RE: DECLARE CERTAIN EQUIPMENT AS SURPLUS PROPERTY, APPROVE CONTRACT
TO AUCTION WITH RITCHIE BROS. AUCTIONEERS (AMERICA) INC., AND
AUTHORIZE CHAIR TO SIGN
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, State statute and the Weld County Code require that all items disposed of be
declared surplus by the Board of County Commissioners, and
WHEREAS, the County has determined that certain equipment, as described in
Schedule "A"to the Contract to Auction mentioned below, a copy of which is attached hereto and
incorporated herein by reference, is no longer required for County use, and
WHEREAS,the Board has been presented with a Contract to Auction between Ritchie Bros.
Auctioneers(America)Inc.,and Weld County,Colorado,concerning said equipment,with the terms
and conditions being as stated in said contract, and
WHEREAS, after review, the Board deems it advisable to approve said contract, a copy of
which is attached hereto and incorporated herein by reference, and declare said equipment as
surplus.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that certain equipment, as described in Schedule "A," be, and hereby is,
declared as surplus.
BE IT FURTHER RESOLVED by the Board that the sale of said equipment at auction and
the Contract to Auction between Ritchie Bros. Auctioneers (America) Inc., and Weld County,
Colorado, be, and hereby are, approved.
BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized to
sign said contract.

Ritchie Bros. Auctioneers is now a Colorado Motor Vehicle Dealer and is required by
Colorado State Law to provide, along with the title, a new Colorado Emissions

some of the vehicles that we sell at auction go into this area,however, we do not know
which I vehicles those will be until they are sold. Therefore, we are asking all
consignors to provide I Iwitia new IColorado Emissions I Certificate (this needs to be
new one, not the one that was used to get your plates (renewed the last time). An
enhanced emissions test is required'for 1982 and newer gas powered vehicles at an
initial cost of $24.25.'1, A two-sueed idle test is required for 1981 and older gas
'powered vehicles at an initial cost •
pof $15.00. All diesel-powered vehicles require
dynamometer testing at an initial cost of $45.00. If you need enhanced testing
locations, please give as a call.
If you do not wish to provide us with these certificates or you know your vehicle will
not pass, then the following notation will appear in the sale day catalog and be posted
on the vehicle:
"IMPORTANT NOTE TO ALL RESIDENTS WITHIN THE COLORADO AIR
PROGRAM AREA: This vehicle is being sold without an emissions certificate.
Other than a Dealer buying for resale, bidders that are living or commuting in the 10
county Colorado Emissions Control Area, are prohibited by current emissions law
from buying this vehicle."

The law requireslthe seller to provide these certificates, therefore the above notice will
not eliminate this responsibility. It is important that you understand that if you choose
Mis option and the buyer disregards the above notice and Me vehicle does not meet the
Colorado emissions standard, you' n?.ay be required to either correct the vehicle's
deficiencies or refund the buyer their money.
