would not allow sufficient time for the
Compressor Station to be constructed and operational by the In-Service Date.
Rockies Express Pipeline LLC hereby request that its application for Case No. USR-1598
be heard by the Board of County Commissioners as soon as is feasibly possible after the
Planning Commission approves said application and that both hearings be simultaneously
noticed to further minimize any delays.
